Recommendation: It is recommended that the City Council take the following action:
Award Emergency Equipment Management Inc. the contract to supply new self contained breathing apparatus
for the City Fire Department in the amount of $168,334.15.

Summary Statement: Emergency Equipment Management Inc. submitted the lowest responsive bid on this
project. Extensive, yearlong research and testing has shown that the equipment provided by Drager Corporation,
represented by Emergency Equipment Management Inc., appears to satisfy the Fire Department's performance
specifications.

FOR
Resolution Authorizing the Award of a Contract to Emergency Equipment Management, Inc.
for the Replacement of Fire Department Self Contained Breathing Apparatus (SCBA)
RECOMMENDATION: That the City Council award the contract for the replacement of self
contained breathing apparatus to the Drager Corporation, represented locally by Emergency
Equipment Management Inc. in the amount of $168,334.15
2. BACKGROUND: The Fire Department successfully applied for a grant through FEMA for the
replacement of 35 self contained breathing apparatus (SCBA) as well as supporting equipment.
After an extensive research and evaluation period, specifications were prepared and sent to
five manufacturers and an invitation to bid was printed in the Santa Rosa Press Democrat. The
manufacturer that initially was the lowest bidder was the ISI Corporation. However, ISI was
deemed non-responsive because their unit did not meet the minimum performance
specifications set forth in the bid; specifically, the ability to easily remove the second stage
regulator from the mask. The next apparent lowest bidder that met all specifications is the
Drager Corporation from Emergency Equipment Management Inc. The FEMA grant
conditions contain strict stipulations concerning how the grant funds are spent. In this case,
the grant includes other SCBA related program purchases. The largest single expense is the
replacement of the SCBA, where Emergency Equipment Management Inc. was the lowest
bidder at $168,334.15. The Fire Department recommends that tlris bid be awarded per the
agenda bill.
3. DISCUSSION: One of the goals of the self contained breathing apparatus program is to ensure
that these units are as durable and maintenance free as possible. The environment that an
SCBA must be worn is, by its nature, harsh and inhospitable. The Drager Corporation is well
known to provide one of most durable units available to fire departments. A purchase of this
magnitude, and for equipment as critical as SCBA, requires that the manufacturer meet certain
benchmarks for performance and reliability. In preparation for this purchase, the Fire
Department conducted a yearlong evaluation of various SCBA manufacturers and tested each
product. The Drager Corporation SCBA had the highest performance rating during the
evaluation period. The Drager Corporation, represented locally by EEMI in Petaluma, CA, is
also the apparent lowest bidder. Local technical and parts support is another critical
component of the breathing air program and local support is very valuable_
4. FINANCIAL IMPACTS: Total cost for this project is $224,780.00. The largest expenditure is
$168,334.15 for the replacement of 35 SCBA, 35 extra bottles and 20 extra masks. The
remaining grant monies ($56,83194) will be used to upgrade the entire SCBA program during
this calendar year. All costs include tax and delivery. The FEMA grant contribution is
$179.824.00 and the required city contribution is 20 percent or $44.956.00. The 20 percent
matching funds have already been encumbered from two recovery claims. The first is the
recovery costs from the Dairyman's Mill fire in 2007 ($40,000) and the second is from a fire
department vehicle that was struck by a civilian truck while the fire engine was being serviced.
The out of service time for repairs netted the fire department $10,000.00 in recovery costs.

5. Bin ANALYSIS: On March 5`h 2009, there was a formal bid opening for this project. After the
bids were read and recorded, the bid documents were forwarded to the Fire Department for
analysis to ensure that the bids are responsive and the performance specifications are met. The
following summaries reflect the Fire Department's responsiveness and performance review.
As a result of such review, it was necessary to adjust the bid tabulation to focus on each
bidder's base bid without alternates. The Fire Department determined that the International
Safety Instruments bid was non-responsive (performance specifications not satisfied), the
Emergency Equipment Management, Inc. bid is the lowest bid at $168,334.15, the Allstar Fire
Equipment bid is the next low bid at $168,579.40, the L.N. Curtis and Sons' bid is the next
low bid at $170,235.49, and the Mallory Fire bid is the next low bid at $187,414.60, in
accordance with the following:

6. Summary Statement: SCBA are highly technical apparatus with the expectation to perform
with 100% accuracy, 100% of the time. To comply with not only City purchasing standards
but with the FEMA grant requirements it is essential that each SCBA base bid included in the
bid tabulation satisfies minimum bid requirements and excludes options. After completing the
performance review, scrutinizing each bid and comparing like units, it is the Fire Department
recommendation that the bid be awarded to EEMI of Petaluma, CA for the purchase of Drager
SCBA, based on EEMI's Iowest price responsive base bid.

