Representative (Alternate) position.

Mayor Torliatt confirmed that Council had adopted Resolution 2008-012 N.C.S.
Appointing Samantha Freitas as Council Representative (Alternate) to the Sonoma
County Transportation Authority for the Calendar Year 2008.
Motion: Approve Resolution 2008-013 N.C.S. Appointing Steve C. Ayala as Petaluma's
representative on the Marin -Sonoma Mosquito Abatement and Vector Control District's
Board of Trustees for a four-year term expiring December 31, 2012.

PUBLIC COMMENT
Katherine Bobrowski, Petaluma, spoke regarding vehicles parking illegally in mobile home
parks and asked City to ticket these vehicles.

1 Richard Brawn, Petaluma, spoke regarding financial problems he believes the City is on
2 the brink of facing.

4 Tom Brandon, Petaluma, spoke regarding the wastewater treatment facility, and said
5 that employees of Veolia Water all were told they have the right to apply forjobs at new
6 plant. Then Veolia people starting giving notice and leaving. Veolia had to tell the City
7 they were concerned they could no longer run plant because of non-compliance with
8 state regulations.

10 Zen Destiny, Petaluma, thinks individuals returning from Iraq are contaminated with
11 submicron -size radioactive particles and should be monitored.

13 John Hanania, Petaluma, spoke about Council Members who do not attend meetings
14 regularly, and about the Brown Act.

15 bellied pigs from the Zoning Ordinance. The Animal Services Advisory Committee's

Public Comment on Item 4A
Kathy Hayes, North Bay Association of Realtors, regarding the discussion of
point-of-sale mandates that took place at the September Council
Meeting. The real estate community took that discussion and feedback
got together as a group to throw around ideas and suggestions and
formulate questions to help their understanding of the City's annual
targets - mandates and goals beyond mandates. They met with staff in
November. Some real estate companies are asking their agents to have
water audits done on their personal residences to help them understand
the program. They want the program to be able to be marketed heavily
and effectively.

Tiffany Ren6e, Petaluma, asked if groundwater had been removed
from the plan, and said if it had, she commended City. She had questions
about the contingency plan and thought Petaluma should look at
Rohnert Park and the lawsuits underway there. She said this was a "house
of cards" in terms of the water rates initiative on the ballot in November
and hoped the City was working hard to defeat that initiative.

Mayor Torliaft summarized Council direction to re-establish a sustainable
sidewalk maintenance program, with $100,000 allocated annually to this
purpose. The City will subsidize the homeowner's expense 50% from this
$100,000 when damage to the sidewalk is caused by street trees. After
citizens are notified of the need to make repairs to their sidewalk, they will
have 30 days to provide evidence to the City that they have engaged
the services of a contractor to make repairs. They will then have an
additional 6 months to have the work completed.

sidewalk defects were not on private property.

PUBLIC COMMENT
Peter Tscherneff, Petaluma, apologized for what he said what he termed his "misuse of
time" at Public Comment at the January 7 Council Meeting. He decried slaughter houses
and factory farms. He then explained why he thinks Mayor Torliatt would be an excellent
President of the United States.
Doug Millar, Petaluma, said he is supporting Ron Paul for President but the media is not
reporting the candidate's successes in the primaries.
Gerald Moore, Petaluma, told Council Dutra is talking about building an asphalt factory
upstream from Shollenberger Park. He said it needs to be "done right." This is a County
project. A public hearing on the draft EIR will be held on February 7, 2008 and comments
will be accepted until February 27, 2008.
Russell Rosenberg, Petaluma, nominee for Petaluma Community Access (PCA) Board of
Directors, said he wanted to give his unwavering and unsolicited support for PCA and its
Executive Director Julie Akins. He spoke of Ms. Akins' accomplishments since she
became director. He then said he was outraged at the "slurs and accusations that have
been thrown around" by some.

1 Bill Greene, Petaluma, said he has spoken to all involved at Petaluma Community Access
2 (PCA), and has seen no real wrongdoing from either side, but has seen a breakdown of
3 communication.

