Summary Statement: The Fox Hollow Park Project, as approved in the FY 08/09 CIP Budget, generally includes new concrete pavement, concrete turf header, concrete curb and gutter, metal edge, removable bollards, picnic tables, benches, trash receptacles, solar lights, planting and automatic irrigation, associated grading and drainage, earthwork, water, electrical and utilities work, and other work specified in these special provisions and as shown on the plans for Fox Hollow Park, dated October, 2008. Staff is recommending the project also include alternates 1 and 2 to create the areas for play structures, which entail earthwork, storm drainage, concrete play curb, play area accessible ramp, and safety surfacing. C00400305 RECOMMENDATION: Adopt the resolution authorizing award of contract 2. BACKGROUND: A design contract was awarded for the Fox Hollow Park Project in 2006; however was not executed. The estimated cost to complete the project ($829,000), as conceptualized, exceeded funds available ($301,000). In order to fulfill a longstanding commitment and move the project forward, the concept and design were revised and narrowed in scope, and final design was initiated in February 2008. A Public Works consultant prepared the plans and specifications for the Project and the Notice Inviting Bids was issued on November 25, 2008. On December 18, 2008, a total of ten (10) bids were received, of which nine (9) were considered responsive. One (1) bid was considered non-responsive; therefore, it was not read and was rejected due to failure to respond according to specifications. These bid results differed from the December l8 bid opening amounts due to mathematical errors on either bid summation and/or bid line item extensions. The engineer's base bid estimate for construction is $196,000. NESSCO Construction Inc. was the apparent low bidder with a total bid of $189,958.20, which includes base bid and bid alternates 1 and 2. NESSCO has satisfactorily performed similar projects for other cities in Northern California. Staff verified that NESSCO possesses a valid Class A California contractor's license No. 765763, which qualifies them to perform the work. DISCUSSION: Staff recommends authorizing City Manager to enter into contract with the low bidder, NESSCO Construction, Inc., to construct Fox Hollow Park and to include both bid alternates. If not awarded at this time, the City will still be accountable for building the park in the future. 4. FINANCIAL IMPACTS: The following is a breakdown of the estimated costs The estimated total project cost, including design, legal counsel, construction contracts, overhead and contingency is $278,650. $301,000 was previously allocated to the 4 -acre Fox Hollow Park from Parkland Acquisition and Development Fees, collected specifically from subdivisions surrounding Fox Hollow Park. $22,350 was previously spent on tree trimming and thinning a very old grove of Eucalyptus trees for safety reasons in anticipation of developing the property as a park site. In addition to the Parkland Acquisition and Development Fees funding, a Fox Hollow Park neighborhood group was formed, and in collaboration with Parks and Recreation staff, has been collecting donations in order to purchase play equipment. To date, this group has raised $13,649, which is likely sufficient for the installation of one play structure. Funds remaining at the completion of the project will be utilized toward purchase and installation of additional play equipment. C00400305 TO NESSCO CONSTRUCTION, INC. WHEREAS, through a design consultant, City staff has prepared construction bid documents and advertised for construction of this Project; and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS, the project was bid on December 18, 2008, and nine (9) responsive bids were received and opened in accordance with applicable law; and WHEREAS, the lowest bid for the Project was from NESSCO Construction, Inc. for $189,958.20; and WHEREAS, the CIP budget, which included a total budget for Project No. C00400305 of $301,000, was approved; and WHEREAS, staff has determined that NESSCO Construction, Ine.'s bid satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that NESSCO Construction, Inc. possesses a valid California Contractor's License, Class A, number 765763, that qualifies NESSCO Construction, Inc. to perform the Project; and WHEREAS, the Project was included in a Mitigated Negative Declaration (Willow Glen Planned Unit Development) that was adopted by the City on April 7, 1997 pursuant to the California Environmental Quality Act ("CEQA"); and NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council hereby: I. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non-confomiance in the bid of NESSCO Construction, Inc. for the Fox Hollow Park Project, finds the bid of $189,958.20 to be the lowest responsive bid and further finds that NESSCO Construction, Inc. is the lowest responsible bidder. 2. Directs staff to issue a notice of award to NESSCO Construction, Inc. 3. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by NESSCO Construction, Inc. of the signed project contract and all other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents.