SECTION A
INSTRUCTION TO BH)DERS
TIIIS IS NOT AN ORDER, BUT AN INVITATION FOR BID.
General: This Invitation to Bid (ITB) serves as a notice inviting bids in accordance with Petaluma
Municipal Code 4.04.080_ The City of Petaluma is seeking bids for the following:

Self Contained Breathing Apparatus
A firm fixed price purchase order will be issued for Self Contained Breathing Apparatus per
specifications, terms and conditions, and other provisions outlined below.
1. Bid Preparation
A. Bid format: Bids must be typewritten or prepared in ink and must be submitted on the
forms provided in this Invitation for Bid_ No oral, telegraphic, telephone or facsimile bids
will be accepted.
B. Conformance to bid requirements: Bids must conform to the requirements of the
Invitation for Bid. All necessary attachments (certifications, bid bond, list of
subcontractors, etc.) must be submitted with bid and in the required format. Failure to
comply with all requirements may result in bid rejection.
C. Exceptions: Any deviation from the bid specifications, plans, terms and conditions may
result in bid rejection.
D. Signature on bid: Bids must be signed in ink by an authorized representative of the
bidder. Signature on a bid certifies that the bid is made without connection with any
person, firm or corporation making a bid for the same project and is in all respects fair and
without collusion fraud.
Signature on the laid also certifies that bidder has read and fully understands all bid
specifications, plans, terms and conditions.
E. Modifications: Modifications or erasures made before bid submission must be initialed
in ink by the person signing the bid. Bids, once submitted may be modified in writing
before the time and date set for bid closing. Any modifications shall be prepared on
company letterhead, signed by an authorized representative and state the new document
supersedes or modifies the prior bid. Modification must be submitted in a sealed envelope
clearly marked "Bid Modification" and identifying the ITB number and closing date.
Bidders may not modify bids after the bid deadline.
F. Bid withdrawals. Bids may be withdrawn in writing on company letterhead signed by
an authorized representative and received by the City Cleric's office prior to the deadline.
Bids may be withdrawn in person before bid closing time upon presentation of appropriate
identification.
2. Bid Submission
Bids must be received prior to the deadline noted on the cover sheet and below. No bid
received after the deadline time and date will be considered. To assure your bid is
properly received, note the ITB number (09-002) date and time of the deadline in the
lover left hand corner of your envelope.
3. Bid opening: The bids received will be opened after the 2:00 P.M. deadline on Thursday,
March 5, 2009.
4. Bid Evaluation and Award
A. Award of Purchase or Contract: Purchases or contracts shall be awarded to the Iowest
responsible bidder. In determining the lowest responsive and responsible bidder, the
following shall be taken into consideration:
1. The quality, suitability and efficiency of the item;
2. The total life cycle cost of the equipment;
3. The delivery, discount terms and all other conditions submitted in the bid;
4. The reputation of the equipment, the service reputation of the bidder, and all
other information and data required to prove the responsibility of the contractor.
B. The City Council shall reserve the right to reject any or all bids in whole or in part and
may waive any irregularities or informalities in any bids.
5. Results of the ITB: A tabulation of all bids received shall be open for public inspection during
regular business hours for a period of not less than 30 calendar days after bid opening.

