Summary Statement: The City of Petaluma, Sonoma County Transportation Authority (SCTA), and Caltrans are partnering on delivery of the East Washington Interchange Project component (Project RDA100280) of Caltrans' Marin/Sonoma Narrows, Segment C (MSN -C) High Occupancy Vehicle (HOV) Project. After several team discussions regarding funds needed to construct East Washington Interchange and to complete full design of MSN -C, it has been determined that there are sufficient funds to achieve both objectives. Total secured funding is $1M in demonstration funds (federal), $9.5M in Measure M funds, $13.5M in SAFETEA-LU (federal) funds, and $4M in PCDC funds for a total $28M in available funding. The estimated total cost of the interchange component is $21.5M. Estimated cost for the design portion of the MSN -C Project (from Route 116, east to Old Redwood Highway in Petaluma) is $6.5M. The total estimated cost to complete both design/construction of the East Washington Interchange Project and full design of the MSN -C Project is $28M. It is anticipated that a stimulus bill will be enacted February 15, 2009. Once enacted, and if included, the East Washington Interchange component would be required to be brought to construction within two years. Consultants for the City have determined that, although challenging, the time schedule would be possible. Design of the sound wall portion of the MSN -C Project could also be advanced as a standalone project, malting it eligible for inclusion in a separate stimulus package. At their meeting of December 8, 2008, the SCTA Board of Directors indicated a preference to complete design of the entire MSN -C Project, including design of the East Washington Interchange component, and to build the sound walls within the MSN -C project area within Petaluma, with funds already allocated for the interchange component, and to defer funding construction of the interchange until additional funding became available. However, since that meeting, the funding plan has been re-evaluated by City staff, the City's consultant, and SCTA staff, and it has been determined that ample funds would be available to complete both design/construction of the interchange and design of the entire MSN -C Project. It should be clarified that, according to the 2007 Measure M Strategic Plan, the specific limits of the MSN -C Project extend from Route 116 (east) to Old Redwood Highway in Petaluma. That the improvements are of benefit to the project area or the immediate neighborhood in which the project is located; 2. That no other reasonable means of financing the improvements is available to the community; 3. That the payment of funds for the cost of the improvements will assist in the elimination of one or more blighting conditions inside the project area, and will be consistent with the implementation plan adopted by the redevelopment agency; and WHEREAS, the Petaluma Community Development Commission ("PCDC") Five -Year Implementation Plan ("Implementation Plan") for the Central Business District ("CBD") and Petaluma Community Development ("PCD") areas (collectively, the "Project Areas") provides for the transfer of certain specified tax increment funds for the purpose of funding roadway reconstruction and related improvements ("Public Improvements") to arterial and collector streets as more particularly described in the Implementation Plan; and WHEREAS, the City of Petaluma, SCTA, and California Department of Transportation are partners in the delivery of improvements to the Highway 101 corridor (known as Segment C of the Marin/Sonoma Narrows Project, or MSN -C) that will include adding a high occupancy vehicle lane (HOV) in each direction, from Old Redwood Highway to Route 116, improving on- and off -ramps, and providing traffic management technologies that maximize congestion management in the corridor; and WHEREAS, the Implementation Plan provides for the use of $4 million in tax increment funds for the purpose of funding the right-of-way acquisitions and construction of the East Washington Interchange ramp improvement component of Caltrans' Marin/Sonoma Narrows, Segment C (MSN -C) Project as more particularly described in the Implementation Plan (collectively, "Public Improvements") within the Project Areas and for the benefit of the Project Areas; and WHEREAS, on December 19, 2005, by Resolution No. 2005-20, the Petaluma Community Development Commission authorized the Executive Director to allocate $4M from PCDC account undesignated fund balance to East Washington Interchange component (Project RDA100280, previously C500306) of the MSN -C Project; and WHEREAS, PCDC and City staff are aware of no other local source of funds reasonably available to undertake the City's share of funding for the Public Improvements, as the only other source available for such purpose would be City general fund revenues which are committed for the provision of essential services such as police and fire services; and WHEREAS, the Public Improvements are of benefit to the Project Areas and/or the immediate neighborhood in which the Public Improvements will be located, regardless