13 Tom Vasgird, Treasurer, Petaluma Community Access (PCA), Petaluma, thanked the City
14 for negotiating with Comcast on behalf of PCA. Several new members of PCA's Board of
15 Directors will be seated shortly. They are on schedule as for as their budget is concerned.

18 Petaluma for their continuing support and said that, "PCA stands for access to every
19 person who lives in Petaluma."

21 David Glass, Petaluma, spoke regarding the 2005 New Year's Eve Morning flooding,
22 which caused $56 million worth of damage. He said there are decisions that could be
23 made by future Councils that could undermine the work achieved by the Army Corps of
24 Engineers flood control project. He cautioned Council not to erode the flood protection
25 achieved through many hours of legitimate study and analysis.

28 said he doesn't see any wrongdoing in the form of prejudice, harassment or anti -Latino

23 David Glass, Petaluma, said that the information in an CIR could be very
24 helpful when making statements of overriding consideration following a
25 CEQA document and will tell you whether you will be adding new jobs
26 and sales tax. He told Council it is not possible to make decisions that
27 serve well the citizens and businesses of the City without knowing the
28 economic impact of projects you approve. He added, "It's more than just
29 land use."

31 H.R. Downs, O.W.L. Foundation, Petaluma, said O.W.L. supports CIRs
32 because they are like an "audit up front" and show if a project will make
33 money for the community. He said the City is like a corporation and must
34 make money.

36 Nathan Nies, Mail Depot, Petaluma, said as a small business owner and
37 resident he would like to see CIRs required. Council should know, as they
38 are making decisions, how they will affect the community. He likes
39 Petaluma as it is, said businesses here "play well together" and he doesn't
40 think big -box businesses play well with anyone.

42 Tiffany Ren6e, Petaluma, presented Council with a petition that is a result
43 of reviewing the development standards, the public review of
44 development projects and concerns from residents and business owners
45 regarding the direction of commercial development in the General Plan.
46 The Petaluma Neighborhood Association founders and others decided to
47 write a petition around increasing anxiety about two major development
48 projects in the pipeline: East Washington Place and Deer Creek Plaza.
49 Major concerns are outlined in the petition as they relate to smart growth,
50 traffic and greenhouse gas emissions, creating a walkable shopping
51 district, water conservation, and community impacts. The signers want

Council to carefully review in -fill development. CIRs will give Council a
valuable tool for this.
Melissa Abercrombie, Petaluma, read the "Responsible Retail
Development in Petaluma" petition.
Linda Hamm, Petaluma, Petaluma Neighborhood Association, owner of
Early Work Toy Station, spoke about moving her business recently and how
she used Petaluma contractors so the money stayed in town.
David Keller, Petaluma, hoped Council would view CIRs as a "balance
sheet for the community." He said this is an opportunity to get this
information neutrally. Business transactions where the money doesn't stay
here do not do us any good. We need to reinvest in Petaluma, not losing
money to businesses with corporate headquarters elsewhere. Petaluma is
such a desirable community that we can afford to ask for a higher
standard for businesses and development that want to come to town.
Many years have been spent to revitalize the downtown. He told Council,
"Let's not cannibalize it." We need this kind of analysis as a complement
to linkage studies or market studies, to CEQA and land use analysis. He
suggested that CIRs be used for a year, and then Council could review
the effectiveness and "tweak if necessary."
Kevin Kelly, Petaluma, says he has been in 48 of 50 states and nothing
could compare to Petaluma. He feels there is something very special
about this town and he urged Council to take the time to make good
decisions. He quoted social critic and poet John Ruskin (1819-1900), who
said, "When we build, let us think that we build forever."
Sandra Shand, Petaluma, said she had only recently learned about CIRs
and is "absolutely horrified" that we would not be supporting our local
businesses. She said she understands that there is a role for development
but many people are concerned about the long-term implications of
development decisions.