7. The deadline for submitting bids is 2:00 PM on Thursday, March 5, 2009 at the Citv of

SECTION B
TERMS AND CONDITIONS
1. IDEFIMTIONS: "Contract" means the entire written agreement between the parties, including but not
limited to the Invitation to Bid or Request for Quotation and its specifications, terms and conditions;
instructions to bidders; change notices, if any; the accepted bid; and the purchase order or price agreement
document:
"Contractor" means a person or organization with whom the City of Petaluma has contracted for the purchase
of equipment, material and supplies.
"City" means the City of Petaluma, California.
2. STANDARD AND SPECIAL TERMS AND CONDITIONS: The terms and conditions on these pages
are standard to City contracts for the purchase of equipment, materials and supplies. There may also be
special terms and conditions in an Invitation to Bid or Request for Quotation which apply only to this
contract.
3. MATERIIAL AND EOUIPMENT SPECIIFIED BY NAME: Whenever any material or equipment is
specified by patent or proprietary name or by the name of the manufacturer, unless stated differently, such
specification shall be considered as if followed by the words "or acceotable equal". whether or not such words
appear. The Contractor may offer material or equipment with equal or better qualities and performance in
substitution for those specified which he considers would be in the City's interest to accept. No verbal offers for
substitution will be acknowledged or considered from contractors, distributors, manufacturers or subcontractors.
Any such offers shall be made in writing to the Purchasing Officer for consideration with the submission of the
proposal and the Contractor shall include sufficient data which, together with any other data the City may
require, will enable the City to assess the acceptability of the material or equipment. Such acceptance by the
City shall not relieve the Contractor from full responsibility from the efficiency and quality and performance of
the substitute material or equipment, in the same manner and degree as the material and equipment specified by
name.
It should be understood that specifying a brand name, components and/or equipment in these specifications shall
not relieve the Contractor from full responsibility to produce the products in accordance with the performance
warranty and contractual requirements. The Contractor is responsible for notifying the City of any inappropriate
brand name, component and/or equipment that may be called for in the specifications, and to propose a suitable
substitute for consideration.
4. MATERIALS c& WOR104ANSIIIP: Materials used shall be of the best quality and applied in accordance
with approved recommendations of the manufacture thereof.
5. AWARD: The City of Petaluma reserves the right to accept bids on individual items listed, on group items, or
on the proposal as a whole; to reject any and all bids; to waive any informality or irregularity in the bids; and to
accept the bid that appears from all consideration to be in the best interest of the City of Petaluma.
In determining and evaluating the best bid, the prices will not necessarily be controlling, but quality, equality,
efficiency, utility, general terms, delivery, suitability of the equipment/material offered, maintainability of the
equipment/material offered, and the reputation of the equipment/material in general use will also be considered
with any other relevant factors.
6. ORDER ACKNOWLEDGMENT: The successful Contractor, after receipt of a City of Petaluma Purchase
Order, shall be required to furnish the City Purchasing Officer, when made available, a copy of the factory order
acknowledgment or production date(s) for the equipment/material ordered.
7. NOTICES: Except as otherwise specifically provided in this Invitation to Bid and the resulting Purchase
Contract or Purchase Order, any notice, submittal or communication required or permitted to be served on a
party hereto, may be served by personal delivery to the person or the office of the Contractor. Service may also
be made by certified mail or recognized overnight delivery service, postage prepaid, to the person and address
stated in the Invitation to Bid and/or the resulting Contract or Purchase Order.
S. OPTION TO INCREASE OUANTITY OF ORDERED UNITS: The City reserves the right to increase
the quantity of ordered units shown on this Invitation to Bid by issuance on the original purchase order or an
additional purchase order not later than thirty (30) days after award of bid. The successful Contractor agrees to
furnish to the City the additional ordered units at the unit price offered in this bid.
9. MODIFICATION: The City of Petaluma, at any time prior to the delivery date specified on the resulting
Purchase Order or Purchase Contract, may issue a written change order for any modifications. Such
modifications shall be the result of negotiation and agreement between both parties.
Oral change orders are not permitted. No change in this Invitation to Bid or resulting Purchase Order or
Purchase Contract shall be made unless the City of Petaluma gives its prior written approval from the
Purchasing Office. The Contractor shall be liable for all costs resulting from any unauthorized changes to the
Invitation to Bid, Purchase Order or Purchase Contract.
10. BREACH OF CONTRACT: Should Contractor breach any of the provisions of this contract, the City
reserves the right to cancel this contract upon written notice to Contractor. Contractor shall be liable for any
and all damages incidental and consequential suffered by the City as the result of the Contractor's breach of
contract. The City shall have any and all remedies provided under the law in the event of a breach of
contract by Contractor. In the event of repeated breach of public and/or private contracts, Contractor shall be
subject to disqualification as a bidder on City contracts
11, TERMINATION OF CONTRACT TO PURCHASE: If at any time, in the opinion of the City Manager,
1) Contractor fails to conform to the requirements of this contract; 2) Contractor seeks relief under any law for
the benefit of insolvents or is adjudicated bankrupt; 3) any legal proceedings are commenced against Contractor
which may interfere with the performance of the contract; or 4) Contractor has failed to supply an adequate
working force, or material of proper quality, or has failed in any other respect to prosecute the work with the
diligence and force specified and intended in any by the terms of the contract, notice thereof in writing may be
served upon the contractor; and should he neglect or refuse to provide means for a satisfactory compliance with
the contract as directed by the Purchasing Officer within the time specified in such notice, the City Manager in
any such case shall have the right and power, at its option and without prejudice to any other right it may have,
to terminate the contract. Any excess of the cost arising there from will be charged against the Contractor and
contractor's sureties, who will be liable thereof In the event of such termination, all monies due the Contractor
or retained under terms of the contract shall be forfeited to the City; but such forfeiture will not release the
Contractor or Contractor's sureties from liability for failure to fulfill the contract.
12. TITLE: Title to the equipment/material shall pass to the City at the F.O.B. Destination point designated
under the delivery clause below, subject to the right of the City to reject upon inspection.
13. WARRANTIES: Unless otherwise stated, all equipment shall be recent model and shall carry full
factory warranties. Contractor warrants all equipment and supplies delivered to be free from defects in labor,
material and manufacture and to be in compliance with the warranty stipulated in the bid specifications. All
implied and expressed warranty provisions of the Uniform Commercial Code are incorporated in this contract.
All warranties shall run to the City.
14. DELIVERY: All deliveries shall be F.O.B. destination with all transportation and handling charges
prepaid by the Contractor. Responsibility and liability for loss or damage shall remain with Contractor until
final inspection and acceptance by the City when responsibility shall pass to the City except as to latent
defects, fraud and Contractor's warranty obligations.
15. INSPECTION AND TESTING: The City reserves the right and shall be at liberty to inspect and test all
materials and workmanship at times and places determined by the City, and shall have the right to reject all
materials and workmanship which do not conform with the equipment/material specification provided; however,
the City is under no duty to make such inspection. Should it be determined, after inspection, that corrections are
needed to bring the equipment/material up to the specifications of the bid award, the City, for the purpose of
earning the discount, may extend the date of complete acceptance beyond the date of delivery. If Contractor is
unable or refuses to correct such goods within a time deemed reasonable by the City, the City may cancel the
order in whole or in part. Nothing is this paragraph shall adversely affect the City's right as buyer.
16. ACCEPTANCE AND PAYMENT: Acceptance shall be made at the time all equipment/material is
operational and in proper working order as determined by and to the satisfaction of the City of Petaluma.
Acceptance of the equipmentlmaterial shall be determined on the basis of technical completeness, performance
and adherence to the operational requirements and functions of the specifications.
Payment will be scheduled within thirty (30) days upon complete delivery and acceptance of all
equipment/material and receipt of an original invoice for the equipment/material complying with the terms and
conditions of the award. The City reserves the right to withhold up to ten percent (10%) of the purchase price in
the event there is a conditional acceptance.
In connection with any cash discount specified on the bid form, time will be computed from the date of
complete acceptance of the equipment/material, or from date correct invoices are received in the Citv Finance
