40 Keith Kay, Petaluma, wanted to tell everyone in the City to start acting. He said he wants to see
41 more young people in the building; he is tired of being one of the only young people who come
42 to Council, including his friends watching TV at home.

44 Dave Libchitz, Petaluma, said that Dutra would like us to believe they are a great asset to our
45 community. He said that the Bay Area Air Quality Management District (BAAQMD) has over a
46 dozen of complaints on file from Dutra's last few years of operation in Petaluma.

48 Wayne Clark, Petaluma, read from his blog, which commended Mayor Torliatt and Council
49 Member Healy for their words in opposition to the proposed Dutra asphalt plant. He said that
50 the Petaluma Health Care District will have a health forum regarding potential health effects of
51 the proposed plant on March 17, 2009 at the Community Center.

Ed Moss, Petaluma, reminded Council that he had come before them a month ago with
concerns about Sonoma County Transit's budget woes. He reported that it appears Sonoma
County Transit has been saved but there will be cutbacks.
Katherine Bobrowski, Petaluma, asked if the Council able to look at the pictures of vehicles
parked on the fire lanes and dogs off leash she provided at the last Council Meeting.
Joan Wagenhnecht, Petaluma, said that she lives in the Littlewoods Mobile Home Park wants
someone to investigate how many residents in the park are illegal.
Catherine Canto, Moms for Clean Air, Petaluma, thanked the Council for closely looking at Dutra
Asphalt Plant proposal and its effects on the citizens of Petaluma. Please visit
www.momsforcleanair.net. She stated that they are having a fundraiser on March 5th at
Velasco's and on March 1 1 th at the Equus Cafe.

tender, the insolvency of the national and international banking community
and "questionable financial machinations," the best minds of our generations could
come up with was borrow more money and send the bill to our children. We need to be
facing this situation now and sending the bills to our children is not the answer.

Scot Stegeman, Sebastopol, thought the process was unexpected, but a
satisfactory exercise. He thought it would be agony if this had to go through
SPARC and then came back to Council again on appeal. If you have any

Zen Destiny, Petaluma, said that he does not support all development, thinks
"smart" development a good idea. He stated that "opposing development in this
community is a recreational activity."

Mayor Torliatt confirmed Council consensus that this item will go to the Planning
Commission with plans to place it on the November 2010 ballot. If removal of
expansion areas triggers a requirement for further CEQA review, that will be taken

Alicia Kay Herries, representing the EI Rose Hayes Lane Coalition, Petaluma,

spoke about concerns regarding CEQA exemption, overall height, mass and
17
aesthetic conditions in relation to the surrounding neighborhood, privacy, sets
18
precedents for the area and the blemishing of "the beautiful west hills."

Scot Stegeman, EI Rose Hayes Lane Coalition, said that the area was designated
21
in the General Plan as mixed use. He said there are no findings or justification for
22
this other than the applicant wants it. So others could come in later and expect
23
the same treatment because nothing was done to correct this. It creates a
24
domino effect. He further discussed the parking issue in the lower parking area.

He said it may be feasible, but it won't be easy for individuals parking below.

Mary Dooley, Architect for Applicant, Petaluma, respectfully requested that the

Council deny the appeal and allow 30 West EI Rose to go forward as approved

by SPARC and as recommended by City staff. She said there are no planning or

technical reasons to uphold the appeal.

Jaden Schrock, Petaluma, said that she is a patient of Northridge Dental, who just

got her braces off today. She thinks that Doctor Claudia deserves more chairs in

her office.

Bob Shanteau, Seaside, stated that he is consulting engineer who used to work for
49
City of Monterey. He says he is a traffic engineer; not an advocate for or against
50
the project. He is looking at this project objectively. His client is Rose Zoia, who is
51
the attorney for the neighborhood group. He found it remarkable that there is no

traffic impact report for the project. He stated that the area could use some
traffic calming features.
Michael Tanzer, Petaluma, stated that he is a patient of Dr. Ashtiani. He said that,
as a community, we spend a lot of time developing plans, rules, master plans,
etc. which constitutes a contract with our citizenry. If citizens do what the rules
say and they don't get approved, the City is going back on its word. We have
had a hard time attracting quality medical professionals. If City does not approve
project, it will be sending a message to other medical professionals that Petaluma
is not the place to establish a practice.
James Arvold, Petaluma, said that his dentist is on EI Rose and has 3 chairs and he
doesn't understand why someone would need 15 chairs. Additionally,
he thought it is a blind curve and there could be issues with automobiles coming
out of the driveway.
Cliff Bond, EI Rose Coalition, Petaluma, stated that he has lived in neighborhood
since 1979 and his two daughters graduated from Petaluma High. He further
stated that the neighborhood is a residential neighborhood and "we do not
need anew building with several hundred automobiles per day." He believes this
case is "out of line" and should be closed.
David Ellwood, Petaluma, stated that his daughter is patient of Dr. Claudia. He
stated that Dr. Claudia provides a child -friendly environment and that kids are
happy to go there and be worked on. He sees this dental office to be an asset to
the community.
Bob Boracchia, Petaluma, stated that this project falls into place with the existing
medical offices. He stated that the community needs this project.
Dr. Dinu Gray, Petaluma Valley Dental, Petaluma, said that he hopes that
common sense and a sense of common good will prevail over obstructionism
and alarmism.
Ramey Elias, DDS, Petaluma, sends his patient to these two doctors - honor to
have them come back and thank him for referring them. If we lose them and
don't give them opportunity to grow in an existing facility, we will be losing a lot.
Rick Edwards, Petaluma, said he seems to be the "default" expert on easement
and drainage on the site. He has lived in the neighborhood for eight years
and has cleaned out that easement to keep the water running. All four buildings
drain off to the back and then end up at his house. He had to put in a sump
pump on his property to get the ground water to go down.
William Henry, IBEW Local 551, Petaluma, stated that he represents IBEW Local 551
and is in support of the project as it will create jobs and stimulate the local
community. He respects the doctors because professionally Dr. Claudia but
braces on both his wife and daughter. Secondly, the doctors have donated
thousands of dollars to local schools and organizations.
Motion: Continue the meeting past 11:00 p.m., as required by Council's Rules,
Policies, and Procedures.

