HomeMy WebLinkAboutStaff Report 3.E 08/07/2017Agenda Item #3.E DATE: August 7, 2017 1d; TO: Honorable Mayor and Members of the City Council through City Manager FROM: Dan 't. -SCE —Director, Public Works and Utilities Curtis B es, P.E. — City Engineer SUBJECT: Resolution Authorizing Grading for the Brody Ranch Subdivision Prior to Final Map Approval. RECOMMENDATION It is recommended that the City Council adopt a Resolution Authorizing Grading for the Brody Ranch Subdivision Prior to Final Map Approval. BACKGROUND The Brody Ranch Subdivision, shown on vicinity map as Attachment 2, consists of 61 single - family homes and 138 multi - family units. The project site is located at 360 Corona Road (APN: 137- 061 -040). The subdivision received tentative map approval by the City Council on January 9, 2017. The final map and improvement plans have been submitted to the City of Petaluma and are currently in the review process. The developer, DeNova Homes, is requesting permission to commence grading activity on the subdivision site prior to final map approval. According to section 20.36.010 of the Petaluma Municipal Code, no permanent improvement work shall be commenced until improvement plans and profiles have been approved by the City Engineer and a subdivision improvement contract has been executed in writing between the subdivider and the City. These approvals follow the Council's approval of the final map for the project, which has not yet occurred. The project final map is anticipated to come before the City Council for consideration in late summer or early fall of 2017. Grading is not considered a permanent improvement as defined in this section and by policy, the City requires the developer to enter into a grading agreement and provide a surety to secure the performance of any grading work that occurs prior to the final subdivision improvement contract. DISCUSSION The recommended resolution included as Attachment 1 addresses the developer's request in Attachment 3 and would allow the Brody Ranch site to be rough graded and the underlying soils to be prepared for construction in advance of issuance of permits for site and building improvements, which are anticipated to start in fall of 2017. The grading plan for the Brody Ranch Subdivision has been carefully reviewed and is approved for construction pending City Council authorization. The geotechnical report required for rough grading was reviewed and the report recommendations are appropriate for the grading request and final development proposal. If the subdivider fails to secure final map approval, or the project is abandoned after the grading is complete, the subdivider is required to restore the graded area to its prior condition as stated in the grading agreement. FINANCIAL IMPACTS The proposed action has no unanticipated financial impacts to the existing City budget. The final map and improvement plan applications for the Brody Ranch Subdivision are subject to 100% cost recovery for staff time spent reviewing the grading plans to the final map and improvement plans. This action does not impact the General Fund. ATTACHMENTS 1. Resolution Authorizing Grading 2. Vicinity Map 3.