Office. 1 I English Street. P.O. BOX 61. Petaluma CA 94951 if the latter date is later than the date of complete
acceptance. For the purpose of earning the discount, payment is deemed to be made on the date of mailing of the
City check or transfer of funds.
17. ASSIGNMENT .AND SUBCONTRACTING: The Contractor shall not assign or subcontract the work, or
any part thereof, without the previous written consent of the City, nor shall he/she assign, by power of attorney
or otherwise, any of the money payable under this contract unless written consent of the City has been obtained.
No right under this contract, nor claim for money due or to become due liereunder shall be asserted against the
City, or persons acting for the City, by reason of any so-called assignment of this contract or any part thereof,
unless such assignment has been authorized by the written consent of the City. In case the Contractor is
permitted to assign monies due or to become due under this contract, the instrument of assignment shall contain
a clause subordinating the claim of the assignee to all prior liens for services rendered or materials supplied for
the performance of work.
Should any subcontractor fail to perform in a satisfactory manner the work undertaken by the subcontractor,
Contractor's subcontract shall be immediately terminated by the Contractor upon notice from the City. The
Contractor shall be fully responsible and accountable to the City for the acts and omissions of Contractor's
subcontractors, and of persons directly or indirectly employed by them, as the Contractor is for the acts and
omissions of persons directly employed by him. Nothing contained in this contract shall create any contractual
relation between any subcontract and the City.
1$. FEDERAL AND STATE TAX: The City is exempt from excise taxes and transportation tax. Tax
exemption certificates will be signed for merchandise delivered to the City upon request. Kindly bid without
these taxes. Transportation tax requires no exemption certificates, but goods must be consigned to the City.
California sales tax of 7.75% will be paid in accordance with the contract payment schedule.
19. SEVERABILITY: If any provision of this contract is declared by a court to be illegal or in conflict with
any Iaw, the validity of the remaining terms and provisions shall not be affected; and the rights and
obligations of the parties shall be construed and enforced as if the contract did not contain the particular
provision held to be invalid.
20. COMPLIANCE WITH APPLICABLE LAWS: Contractor shall comply with all federal, state and local
laws, codes, regulations and ordinances applicable to the provision of goods to be purchased under this
contract. Failure to comply with such requirements shall constitute a breach of contract and shall be grounds
for contract cancellation. Damages or costs resulting for noncompliance shall be the sole responsibility of
Contractor.
21. GOVERNING LAW, JURISDICTION, VENUE: This contract shall be governed and construed in
accordance with the laws of the State of California, without resort to any jurisdiction's conflict of laws rules
or doctrines. Any claim, action, suit, or proceeding (collectively "the claim") between the City (and/or other
agency or department of the City) and the Contractor that arises from or relates to this contract shall be
brought and conducted solely and exclusively within the Superior Court of Sonoma County for the State of
California. Provided, however, if the claim must be brought in a federal forum, then it shall be brought and
conducted solely and exclusively within the United States District Court for the District of Northern
California. Contractor hereby consents to the_jurisdiction of said courts.
22. WAIVER: Failure of the City to enforce any provision of this contract shall not constitute a waiver or
relinquishment by the City of the right to such performance in the future nor of the right to enforce any other
provision of this contract.
23. CALIFORNIA OSHA, RULES AND REGULATIONS: All machinery, materials, supplies and
equipment furnished shall be in full accordance with all currently applicable Cal/OSHA rules and regulations.
Contractor or Contractor warrants that he and each of his subcontractors shall, in performance of this contract
or purchase order, comply with each and every compliance order issued pursuant to Cal/OSHA. The
Contractor or Contractor assumes full and total responsibility for compliance with Cal/OSI-IA standards by his
subcontractors as well as himself. The cost of complying with any compliance order and payment of any
penalty assessed pursuant to Cal/OSHA and the cost of placing non -conforming machinery, supplies,
materials and equipment in compliance with Cal/OSHA shall be borne by the Contractor or Contractor.
Contractor or Contractor shall save, keep and hold harmless the City, and all officers, employees and agents
thereof, from all liability, cost or expenses in law or in equity which may at any time arise or be set up
because of Contractor's or Contractor's, or his subcontractors', non-compliance or alleged non-compliance
with Cal/OSHA requirements, or failure to provide machinery, materials, supplies or equipment which
conforms to Cal/OSHA. Nothing contained herein shall be deemed to prevent the Contractor or Contractor or
his subcontractors from otherwise allocating between themselves responsibility for compliance with
Cal/OSHA requirements; provided, however, that the Contractor or Contractor shall not thereby be, in any
manner whatsoever, relieved of his responsibility to the City as hereinabove set forth.
24. SAFETY AND HEALTH REOUI[REMENTS: Equipment and supplies supplied shall comply with all
federal Occupational Safety and Health Administration (OSHA) requirements.
25. MATERIAL SAFETY DATA SHEETS: Contractor shall provide the City with a Material Safety Data
Sheet for any equipment and/or supplies provided under this contract, which may release or otherwise result
in exposure to a hazardous chemical under normal conditions of use. In addition, Contractor must label, tag
or mark such goods.
26. PATENTS AND ROYALTIES: The Contractor, if his bid is accepted, shall defend any and all
suits and assume all liability for the use of any patent process, device or article forming a part of the
apparatus or any appliance furnished under the contract. All costs involved in fees, royalties or claims
for any patented invention, article, process or method that may be used upon or in any manner
connected with the supply of this material/equipment shall be paid by the Contractor. Should the
Contractor, his agent or employees or any of them be enjoined from furnishing or using any invention,
article, material or plans supplied or required to be supplied or used under the contract, the Contractor
shall promptly substitute other articles, materials or appliances in lieu thereof equal finish, efficiency,
quality, suitability and market value, and satisfactory in all respects to the City. Or in the event that the
City elects, in lieu of such substitution, to have supplied and to retain and use any such inventions,
articles, materials or plans as may be required to be supplied, the Contractor shall pay such royalties and
secure such valid licenses as may be requisite for the City, its officers, agents, and employees, or any of
them to use such invention, article, materials or appliances without being disturbed or in any way
interfered with by any proceeding in the law or equity on account thereof Should the Contractor
neglect or refuse to make the substitution promptly or to pay such royalties and secure such licenses as
may be necessary, then in the event the City shall have the right to make such substitution or the City
may pay such royalties and secure such licenses and charge the Contractor even though final payment
under the contract may have been made.
27. INDEMNITY AND HOLD HARMLESS AGREEMENT: Contractor agrees to accept all responsibility
for loss or damage to any person or entity, and to defend, indemnify, hold harmless and release the City, its
officers, agents and employees, from and against any and all actions, claims, damages, disabilities, or costs of
litigation that may be asserted by any person or entity, arising out of or in connection with the performance by
Contractor hereunder, whether or not there is concurrent, passive or active negligence on the part of the City, but
excluding liability due to the sole active negligence or willful misconduct of the City. This indemnification
obligation is not limited in any way by any limitation on the amount or type of damages or compensation
payable to or for Contractor or its agents under Workmen's Compensation acts; disability benefits acts or other
employee's benefits acts.
Contractor shall be liable to the City for any loss or damage to City property arising from or in connection with
Contractor performance hereunder.
28. FORCE MAJEURE: Neither party to this contract shall be held responsible for delay or default caused by
fire, riot, acts of God and /or war, which is beyond that party's reasonable control. The City of Petaluma may
terminate this contract by written notice after determining such delay or default will reasonably prevent
successful performance of the contract.
29. BUSINESS TAX: Contractors, who are awarded a City contract, must pay a City business tax pursuant
to City Ordinance.
30. YEAR 2000 COMPLIANCE: All products offered by the contractor as well as third party components
of the solution must be Year 2000 Compliant. The software/hardware design to ensure year 2000 compliance
shall include, but not be limited to, century recognition of dates, calculations that correctly compute sante
century and multi century formulas and date values, and interface values that reflect the century, None of
these products should require any modification because of date issues arising between now and the next one -
hundred years into the future. In any changes are required, the contractor will make the changes at no cost
and in a time frame that is acceptable to the City.

