Recommendation: It is recommended that the City Council take the following action: Authorize filing of application for federal American Recovery and Reinvestment Act of 2009 (ARRA) funding, and state assurance to complete the project, Petaluma: Various Street Rehabilitation. Summary Statement: The proposed American Recovery and Reinvestment Act of 2009 includes funding for infrastructure projects. For the most part, the funding will follow the typical procedures for federal funding. While all of the usual requirements remain in effect, the approval process has been altered in order to meet the schedule requirements imposed by the Act. BACKGROUND: On January 15, 2009, the House Appropriations Committee released an Economic Stimulus proposal referred as the "American Recovery and Reinvestment Act of 2009". This proposal includes $40 billion for surface transportation nationwide. The Metropolitan Transportation Commission (MTC) estimates that the Bay Area discretionary share of the regional Surface Transportation Program (STP) funds will be around $140 million. Based on standard distribution percentages used for other funds, it is estimated that the City of Petaluma is eligible to receive $1,109,000. A few important notes about the bill: • The bill requires recipients to award contracts for 50 percent of the funds within 90 days of Enactment (which will be around February 15). However, MTC has required that all local road rehabilitation projects meet the 90 -day award deadline to ensure fiords are not lost to the region. • There is no regulatory relief (i.e. no environmental or federal -aid process streamlining) offered in the bill and it is highly unlikely that any will be forthcoming. Because of this, MTC will only consider projects that have NEPA clearance (or verifiable NEPA clearance within 30 days) or are categorically excluded from NEPA. • All existing rules and requirements for federal STP funding apply, and must be adhered to within the expedited timeframe. • The federal share can be up to 100%, at the option of the recipient. • Projects must be completed and fully invoiced and reimbursed within three years. DISCUSSION: Based on the criteria above, this project to rehabilitate the pavement on Ely Road, from Sonoma Mountain Parkway north to City limits, and Sunnyslope Road, from D Street to I Street, was specifically selected to meet the very stringent requirements set by the Act and further set by the Metropolitan Transportation Committee and Caltrans, the agencies responsible for allocation and oversight of the fiords. 2 C:\Uucuments and SettingsTcrump\Local SettingsVI'cinporaq Internet Files\C�)ntenl.Outlook\31'.IK2Xa(�\Nina) Resolution of Locul Support \13 due ro 3.doc Work must occur on the Federal System, which is a very specific list of arterials and major collectors within City limits. Also, Public Works staff consulted with Water Resources staff to assure the roadwork selected was not over utilities that have known problems or are scheduled for repair or replacement. The limits of the project can, and likely will be, adjusted in order to match the final determined funding limits. 4. FINANCIAL IMPACTS: The construction work is to be 100% grant funded on a reimbursement basis, which is standard procedure for federally funded projects. Funds can be used to pay for construction inspection and the construction contract, which includes the construction contingency. Staff will prepare construction documents (plans and specifications), administer the construction contract, and will likely inspect the work. There will be a small consultant agreement to test the existing pavement by deflection testing and core samples to determine the most effective rehabilitation strategy. Funding for the testing is approximately $14,000 and will be paid from existing Public Works operating budget. It is anticipated that the CIP administrative overhead will be waived for this project. The City plans to invoice Caltrans for actual money spent on a monthly basis. Typically, the City will receive a reimbursement check within two months of expenditure.. This will have no impact on the General Fund. AUTHORIZING THE FILING OF AN APPLICATION FOR FEDERAL AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009 (ARRA) FUNDING AND STATING THE ASSURANCE TO COMPLETE THE PROJECT WHEREAS, the City of Petaluma (herein referred as APPLICANT) is submitting an application to the Metropolitan Transportation Commission (MTC) for approximately $1,109,000 in fimding from the federal American Recovery and Reinvestment Act of 2009 (ARRA) for the Petaluma: Various Street Rehabilitation Project No. C16100903 (herein referred as PROJECT) for the MTC Regional ARRA Program (MTC Resolution No. 3885) (herein referred as PROGRAM); and WHEREAS, pursuant to ARRA, and any regulations and/or guidance promulgated thereunder, eligible project sponsors wishing to receive Regional ARRA funds for a project shall submit an application first with the appropriate Metropolitan Planning Organization (MPO), for review and inclusion in the MPO's Transportation Improvement Program (TIP); and WHEREAS, the Metropolitan Transportation Commission (MTC) is the MPO for the nine counties of the San Francisco Bay region; and WHEREAS, MTC has adopted a Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised applicable to federal ARRA fund delivery and has adopted (or is scheduled to adopt) in MTC Resolution No. 3885 such additional requirements as are necessary or appropriate to meet the obligations/award deadlines in the ARRA; and WHEREAS, APPLICANT is an eligible project sponsor for ARRA funds; and WHEREAS, as part of the application for ARRA funding, MTC requires a resolution adopted by the responsible implementing agency stating the following: 1) that the sponsor understands that the ARRA funding is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with additional ARRA or other MTC -programmed funds; and 2) that PROJECT will comply with the procedures specified in MTC's Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised) and with all project -specific requirements as set forth in MTC's Regional ARRA Program (MTC Resolution No. 3885); and PROJECT as described in the application, and if approved, as included in MTC's TIP; and 3) that PROJECT will comply with all the project -specific requirements as set forth in the federal ARRA and appropriate applicable regulations or guidance. 4 CADocuments and SettinuS\kcrtnnp\Local SettinesUempomry Internet l'ilex\Custent.Outlook\3F.IS2X6(i\Final Resotutiun or Local Support AB doe rev3.doc NOW, THEREFORE, BE IT RESOLVED that the City of Petaluma is authorized to execute and file an application for funding under the American Recovery and Reinvestment Act of 2009 for Petaluma: Various Street Rehabilitation Project No. C16100903. BE IT FURTHER RESOLVED that: The APPLICANT by adopting this resolution does hereby states that: a. APPLICANT understands that the ARRA funding for the project is fixed at the MTC approved programmed amount, and that any cost increases must be funded by the APPLICANT from other funds, and that APPLICANT does not expect any cost increases to be funded with additional ARRA or MTC -programmed funds; and b. APPLICANT understands the funding deadlines associated with these funds and will comply with the applicable provisions and requirements of the Regional ARRA Program (MTC Resolution No. 3885) and Regional Project Funding Delivery Policy (MTC Resolution No. 3606, as revised); and C. The PROJECT will be implemented as described in the complete application and in this resolution and, if approved, for the amount programmed in the MTC federal TIP; and d. The PROJECT will comply with all the project -specific requirements as set forth in the ARRA and appropriate applicable regulations or guidance; 2. There is no legal impediment to APPLICANT making applications for the funds; 3.
