Summary Statement: North Bay Construction, Inc. has completed the construction contract for the Petaluma Boulevard North Bike Lane Project for $370,929.52. Acceptance of this project is recommended. C00200108 RECOMMENDATION: City staff recommends City Council adopt the resolution accepting completion of the construction contract for the Petaluma Boulevard North Bike Lane Project. 2. BACKGROUND: The City and County of Sonoma desired to jointly construct bike lanes on Petaluma Boulevard North. The project, which was included in the FY 07-08 CIP budget, began at Shasta Avenue and continued north past the city limit to Bailey Avenue, near the Twin Bridges in the County. It called for widening the shoulders at certain locations to provide adequate width for construction of bike lanes. Through a design consultant, Department of Public Works staff prepared plans and specifications for this project. The Notice Inviting Bids was issued on May 20, 2008, and bids were received and opened on June 25, 2008. City Council awarded the construction contract to North Bay Construction, Inc. on July 21, 2008. The contractor, North Bay Construction, Inc., has satisfactorily completed the work. Per contract requirements, the 10% retention will be released sixty days after Council acceptance of the project. 3. DISCUSSION: Staff recommends accepting completion of the construction contract for the Petaluma Boulevard North Bike Lane Project, since the contractor has fulfilled all contract requirements. Approval of this resolution will assure release of retention to the contractor. 4. FINANCIAL IMPACTS: The final construction cost is $370,929.52, which is funded by a BTA Grant in the amount of $333,391.45(89.88%), and PCDC in the amount of $37,538.07(10.12%). The approved budget for construction is $384,902.85 (low bid) plus $58,000 for a total of $442,902.85. The final construction cost was less than the bid amount due to under -runs in both asphalt paving and the amount of contaminated soil removed from the site. C00200108 WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Petaluma Boulevard North Bike Lane Project ("Project"); and WHEREAS, bids for the Project were opened on June 25, 2008 in accordance with California Public Contract Code Section 4104.5 and other applicable law; and WHEREAS, the apparent low bid for the Project was the bid of North Bay Construction, Inc. in the amount of $384,902.85; and WHEREAS, by Resolution No. 2008-139 adopted on July 21, 2008 the City Council of the City of Petaluma found the bid of $384,902.85 for the Project to be the lowest responsive bid and awarded the Project to North Bay Construction, Inc. in the amount of $384,902.85, conditioned on North Bay timely executing the Project contract and submitting all required documents, and authorized and directed the City Manager to sign the Project contract on behalf of the City upon such timely submission and to execute on behalf of the City any change orders and other amendments to the Project contract that were necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City so long as such change orders or amendments did not result in an increase in excess of $58,000; and WHEREAS, the following change orders affecting the Project amount have been approved: Clime Order No. Description Amount 1. Substitute aggregate base for imported fill 0.00 Total change orders: $4,625.07 Im WHEREAS, the final contract amount, as amended, including all change orders is $370,929.52; and WHEREAS, City staff have inspected the Project and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: The Petaluma Boulevard North Bike Lane Project No. C00200108, with a final contract amount of $370,929.52, is accepted as complete, subject to the Contractor's completing the punch list work prior to release of the retention, continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project contract, California Public Contract Code Section 7107 and applicable law. 4 Location Map
