PERMITS -MAY BE GRANTED AND - TO, ESTABLISH. S'P,ECIAL CONDITIONS FOR THE GRANTING OF USE PERMIT- WITH. REGARD,--T0 SERVICE STATIONS. BE IT ORDAINED BY THE COUNCIL.OF'ThE.CITY :OF'PETALUMA AS FOLLOWS.: Section 1. . Article 1.,.:Section 17551 of Zoning 'Ordinance No..66:2 N.C.S.. is hereby amended to read as follows: "`SERVICE - STATION" - a retail place-o business:engaged pri- marily in the sale of motor fuels, but. -also in: supplying goods and services generally.- required in the operation-an'd maintenance of motor vehicles. These, may include sale- of petroleum products; sale and servicing; of- alres; batteries; automotive accessories - _arid - replacement items -; lubrication- _ services ;Washing of cars.where:no chain conveyor or- ,blower used. Operations outside s al'l he, limited to tlie` dis- pensing of gasoline, , .oil and water ; changing tires,. re- placement. and adjustment of automotive' accessories such as windshield wipers; lights - and "batte -r:ies and similar minor customer needs." -. - -• Section 2 - . Article 18, Section 18-7 of Zoning Ordinance No. 662 N.C.S. is hereby amended to read as.fo1.lows-.' "18-701 The City Planning Commission may grant an appli- cation for.a use pe..rZit.',as1thb use-permit was applied for or in modified form if, on,the the ap-- plication and the 6videft6e the-Commission makes the following findings: a. That the,proposed'locat of the.conditional use-is'in accord with the , . of the. zoning ordinance and the',purpo'sps of the di trict in which the site is,located;. b. That the proposed conditional use will comply with each of the applicAbleprovLsions of this ordinance. 18-702 In addition to the findings required by Section 18-701 a, b - and c above., the City. Planning Commission may grant an application fo'r,a. use permit for a ser- vice station, as the use permit was. applied for or in modified form, if, on the basis of th-e - application and the evidence submitted:, theCQmmission - makes the ing findings: MM :a. That. the propos:ed'lo`catdon -of the conditional use does not create .more than two' (2) service station sites at any *street intersection; b. That the -service -station site Area has a minimum of 15,0.'00 square feet for -a-two-bay station, plus 0 2,000 square. feet,for each - additional bay pro- posed to.be constructed. The lot frontage,'if located on -A major street, shall be 125 feet; C. Buildings of Type IV'constructlion, as defined in the Uniform Building Code'i are to be located at a distance of not less than 10 feet from Property or building setback lines, (EXCEPTION: Structures having two-hour fire wall construction may be lo- cated at less than the - minimum distance herein specified provided' buildings conform with the requirements of the liniform Bu''ilding.Code); d.
