RUTH®ItIZING ACQUISITION
®F 82 LAKEVII..LE STI~ET
WHEREAS, the Petaluma Community Development Commission has adopted as one of its
priority projects the implementation of the Petaluma River Payran Reach Channel Improvement
Project for the protection of the developed areas in that vicinity from flood damage; and,
WHEREAS, the acquisition of property owned by Lee O. & Phyllis McCann at 82 Lakeville
Street, Assessor Parce1007-071-004, to permit implementation of this priority project; and,
WHEREAS, the Commission authorized its staff to pursue negotiations for acquisition of said
property.
NOW, THEREFORE, BE IT RESOLVED that the Petaluma Community Development Commission
hereby
1. Authorizes the Chairman or its Executive Director to enter into and execute all
documents necessary between the McCanns, owners of the property at 82 Lakeville Street, and the
Petaluma Community Development Commission relating to acquisition of the property for $180,000
plus $1,100 escrow charges.
2. Finds that these actions were evaluated under the final Environmental Impact Report
and Environmental Impact Statement adopted for this project and are consistent with the General
Plan. Portions of the project may be exempt from CEQA guidelines under one or more of
§ 15061(b)(3), § 15304, § 15312, § 15325(d), and/or § 15326.
Adopted by the Petaluma Community Development Commission this 21st day of January ,
1997, by the following vote:
Ayes: Read, Keller, Torliatt, Maguire, Chairman Hilligoss
Noes: None
Absent: / Stompe, Vice Chairman Hamilton
