Summary Statement: Richard A. Heaps Electrical Contractor, Inc. has completed the construction contract for the Safe Routes to School Project for $409,402.30. BACKGROUND: The City applied and received the Federal Highway Administration (FHWA) Safe Routes to School grant for the installation of in -roadway pedestrian warning systems (lighted crosswalks) near eight schools. Department of Public Works staff prepared plans and specifications for this project. The Notice Inviting Bids was issued on July 1, 2008, and bids were received and opened on August 6, 2008. City Council awarded the construction contract to Richard A. Heaps Electrical Contractor, Inc. on September 8, 2008, who has satisfactorily completed the work. Per contract requirements, the 10% retention will be released sixty days after Council acceptance of the project. DISCUSSION: Staff recommends accepting completion of the construction contract for the Safe Routes to School Project, since the contractor has fulfilled all contract requirements. Approval of this resolution will assure release of retention to the contractor. 4. FINANCIAL IMPACTS: The final construction cost is $409,402.30, which is funded by a Safe Routes to School Grant in the amount of $368,462.07 (90%), and Traffic Mitigation Fees in the amount of $40,940.23 (10%). This cost includes the original bid ($392,225), underruns, overruns (totaling $5,720), and change orders ($11,457.30): The approved budget for construction is $392,225 (low bid) plus a $59,000 contingency for a total of $451,225. I'hi I � .` Pail RESOLUTION ACCEPTING COMPLETION OF CONSTRUCTION CONTRACT FOR THE SAFE ROUTES TO SCHOOL (ENHANCED PEDESTRIAN CROSSING) PROJECT PROJECT NO. C00501504 WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Safe Routes to School Project ("Project"); and WHEREAS, bids for the Project were opened on August 6, 2008 in accordance with California Public Contract Code Section 4104.5 and other applicable law; and WHEREAS, the apparent low bid for the Project was the bid of Richard A. Heaps Electrical Contractor, Inc. in the amount of $392,225; and WHEREAS, by Resolution No. 2008-169 adopted on September 8, 2008 the City Council of the City of Petaluma found the bid of $392,225 for the Project to be the lowest responsive bid and awarded the Project to Richard A. Heaps Electrical Contractor, Inc. in the amount of $392,225, conditioned on Richard Heaps timely executing the Project contract and submitting all required documents, and authorized and directed the City Manager to sign the Project contract on behalf of the City upon such timely submission and to execute on behalf of the City any change orders and other amendments to the Project contract that were necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City so long as such change orders or amendments did not result in an increase in excess of $59,000; and WHEREAS, the following change orders affecting the Project amount have been approved: Change Order No. Description Amount 1 Remove existing sidewalk for conform $9,151.50 2 Remove conflicting striping $2,305.80 Total change orders: $11,457.30 and WHEREAS, the final contract amount, as amended, including all change orders is $409,402.30; and WHEREAS, City staff have inspected the Project and determined that it has been substantially completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and S:\CIP nrvismn\Projects\Sale Roules it, Sehool COO ioI il)-I�Comtruchon\30 Ag ell da Til ls`mecepl cunyrleuun ol'cnn>tpiChOil Cnnh11C0 f incl l doe WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: The Safe Routes to School (Enhanced Pedestrian Crossing) Project No. C00501504, with a final contract amount of $409,402.30, is accepted as complete, subject to the Contractor's completing the punch list work prior to release of the retention, continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project contract, California Public Contract Code Section 7107 and applicable law.
