SUBJECT: Second Reading for Basin Street and Pinnacle Ridge Ordinances
At a Special City Council Meeting on Monday, December 8, 2008, Council introduced two
ordinances:
• Ordinance Authorizing Execution of First Amendment to Parking Garage Easement
and Operating Agreement By and Among the City of Petaluma, Petaluma Community
Development Commission (PCDC), Basin Street Properties, and Petaluma Theatre
District Parking, LLC and Accepting Easement.
• Ordinance Approving a Planned Unit District (PUD) Amendment, Including the Unit
Development Plan and Development Standards for the Pinnacle Ridge Subdivision
Project Consisting of Eleven Single -Family Residential Units Located at 2762 `I' Street,
APN 019-401-019, Project File No. 05-ZOA-0029-CR.
Both ordinances had a second reading and were presumed adopted at the Regular City Council
Meeting of Monday, December 15, 2008. However, neither ordinance was introduced with a
unanimous vote of Council, nor was a separate motion passed to permit posting rather than
publication to advertise the ordinances before second reading and adoption. The ordinances
were posted on the bulletin board at City Hall, but were not published prior to the December 15
actions. The City Charter, Article VII, Section 45 requires advertisement by publication prior to
adoption of an ordinance, unless there is a unanimous vote to permit posting. To cure this
potential procedural defect, the ordinances were published in the Petaluma Argus -Courier on
December 18, 2008 and can now be re -adopted.
Both ordinances will be presented to Council for re -adoption at the meeting of Monday, January
5, 2009. The re -adoption affects only the ordinances which were part of each agenda item, not
the resolutions which were also passed for each item.
