Recommendation: It is recommended that the City Council take the following action:
Adopt the resolution authorizing award of contract and approving a new project budget
Summary Statement:
The Airport Underground Storage Tank Removal Project, as approved in the FY 08/09 CIP Budget, generally
includes removal and disposal of three, 12,000 -gallon underground storage fuel tanks, testing for soil
contamination, site work excavation, associated electrical and utility work, and restoration of concrete and asphalt
surfaces at the Petaluma Municipal Airport. Removal of the three tanks is mandatory per State regulations.

STORAGE TANK REMOVAL PROJECT NO. C001 00208 AND APPROVING A NEW PROJECT
BUDGET
RECOMMENDATION:
Adopt the resolution authorizing award of contract and approving a new project budget.
2. BACKGROUND:
A Public Works consultant prepared the plans and specifications for the Airport Underground
Storage Tank Removal Project. The Notice Inviting Bids was issued on November 25, 2008,
and bids were received and opened on December 18, 2008 as follows:

The engineer's estimate for the construction is $100,000.
With a bid of $83,000, the apparent low bidder is Bay Pacific Pipeline, Inc. of Novato,
California. This contractor has satisfactorily performed similar projects for other cities in
Northern California. Staff verified that Bay Pacific Pipeline, Inc. possesses a valid Class A
California contractor's license No. 524020, as well as a Hazardous Substance Removal
Certificate, which qualifies them to perform the work.
3. DISCUSSION:
In accepting the Airport Fuel Tank Upgrade, Project on February 25, 2008, Council was
informed that, to comply with the California Fire Code and California Code of Regulations
Title 23, the three decommissioned underground storage fuel tanks would have to be removed
within a year of being taken out of operation. The City had been given notice on November,
27, 2007 by the Fire Marshal that removal of the UST's would be required by October 9,

2008. However, to allow the City to complete design plans and specifications, the City Fire
Marshall agreed to extend this deadline until June 2009.
The specific code requiring closure and removal within 12 months of abandonment (with a
possible 12 month extension) is CCR Title 23 Water, Division 3 State Water Resources
Control Board and Regional Water Quality Control Boards, Chapter 16 Underground Tank
Regulations, Article 7. Underground Storage Tank Closure Requirements.
At this time, staff recommends authorizing City Manager to enter into contract with the low
bidder, Bay Pacific Pipeline, Inc., to allow removal of the underground storage tanks. If not
awarded at this time, the City will not meet State requirements and could potentially face
fines.

The estimated total project cost, including planning, design, construction, administration,
inspection, testing, and contingency is $173,984. IIowever, there is a possibility that additional
excavation will be needed if soil contamination is found during the tank removal process.
$197,000 was approved in the 08-09 Budget.

RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE AIRPORT
UNDERGROUND STORAGE TANK REMOVAL PROJECT NO. 000100208
TO BAY PACIFIC PIPELINE, INC. AND APPROVING A NEW PROJECT BUDGET
WHEREAS, through a design consultant, City staff has prepared construction bid documents
and advertised for construction of this Project; and
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California
Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project;
and
WHEREAS, the project was bid on December 18, 2008, and nine (9) bids were received and
opened in accordance with applicable law; and
WHEREAS, the lowest bid for the Project was from Bay Pacific Pipeline, Inc. for $83,000; and
WHEREAS, the CIP budget, which included a total budget for Project No. C00100208 of
$197,000, was approved; and
WHEREAS, staff has determined that Bay Pacific Pipeline, Inc.'s bid satisfies the bidding
requirements for the Project; and
WHEREAS, staff has verified that Bay Pacific Pipeline, Inc. possesses a valid California
Contractor's License, Class A, number 524020, that qualifies Bay Pacific Pipeline, Inc. to perform the
Project; and
WHEREAS, the Project has a Categorical Exemption pursuant to the California Environmental
Quality Act ("CEQA") pursuant to Article 19, Section 15301 and/or 15330 of Title 14 of the California
Code of Regulations ("CEQA Guidelines"); and
NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council hereby:
1. Approves the project budget in the amount of $175,000.
2. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract
Code Section 20162 and other applicable law, waives any and all non-conformance in the bid of Bay
Pacific Pipeline, Inc. for the Airport Underground Storage Tank Removal Project, finds the bid of
$83,000 to be the lowest responsive bid and further finds that Bay Pacific Pipeline, Inc. is the lowest
responsible bidder.
3. Directs staff to issue a notice of award to Bay Pacific Pipeline, Inc.
4. Authorizes and directs the City Manager to execute the project contract on behalf of the City of
Petaluma upon timely submission by Bay Pacific Pipeline, Inc. of the signed project contract and all
other required documents, including but not limited to, executed bonds, certificates of insurance, and
endorsements, in accordance with the project bid documents.