SPECIAL TERMS AND CONDITIONS
1. ]ILLUSTRATIVE AND TECHNICAL, DATA: Bidder shall submit with his bid complete and
current illustrative and technical data on the proposed equipment/material. Failure to provide this
information may be sufficient to declare the bid non-responsive.
2. DEALER PREPARATION: Bid prices must include all necessary dealer preparation applicable
to new equipment, and destination delivery charges from the factory to the dealer.
3. DELIVERY: Failure by the successful Contractor to notify the City of Petaluma immediately of
any delivery beyond the stated date or terms is cause for him to be held responsible for damages
incurred as a result of an extended delivery time.
Prior to delivery the equipment /material shall be completely assembled as necessary to assure proper
operation and function.

Self Contained Breathing Apparatus
GENERAL: It is the intent of these specifications to describe the minimum requirements for
Self Contained Breathing Apparatus.
All equipment/options are to be factory installed. Special items needed to bring the equipment
up to the specifications herein shall be accepted only if they are the manufacturer's regular or
approved factory options.
The Self Contained Breathing Apparatus shall meet or exceed the construction and
performance specifications described in the following specifications.
Any deviations from the specifications set forth herein shall be noted and explained in
Section E, Exceptions to the Specifications.
In order to receive full consideration, bid must follow these specifications and the Invitation
to Bid's Terms and Conditions and Instructions.
SPECIFICATIONS: To be satisfied by bidder and attached to Section C (Bid)

Self Contained Breathing Apparatus Specifications
Scope of request for this project includes the following minimum standard:
1. The open circuit self-contained breathing apparatus covered by this specification shall be
of the type using compressed air. The SCBA shall be approved by the National Institute
for Occupational Safety and Health (NIOSH) as a positive pressure breathing apparatus.
The SCBA shall meet the latest edition of the NFPA 1982 Standard on Personal Alert
Safety Systems (PASS) and NFPA 1981 Open -Circuit Self -Contained Breathing
Standard, 2007 edition_ The SCBA shall utilize a two stage system of pressure reduction.
Main components of the SCBA shall include:
• Face -piece and Communication System
• First Stage Pressure Reducer
• Rapid Intervention Company (RIC) Quick Fill system
• Lung Demand Valve (LDV) with Chemical Biological Radiological Nuclear (CBRN)
approval
• Back -plate and Harness Suspension Assembly
• Cylinder and Valve Assembly
• Chest Mounted Electronic Gauge and Warning System
• Integrated Personal Alert Safety System (IPASS)
• Pull Forward Waist Belt
• Emergency Air Refill Connection

