Vol. XX, Page 4 January 26, 2009 1 PUBLIC COMMENT 2 3 Richard Brawn, Petaluma, spoke regarding the problems we are facing with energy. 4 5 Katherine Bobrowski, Petaluma, spoke regarding vehicles parking in the firelanes in her mobile 6 home park, and shared pictures she had taken. 7 8 Diane Reilly Torres, Petaluma, told Council that mobile home parks are legally required to have 9 an on-site manager, but Littlewood Mobile Home Park doesn't have one. 10 1 1 Zen Destiny, Petaluma, spoke about the process for approval of development in Petaluma, and 12 compared it to "having an abscessed tooth removed without anesthesia." 13 14 Paul Francis, Petaluma, Petaluma Neighborhood Association, wanted to introduce himself to the 15 new Council Members and said his group are advocates of sustainable development. He 16 believes new strategies are needed, focusing on the local economy. The Retail Leakage Study 17 needs updating. Council Member Glass Mayor Torliatt Council Member Ren6e Council Member Glass Public Comment on Item 5.13 Richard Brawn, Petaluma, believes the process should have been resolved amicably between the community and the developer. David Wertzberger, said that Mayor Torliatt's and Council Member Glass's comments were refreshing. He believes there are some material problems with the project and that it is inconsistent with the General Plan. He spoke of a lack of transparency and due diligence in the project. He said he is in favor of appropriate development on this property - either fewer homes of the size proposed, or the same number of homes but lower square footage and of a design more sensitive to the ridgeline. Richard Dowd, Vice President, Pinnacle Homes, said he was here to address any questions Council might have. Said records stands Vol. XX, Page 10 January 26, 2009 1 2 Scot Stegeman, Petaluma, spoke regarding noticing deficiencies in connection 3 with the project, and asked that a meeting of all interested parties be scheduled. 4 5 Ralph Hooper, Petaluma, said that 11 large, 2 -story houses "on that lovely 6 ridgeline" is too many. He believes there are serious earth movement, fire 7 protection, and water issues. He seconded Scot Stegeman's call to convene a 8 meeting of all interested parties. 9 10 Shelly Campbell, Petaluma, said she had spoken of conditions of approval the 1 1 last time this was on the agenda, and said the community "would like to have 12 some give and take." Her main concern regarding approving 11 homes is 13 that there is no way to bring them down from the top of the ridgeline. She would 14 like to see the number reduced to 8 or 9 homes. She is also concerned about the 15 easement for emergency vehicles to access the "grassy area." Discussion and Possible Action to Submit Additional Comments to the County of Sonoma on the Proposed Dutra Asphalt and Recycling Facility. (Moore) Mayor Torliatt Council Member Healy Council Member Glass Council Member Harris Council Member Renee Mayor Torliatt Public Comment on 5.0 Daymon Doss, Petaluma Health Care District, Petaluma, spoke regarding concerns about air quality and the proposed asphalt plant. He asked that Council to be very clear about air quality and to ensure that the public has access to all studies regarding this. Frank Simpson, Petaluma, asked Council to consider sending a DVD of this portion of the meeting to County Board of Supervisors. He thought a letter with the signatures of all seven Council Members would send a good message. Bill Phillips, Petaluma, congratulated Council Member Healy on the idea of putting all Council Members' signatures on the letter. He read from Paul Payne's article in the Press Democrat, "Petalumans Fuming Over Proposed Asphalt Plant." He said the public is upset. He would like the letter to include reference to the effects of an asphalt plant on tourist dollars, especially birders, whom he described as "older and more affluent" than the average tourist. Jason Davies, Petaluma, takes his young children to ride bikes at Shollenberger Park and saw signs there about proposed project. He thinks that the only way to make this consistent with the County General Plan is to require that the plant be fully enclosed and operate under Alternate C. Alan Pendley, Petaluma, consulting chemist, said that fumes coming off asphalt when it's being made contain "just about the most carcinogenic particles out there." He said the letter to the County Board of Supervisors needs to focus on technical issues. He said the proposed plant's plan is to pump water from the Petaluma River and spray it on gravel. That's 95% salt water. That will mean asphalt that will not last very long. If they wanted to use fresh water, that would Vol. XX, Page 12 January 26, 2009 1 come out of Petaluma's allotment of water. He said the plant must be 2 completely contained and must include not just an electrostatis precipitator, but 3 also must use a catalytic converter to completely incinerate the hydrocarbons. 4 5 Margi Levin, Petaluma, moved here because Petaluma gave her "a place to live, 6 work, and play." If the asphalt plant project is approved, it will wipe out her 7 dream. She will be exposed to carcinogens. The statistics say that in Sonoma 8 County 1 in 8 will get cancer. That plant will just increase the exposure. 9 10 Kevin Cotter, Petaluma, thinks if this plant is approved, it will "kill South McDowell 1 1 development." He said, "Dutra is not a good corporate citizen." 12 13 Ned Orrett, Petaluma, North Bay Rowing Club, showed a PowerPoint presentation 14 and said that the Petaluma River is one of the best venues for rowing in California. 15 He is concerned that should this plant be built, the North Bay Rowing Club would 16 not be able to hold their regattas anymore. In order to continue, Dutra would 17 have to agree that on one Sunday per year there would be no barge at a 18 particular spot in the river. 19 20 Tom Brown, Petaluma, North Bay Rowing Club and Petaluma Small Craft Center 21 Coalition, said the rowing club has members from Sonoma, Marin and Napa 22 Counties who come to row on the Petaluma River - a "superb venue." There is an 23 active juniors program, and Sonoma State also rows out of their facility. He said 24 that the fact that Coast Guard does not get any input into this project until it has 25 been permitted seems "backward." He asked Council to include in their letter to 26 the Board of Supervisors a recommendation that the Corps of Engineers and 27 Coast Guard analyze the draft EIR on the project before it is approved. He said 28 the plant must be fully enclosed and all emissions scrubbed. Dutra has said they 29 will close down barge activity during the rowing regatta, but they need to 30 confirm that in writing. 31 32 Sylvia Ross, Petaluma, told Council she lives in McNear Landing, which is about 4 33 blocks from the site of the former Dutra plant. She said the dust in their homes was 34 "horrible." Joe Caramucci, Point San Pedro Road Coalition, San Rafael, spoke of numerous problems with the San Rafael Rock Quarry after it was purchased by Bill Dutra. Victor Chechanover, Petaluma, told Council that residents are paying part of their sales tax to preserve open space, and asked, "Why would the Board of Supervisors impede that?" He asked Council to remind the Board of their duties to our residents and all of Sonoma County, and to ask them not to allow the project to move forward at this time. Virginia Steenhoven, Petaluma, said she moved here 10 years from Marin and is very familiar with "Dutra's business practices" which were the subject of a Grand Jury report.