tonight. He also stated that they take pride in their community's long standing

Wayne Miller, Santa Rosa, stated that has a concern that deals with the process

in Petaluma. In order to get to the long term vision of the General Plan, a process

is needed that is relied upon by the community and design professionals. He

suggested that there is a conflict between the greater common good and by the

people directly impacted by the project. He urged the Council to deny the
38
appeal.

Bill Scott, Marin County Building Trades, Novato, said that the process is set up so

you can go through and meet the demands fairly and listen to the community.

More importantly, the trades look at a project like this as infill and the building is

past its time and it is time to put some new money in to it and you have to make it

economically feasible.

Bea Gaffney, Petaluma, said she was pleased to hear that Council Member

Rabbitt said that the project should nestle into the hillside. She doesn't believe
48
this project "nestles into the hillside." She is concerned about the parking below,

which backs up to her fence, and hopes that her family room is not hit by a large
50
vehicle. She also had concerns about the lack of a sidewalk and about delivery
51
trucks.

work within the confines of the existing building. She disagreed with the traffic

study as there have been infractions and accidents in that area throughout the

years. She requested that the parking requirements bereviewed.

recorded. In addition, there has been drainage problem in this area for years. He

any truck double parked. She believes that the dental staff will need 10park on

with olot ofpeople out ofwork. The developer has assured him howill pay

prevailing wage even though he is not required. The process has run its course

and the applicant has met every all his requirements.

conclusions reached bvCity staff. She said they are professionals, unbiased and

Jack Murphy, Petaluma, said that he couldn't believe this has taken one and a

half years. He thinks the applicant should go back and design something that fits

in the neighborhood.

Steve vonRaesfeld, Architect, Petaluma, said that infill is tough work and always

will be, but reminded Council that this is the trade-off for the Urban Growth
10
Boundary. He said that if you trust SPARC and the General Plan then this project

should be approved.

Moira Bullen, Petaluma, welcomed the Council to walk in the community. She
14
stated that there is a sewer line under her house that did not show up on any
15
maps.

Rebecca Avery, Petaluma, says Petaluma needs dentists and other medical
18
professionals, but she stated that the building is too big and has sewer problems
19
in the past. She thinks the expansion will increase the sewer problems and the
20
traffic problems.

Ken Barnhart, Petaluma, stated that he has lived in neighborhood since he was 10
23
years old and a homeowner since 1962. He stated concerns about traffic and
24
stated that "driveway is going to be a killer."

Allan Tilton, W -Trans, Santa Rosa, said that the Council has heard some statistics,
27
facts and numbers about traffic as well as "some other wilder claims." This street
28
has been a designated collector street which could carry up to 5,000 trips per
29
day.

Lyle Yee, Petaluma, spoke in support of applicants and fellow dentists. He stated
32
that much consideration has been given to privacy and aesthetic concerns of
33
the neighbors. He also said that SPARC has given this project much attention and
34
required additional conditions.

Terry Boyer, retired City of San Jose Planner and Building Inspector, Petaluma,
37
said that was going to buy that property. He found it interesting that no one had
38
mentioned the problems before despite the building having been there for
39
years. He stated that the water problems are caused by the three poorly
40
maintained dental offices hair dental office below this site to the south.

Shelly Campbell, Petaluma, passed out a map and asked that the Council take
43
notes. She lives nearby and for 10 years has been driving from I Street to the pre -
44
school, junior high and the high school. She voiced concerns about EI Rose not
45
being wide enough for two cars to pass because of the parked cars on either
46
side of the street.

Dennis Elias, Petaluma, said that there was a letter from a Dr. Clyde Schulz

regarding this item. He said he found the letter disturbing and said that Dr. Schulz
50
should not have sent it. He said that he wants the entire General Plan included in
51
these proceedings. He also gave citations from the Implementing Zoning
52
Ordinance and Petaluma Municipal Code.

Johann Vetter, Petaluma, stated that the issue has never been against building
the building, but it's about the size of the building and the traffic. He further
stated that this meeting is about the building and giving the permit and not
about whether the dentist is good.
Mayor Torliatt closed the PUBLIC HEARING and confirmed Council consensus to
continue the item to the March 16, 2009 City Council Meeting, to be the first item
under UNFINISHED BUSINESS.