All components of the SCBA shall be arranged to minimize interference when maneuvering
in confined spaces and when passing through small openings. Components of the SCBA shall
be easily removed for routine service and maintenance.
2. The Petaluma Fire Department is seeking the replacement of approximately:
35 SCBAs — One for each seat on fire apparatus and one for each command vehicle

1 Face -piece
1.1 Body
a The face -piece shall adapt to all facial contours and provide excellent ft factors.
The facemask must come in 3 different sizes (S, M, L).
b. The size of the facemask must be clearly identified on the mask body with the
letters S, M, L.
C. The face -piece body shall have a large chin support to locate and support the
chin and provide an excellent seal.
d. With the Lung Demand Valve (LDV) removed and the face -piece donned, the
wearer shall be able to breathe freely.
e. The pulling force of the head harness shall not be directly applied to the sealing
rings to minimize deformation of the seal and prevent Ieakage.
f. The face -piece body shall have only two openings, lens and front port
connector, to minimize the possibility of leakage.
1.2 Nose Crap
a. Nose cups shall come in three (3) different sizes, 1, 2, 3, (S, M, L).
b. The face -piece shall have a nose cup fitted as standard that reduce CO, to an
average value of less that 1% by volume.
C, The nose shall be easily removed or replaced without the use of tools, for ease
of cleaning and disinfecting.
1.3 ]Lens
a. The lens shall meet the scratch resistance test for the latest revision of NFPA
1981 Open -Circuit Self -Contained Breathing. It shall be coated on both sides.
b. The effective field of vision shall be greater than 90%.
C. The face -piece shall be designed so that air from the cylinder passes over the
face -piece lens prior to inhalation to prevent fogging on the inside of the lens.
1.4 Lens Frame
a. The lens frame material shall be a non conductive robust composite material for
improved lens protection in the event of shock or vibration.
1.5 Speech Diaphragm
a. The mask shall be fitted with a speech diaphragm.
b. The speech diaphragm shall be protected from damage to prevent damage or
puncturing. In the case of leakage in the area of the speech diaphragm, the mash
will maintain positive pressure.
1.6 Exhalation 'V'alve
a. The mask shall be fitted with an exhalation valve to isolate the exhalation from
the inhalation supply from the regulator.
b. The exhalation valve shall be protected by a cover.
C. The exhalation valve cover and exhalation valve shall be easily removed
without the use of tools for ease of cleaning and decontamination.
1.7 Head Harness
a. The head harness shall be made from EPDM material.
b. The head harness straps shall be easily removable without the use of tools.
1.8 Mask Cow Ung and Communication System
a. The face -piece shall include a mask cowling to ehininate the collapse of the
face --piece onto the wearer's face in the event of a fall.
b. The mask cowling must be easily removed without the need of special tools.
C. The mask cowling shall incorporate an integrated voice amplifier
communication system.
1.9 Heads Up Display (HUD)
a. The HUD system must automatically activate when the cylinder is opened,
pressurizing the SCBA pneumatics.
b. The HUD shall be designed to fit the face -piece without interfering with the
user's field of vision.
C. The HUD shall be interchangeable between face -pieces.
d. The HUD system shall be NIOSH, NFPA 1981, 2007 edition, UL 913 and
FCC, Part 15 compliant
1.9 Other
a. The face -piece shall have a provision for using spectacles without breaking the
integrity of the face -piece seal or directly attaching to the lens.
b. The face -piece shall employ as standard a highly flame retardant neck strap that
has an extra button tab to position the face -piece on the wearer's chest to reduce
the potential for dirt infiltration when not donned or in use.
C. The face -piece shall have an individual serial number permanently marked on
the mask.
d. A spectacle kit designed by the SCBA manufacturer for better fit in the face -
piece shall be available.
e. The spectacle kit shall not mount directly on the lens.
£ The face -piece shall have a device so that it may be secured to the firefighter or
the SCBA.