of whether the Public Improvements are in another project area, in that they will facilitate improvement to the traffic circulation along the East Washington Street corridor and facilitate redevelopment of large parcels of vacant and underutilized land; and WHEREAS, payment of funds for the Public Improvements will eliminate blighting conditions in the Project Areas in that they will facilitate improvement to traffic circulation and pedestrian/vehicular safety along the East Washington Street corridor and facilitate redevelopment of large parcels of vacant and underutilized land; and WHEREAS, current funding for the East Washington Street Interchange component (Project RDA100280) of the MSN -C Project and design of the full MSN -C Project consists of $1M in demonstration funds (federal), $9.5M in Measure M funds, $13.5M in SAFETEA-LU (federal) funds, and $4M in PCDC funds for a total of $28M in available funding; and WHEREAS, the current estimated Interchange Project cost, including right-of-way land acquisition, is $21.5M, and design of the MSN -C Project is estimated at $6.5M, for a total cost of between $28M; and WHEREAS, the Petaluma Community Development Commission has determined that it is in the best interest of the community to continue pursuing right-of-way acquisition of Plaza North, Plaza South, and Regency shopping centers, construction of the East Washington Interchange Project and full design of the MSN -C Project; and, WHEREAS, to move both Projects forward, Petaluma Community Development Commission urges the Sonoma County Transportation Authority to designate all Measure M funds from the Marin/Sonoma Narrows, Segment C (MSN -C) Project to fund the East Washington Interchange Project RDA100280 (previous project number C500306) and complete design of the MSN -C Project; and WHEREAS, it is anticipated that federal stimulus packages from the State or federal level will be enacted over the next few months, for which Project RDA 100280 may be eligible for inclusion. NOW, THEREFORE, BE IT RESOLVED that Petaluma Community Development Commission: I . Adopts the factual recitals above as true and correct and as its findings. 2. Based upon the foregoing, finds that (i) the expenditure of tax increment funds to undertake the Public Improvements as set forth in this Resolution and the Implementation Plan will be of benefit to the Project Areas, (ii) no other reasonable means of financing the Public Improvements is reasonably available, (iii) completion of the Public Improvement will eliminate blighting conditions in the Project Areas; and (iv) completion of the Public Improvements is consistent with the Implementation Plan adopted for the Project Areas. 3. Confirms PCDC Resolution No. 2005-20 of December 19, 2005, authorizing the Executive Director to allocate $4M from PCDC account undesignated fund balance to East Washington Interchange Project RDA 100280. 4. Urges the Sonoma County Transportation Authority to designate all the Measure M funds in the Caltrans Marin/Sonoma Narrows, Segment C High Occupancy Vehicle Project to fund the East Washington Interchange component (Project RDA100280, previous project number C500306) and to complete full design of the MSN -C Project. 5. Directs staff to continue to pursue inclusion of the East Washington Interchange Project component of the Caltrans MSN -C HOV Project in upcoming State and/or federal stimulus packages. ATTACHMENT 3 RESOLUTION URGING THE SONOMA COUNTY TRANSPORTATION AUTHORITY (SCTA) TO DESIGNATE ALL MEASURE M FUNDS FROM THE MARIN/SONOMA NARROWS, SEGMENT C (MSN -C) PROJECT TO HELP FULLY FUND THE EAST WASHINGTON STREET INTERCHANGE COMPONENT (PROJECT RDA100280, PREVIOUSLY PROJECT C500306) OF CALTRANS MSN- C HIGH OCCUPANCY VEHICLE (HOV) PROJECT, AND TO FULLY FUND DESIGN OF THE MSN -C HOV PROJECT; CONSENTING TO THE EXPENDITURE OF TAX INCREMENT FUNDS IN THE PETALUMA COMMUNITY DEVELOPMENT PROJECT AREA, ADOPTING FINDINGS REQUIRED BY HEALTH & SAFETY CODE SECTION 33445 FOR SAID PROJECT; AND DIRECTING STAFF TO PURSUE STIMULUS PACKAGE FUNDING WHEREAS, in June, 2007, the Petaluma Community Development Commission held a public hearing and adopted the Five Year Implementation Plan for the Central Business District Project Area and the Petaluma Community Development Area (collectively, the "Project Areas") furtherance of the City's adopted Redevelopment Plans for the CBD and PCD; and WHEREAS, California Health and Safety Code Section 33445 provides that a redevelopment agency may, with the consent of the legislative body, pay for the cost of the construction of improvements which are publicly owned if the legislative body determines all of the following: 1. That the improvements are of benefit to the project area or the immediate neighborhood in which the project is located; 2. That no other reasonable means of financing the improvements is available to the community; and 3. That the payment of funds for the cost of the improvements will assist in the elimination of one or more blighting conditions inside the project area, and will be consistent with the implementation plan adopted by the redevelopment agency.
