TO PROVIDE -FOR THE- SUBMISSION OF SOIL REPORT,
SOIL INVESTIGA!TI`ONS AND APPROVAL OF-CORRECTIVE
A.CT.IONS AT THE TIME OF THE. FILING OF A. FINAL
SUBDIVISION MA.P.
BE IT ORDAINED BY CITY COUNCIL OF-THE CITY OF 'PETALUMA AS FOLLOWS:
Section 1 . Chapter 22, Article III, Section 22.23 of the
Petaluma City Code of 1958 is hereby amended.to read-as-follows:
Section 22.23 A.ccompanyinq 'd'ata At the time of the filing of a
final map with the Director of Public Works, a subdivider shall also
file therewith the following:
(a) In.the event any dedication is to,be made for the - public
use, a preliminary title report issued by a title insurance
company, in-the name of the owner of the land, issued to or
for the benefit and protection of the City, showing all
parties whose consent is necessary to pass clear title to
the land being subdivided, together w th.the nature of their .
interests therein, except where.the land embraced in such
subdivision is registered under the Land.Registration Act,
also known as the Torrens Act. If the land is so registered,
a certified copy of the certificate of title shall be fur-
nished..
(b) The inst =rument prohibiting traffic over the side lines of a
major highway -, parkway, street or freeway, when and if.the
same is recruired under Section 22.46 of this Code.
(c) Calculation and traverse sheets used in computing the dis-
tances, angles and courses shown on the final map and ties
to existing and proposed monuments..
(d) A. preliminary soil report prepared by a civil engineer who
is registered by the State of California, based upon ade-
quate test borings or excavations of -every subdivision, as
defined in.Sections 11535 and 11535.1 of the Business and
Professions Code. The preliminary soil report may be- waived
if the City of Petaluma Building Department shall determine
that, due to the knowledge of such department as to the soil
qualities of the subdivision, no preliminary analysis is
necessary.
(e) If the preliminary -soil report indicates the presence of
critically expansive soils or other soil problems which, if
not corrected,.would lead to structural defects, a soil in-
vestigation of each lot in the subdivision may be required,
prepared by a civil engineer who is- registered by.the State
of California. The soil - investigation shall recommend cor-
rective action which is likely to prevent structural damage
to each.dwelling proposed to be constructed on expansive or
unstable soil. The report shall be filed with the City of
Petaluma Building Department.
(f) The City of Petaluma Building Department shall approve the
recommended corrective action if it determines that the
recommended corrective action -is likely to prevent structural
damage to each dwelling to be constructed on each lot in the
subdivision. Appeal from such determination shall be to the
Board of Building Appeals. Building permits shall be con-
ditioned upon the incorporation of..the approved recommended
corrective action in-the construction of each dwelling.

Section 2 . The City Clerk -be, and�she is hereby directed