2 First Stage Reducer
a. The first stage reducer shall be connected directly to the back -plate.
b. The failure mode of the first stage reducer shall be such that the reducer fails
safe and always delivers air to the user.
C. An audible whistle alarm shall be located on the reducer. The warning whistle
will alert the wearer when approximately 25% of the service life of the SCBA
remains. The alarm shall meet the requirements for respiratory protective
devices:
Self-contained, open -circuit, compressed air breathing apparatus EN -137 and/or
NFPA standards for operation during a direct water spray.
d. The audible warning shall produce a sound of 90 dBA minimum when
measured at 18 inches.
e. The warning shall operate when the cylinder pressure is less than or equal to the
set pressure for the alarm.
f. Optional airline connections shall be available for using SCBA as a supplied air
respirator, or for use as an emergency escape (buddy breather) system.
g. The first stage reducer shall be capable of supplying 1000 l/min. of air at input
pressure from 300 psi to 45 psi.
h. The first stage reducer shall incorporate an integrated pressure relief valve to
allow for any over pressurization of the medium pressure system. The relief
valve shall open between 160-220 psi. The relief valve shall be protected from
adjustment by the use of an anti -tamper device.
i. The primary reducer shall have an integrated RIC coupling.
j. The SCBA shall be fitted with a RIC Universal Air Connection (UAC) male
fitting connected directly to the pressure reducer to allow refilling of the
cylinder with breathing air.
k. The RIC system must be positioned behind the reducer hand wheel for
maximum protection and easy access.
1. To reduce damaging the RIC fitting, the RIC fitting should not point directly
outward from the reducer or manifold area.
m. The SCBA wearer should be able to connect or disconnect the RIC filling hose
while wearing the SCBA.
n. The distance between the leading edge of the Compressed Gas Association
(CGA) fitting on the SCBA cylinder valve and the leading edge of the RIC
UAC male fitting shall be a maximum of 4 inches.
o. A self -resetting relief valve shall be installed on the RIC system to protect the
cylinder from over pressurization.
p. The RIC UAC male shall be able to connect with any RIC UAC female fitting.
q. The RIC UAC fitting shall not interfere with any operation of the SCBA.
r. The RIC UAC fitting shall be equipped with a dust cap or sealing plug to
prevent dust, dirt and debris from entering the RIC fitting.
S. Dust cap shall serve as a leak proof seal.
t. The RIC UAC fitting coupling shall be capable of being connected and
disconnected with one hand while under pressure.
U. The RIC UAC fitting coupling shall have a 4500 -psi operating pressure.
v. The maximum fill time shall not exceed three (3) minutes.

Ling Demand Valve (LDV)
a. The SCBA shall utilize a mask mounted LDV which connects to the face -piece
by a simple push -in connection. The regulator shall be capable of being reset to
the donning mode while connected to the SCBA to allow the user to keep the
mask in a ready position at all times (i.e. when utilizing the neck strap feature
set forth in 1.1 Ob above). The LDV shall have a swivel at the medium pressure
hose connection to provide easier head movement.
b. The LDV shall be CBRN approved along with the SCBA.
C. The LDV shall use the wearer's exhaled air to flushing any contaminants away
from the outside surface of the diaphragm, keeping the diaphragm free from any
contamination.
d. The LDV shall utilize a quick disconnect coupling that enables the LDV to be
disconnected from the first stage. The quick disconnect shall not be capable of
being accidentally disconnected.
e. The mask -mounted regulator shall be automatically activated to the positive
pressure mode by the user's first inhalation. It shall take no more than a
negative pressure of 15 -millibar
(6 in/H2O) to activate the positive pressure.
i The LDV shall have a bypass valve that can be operated in either a pulse flow
or hands-free continuous flow mode. The minimum flow rate through the
bypass valve shall be 80-130 liters per minute in the continuous flow mode.
Hands-free continuous flow mode shall be achieved by a 900 turn.
g. The hose connecting the first stage regulator to the LDV shall be a small
diameter, non -corrugated hose with a minimum pressure rating of 250 psi.
h. A buddy breathing connection assembly shall be available with quick
disconnect fitting for emergency tie-in of LDV hose fitting from another SCBA.
When required, the buddy breather shall also be useable as an airline
connection.
i. The LDV shall be capable of supplying in excess of 5001/min. of air at input
pressure of 300 psi.
j. The LDV shall maintain a positive pressure at 150 psi and 300 1/min.
k. The LDV shall have a lifetime warranty.
1. When attached to the face -piece, the LDV shall not begin the flow of air until
the wearer inhales.
Integrated PASS/Electronic Gauge/Secondary
a. The PASS shall be located over the shoulder of the SCBA and shall be
automatically activated when the SCBA is pressurized. The activation pressure
shall be greater than or equal to 60 psi.
b. When the PASS is activated, a multiple frequency tone shall sound to indicate
the PASS is operational. The integrated PASS cannot be turned off while the
SCBA is pressurized.
C. If the PASS detects no movement for a period of 20-23 seconds, the PASS will
sound a
10 —13 second "pre -alarm". After the pre -alarm, if there has still been no
movement detected by the PASS the unit shall go into full alarm.
d_ The PASS alarm shall sound at a minimum of 95 dBA multiple frequency tone
alarm and cannot be blocked off on any one surface.

