PUBLIC COMMENT
Gerald Moore, Petaluma, spoke about the Audubon Society's Christmas Bird Count, and the first
annual "Christmas Bird Count for Kids" which will be on December 29, 2009, an activity co-
sponsored by the City of Petaluma Parks and Recreation Department and trained docents
counting birds in the wetlands.
Zen Destiny, Petaluma, spoke about the Nobel Peace Prize, the war, said he is a strong
white man from the South and doesn't pander to minorities. He further stated that if there is any
attempt by the City to control his free speech he will seek judicial relief.
Richard Brawn, Petaluma, said the City Council has done a good job of maintaining the status
quo. However, over the past decade, he thought the City has lived beyond its means. He stated
that the City needs to go into survival mode. He wondered, "What is it going to take for this City
to survive in 2010 and 2011 ?"
Katherine Bobrowski, Petaluma, said there is no on-site manager at her mobile park and left
pictures for Council of various problems.

Charles Cook, International Vice President for Amalgamated Transit Union, Washington,
D.C., stated that he represents employees of MV Transportation here in Petaluma. He
encouraged the City Council to extend MV's contract for at least 6 months and maybe
even reconsider putting it out to bid.
Motion: Approve 3.1). Resolution 2009-201 N.C.S. Authorizing City Manager to Execute a
First Amendment to the 2007-2009 Contract with MV Transportation, Inc. to Extend the

Batch Plant Project. (Brown/Danly) - Continued from the December 7, 2009 City
Council Meeting.

Jason Davies, Berkeley Integrated Audio Software, Inc., Petaluma, thanked the
Council for taking a stance on this position in support of our City. He sees the
issue as a challenge to the City's sovereignty.
2 Gerald Moore, Petaluma Wetlands Alliance, Petaluma, said they have been
3 meeting for almost four years with Dutra and the County about this project. The
4 project will be worse than the EIR states because the EIR does not address
5 rubberized asphalt. He told Council "The issue is our health and the health of our
6 wildlife community."

Heidi Rhymes, Petaluma, stated that that the City's unanimous support has been
very valuable this past year. She asked, "How ironic would it be to place an
asphalt plant next to a place where we teach about conservation?"
Joan Cooper, Friends of Shollenberger Park, Petaluma, stated that she is a
representative of over three thousand people that have signed a petition online
for Friends of Shollenberger Park. All three thousand people are together in
opposition to the plant.
Margie Goolan, Save Shollenberger Park, Petaluma, spoke of the economic risk
Petaluma will face with the installation of an asphalt plant at Haystack Landing.
She stated that the plant will depress real estate values for home and
commercial properties.
Alan Pendley, Petaluma, thanked the entire City Council for taking such a
strong stand with the letter. He said that it was "absolutely critical to the
community's opposition that the political leaders stand with us."
Mike Orton, Trout Unlimited, Petaluma, stated that he sent a letter to the County
as a representative of Trout Unlimited and it extended out of a workshop on
riparian water rights that he attended at the State Water Regency Control Board.
David Keller, Petaluma River Council, Petaluma, wanted to echo the thanks and
gratitude of people in the City and the region for the Council's unanimous
support for the petition that this not the right place for an asphalt plant.
Tom Brown, President, North Bay Rowing Club, Petaluma, thanked the Council for
the unanimous decision to send their original letter. He provided a copy of a
letter that his Club has sent to the Board of Supervisors. Their primary concern is
the navigational issue.
Sheri Chlebowski, Petaluma, thanked the Council for their support. She stated
that "There is no way an asphalt batch plant of any type or size is appropriate at
Haystack Landing."
Wayne Clark, Petaluma, wanted to stress the fact that Dutra's mailers are faulty.
He stated that Dutra cannot be trusted and "they are not a good neighbor."
Lindsay Mickels, Friends of Shollenberger, Petaluma, stated that "The idea of
putting of putting an asphalt plant here ... is so blindingly stupid, that I am left
breathless." What is left to debate?

Ordinance 2300 N.C.S., to Redesignate from R5 to MU2 the Property Known as the
Silk Mill, Located at 450 Jefferson Street, APN 007-163-002, as amended to
remove condition #55 as it is a duplicate of condition #50; and to add
requirements that: (1) Two parking places contain the infrastructure necessary to
install future charging stations for electric cars; (2) The outdoor fire pit be fueled
by natural gas.
