SECONDED BY COUNCILMAN ABLISH'ING PRECISE PLAN LINES OVER CERTAIN PROPERTY °HEREINAFTER DESCRIBED FOR THE RESERVATION OFIA FUTURE RIGHT-OF-WAY FOR THE PROPOSED REALIGNMENT OF A PORTION OF MAGNOLIA AVENUE AND EXTENSION 'OF LIBERTY STREET. BE IT ORDAINED BY THE COUNCIL OF THE.CITY. OF PETALUMA AS FOLLOWS: Section le ,That the City Council finds that the Planning Commission filed with the; City Council on the 5th day of September, 1968 its report and affirmative recommendation relative to the establishment of precise plan lines along the .planned realignment of Magnolia Avenue,and extension of Liberty Street, which proposed realignment and.exten.sion is more partic ularly described and bounded as follows: Precise plan lines are to be. set along the_ south side of Magnolia Avenue from_. -Petaluma Boulevard North to Keokuk Street and along the north side of Magnolia Avenue from Pet- aluma Boulevard North to a point approxim- ately 200 feet westerly of .the centerline of Keokuk Street. And precise plan lines are to be set for the future extension of Liberty Street projecting northerly from the northerly line of West Street to the southerly line of Cherry Street and from the northerly line of Cherry Street to Mag nolia Avenue, which proposed.widening and al-ignment is more particularly described in the map drawings, Eng.. C-17, entitled, "'Mag- . viol -,a Avenue and Liberty Street, Right-o,f=Way Acquisition Maps", No. Eng. C-17, dated Jan-. uary 1967 and on file in the office of.the Director of Public Works, City of Petaluma., That said recommended precise plan lines are further d_es.%gnated and shown on that certain map or plat attached hereto, designated Exhibit "A" and by reference made,a part hereof. The City Council further finds that said Planning Commission held. -.a hearing on said proposal to establish precise plan lines on September 4, IRE& after having received the report and recommendation of the Department of Public Works, and after having given notice of the hearing in the manner, for the period and in the form required by Ordinance No. 597 N.C.S. Section 3. The City Council further finds that Notice of the public hearing required to be held by the City Coun- cil upon receipt of the Planning Commission report and recommenda- tion, as aforesaid, and as set forth, in Resolution No.525:3 N.G.S., duly adopted by this Council on .Tan :16;'� 19'69, was given in the manner, for the period and in the form required by Ordinance No. 597 N.C.S. Section 4, The City Council further finds that, after public hearing, no protests or objections to said proposed precise plan lines which should be sustained were received; and that no chanaes or modifications should be made to the said proposed pre- cise plan line report and recommendation of the Planning Commission; and that the public safety, comfort, convenience, interest and wel- fare required the adoption of the recommended precise plan lines hereinbefore described, and that the recommendation of the Planning Commission, as aforesaid, is consistent with the purposes of Ord- inance No. 597 N.C.S. as set forth in Section 21,51 thereof. Section 5. That pursuant to Article 21.63 of Ordinance No. 597 N.C.S., the City Council hereby orders the. es..tab.lishment of the Precise. Plan Lines described hereinabove, and further desig- hated on Exhibit "A" attached hereto and by refetrence made: a. part hereof without change or modification of any kind. -2- i A Section 6.. The City Clerk be, and she is hereby directed to publish this ordinance, including the map or plat attached hereto and designated Exhibit "A", in the Argus Courier, the official newspaper of the City, for the period and in the manner required by the City Charter.