e. The PASS shall utilize a sensitive movement sensor to reduce the frequency of
false alarms.
f The PASS shall have an alarm button easily accessible with a gloved hand.
g. The PASS shall be capable of working even in the event the pressure signal
cable is broken.
h. The PASS shall be watertight and shall be intrinsically safe, in accordance with
UL 913 in accordance with the NFPA 2007 edition standards.
L The PASS shall be an approved part of the SCBA and meet the requirements of
the current editions of NFPA-1981, NFPA-1982, and 42 CFR, Part 84.
j. The SCBA shall have a low battery display easily read by the user when in
operation.
k. The secondary low-pressure alarm shall be an approved part of the SCBA and
meet the requirements of the current editions of NFPA-1981 and 42 CFR, Part
84.
1. The unit shall have an electronic low-pressure alarm in the form of an electronic
chirp or tone, which is distinct from all other alarms.
M. Two rear enunciators to meet NFPA-1981, 2007 edition, PASS warning
requirements shall be integrated into the back plate.
n. The rear enunciators shall be on the left and right hand side of the back plate
when the cylinder is in position.
o. A user ID shall be programmable into the unit.
5 Back Plate, Harness Assembly and Integrated Electronic System
a_ The back plate shall have two (2) handles, one on either side of the back plate,
to allow for carrying the SCBA, or for ease of donning, or to assist in dragging a
firefighter in the event of a rescue. Each handle must be able to withstand 450
pounds of force.
b. The SCBA shall accommodate a 45 minute, 4500 psi full composite carbon
fiber standard size cylinder.
C. The external padding cover shall be high abrasion resistant, high puncture
resistant, non slip, impregnated waterproof rubber (chloroprene) coated, quick
drying, chemical resistant and inherently fire retardant material.
d. The harness webbing shall be constructed of a heavy duty, high temperature
material.
C. Shoulder and waist adjustment friction buckles shall be of stainless with a curve
inward toward the wearer to eliminate any potential for snagging.
f. Adjusting straps of both shoulder and waist shall have a stiffened, 3-4 inches
long end grips.
g. A locking mechanism shall be used to secure the cylinder strap in place to
ensure simple and secure operation.
h. The cylinder strap shall accommodate all types and sizes of cylinders without
the use of tools.
i. The cylinder strap shall be easy to detach from the back plate without the use of
tools for cleaning and disinfection.
j. The pneumatic system shall be easy to detach from the back plate and harness.
k. Hoses going over the shoulder shall be covered by a protective hose sleeve.

6 Cylinder and Valve Assembly
a. Cylinders shall be available in the following configuration: 45 minute, 4500 psi
carbon fiber standard size cylinder.
b. The volume of the 45 minute cylinder shall be approximately 66 cubic feet
when filled to 4500 psig pressure and shall conform to DOT exemption
numbers.
C. The cylinder valve shall contain a closing valve which incorporates a pressure
gauge to indicate the cylinder pressure at all times.
d. The cylinders shall have reflective marking for ease of visibility.
e. The cylinder valve shall be fitted with a luminous boldface gauge with
protective guards.
f The cylinder valve shall conform to the Compressed Gas Association (CGA)
standard for threaded connection number 347.
g. If possible, each cylinder must be fitted with a device for a quick
disconnect/reconnect without utilizing the threaded connection system.
Optional Accessories
7 RIT/UAC
a. The RIT/UAC shall be capable of being used in an IDLH environment.
b. The RITIUAC shall not incorporate a check valve to prevent transfill (i.e.
transfer and equalization between two cylinders).
C. The RIT/UAC shall utilize a 45 minute, 4500 lb carbon cylinder.
8 Communication Unit
8.1 Voice Amplification Unit
a. A fully integrated voice amplification unit shall be available which can be easily
attached to the face -piece without the use of tools for ease of cleaning and
disinfection.
b. The addition of the communication unit shall not break the integrity of the face -
piece seal.
C. A speech transmission diaphragm is required to provide back up in the event of
battery or communication unit failure.
d. The units shall utilize an internal microphone and integrated ear speaker
(optional) for clear transmissions.
8.2 Radio Interface System
a. The radio interface system shall connect directly to the voice amplifier system.
b. The radio interface shall include an ear speaker that will connect to a large
(easily depressed with a structural firefighting gloved hand) Push -to -Talk (PTT)
button or lapel microphone.
C. The radio interface must utilize a mounting clip for multiple positioning
options.
d. Radio interface shall connect to the ear speaker/PTT assembly via a shielded
quick connect.

9 Extension Hose for Emergency Air Refill
a. An extension hose for emergency air refill with a Nomex pouch that can be
attached to the back plate shall be available as an option.
b. The hose shall be at least 36 inches long and be configured so that a firefighter
can quickly refill another firefighters air bottle via the UAC.
C. When not in use the line shall be coiled in a Nomex or Kevlar pouch that shall
be located on the waist belt.
10 Warranty
a. The SCBA and cylinder shall carry a limited warranty of not less than 15
years. The first stage regulator shall carry a limited warranty of not less than
the lifetime of the SCBA and the HUD shall carry a limited warranty of not
less than one year. Other electronic accessories shall not carry warranties less
than one year.
11 Telemetry/Transmitter/Transducer
a. The SCBA shall be outfitted with any telemetry, transducer or transmitter
hardware required for optional tracking, locating or status systems that may be
purchased at a later date.
12 'Training
a. The successful bidder will submit a comprehensive plan for training all
Department personnel in the use of the SCBA.
b. The plan will be forwarded to the Battalion Chief in charge of training for
approval prior to delivery of the SCBA order.
C. The plan should include the name(s) of the instructor, the required time for
each class, maximum class size, the applicable lesson plan and also include
other training adjuncts such as PowerPoint or video_
13 Sample SCBA
a. Each manufacturer that chooses to bid on this project must submit a sample
SCBA for review at the same time as the bid closing date. The sample SCBA
will include a bottle and mask. The sample SCBA will conform to the
specifications of this bid.

radio transmitter, so FCC certification is not relevant to or required for its design.

The Sperian Warrior backpack has a snap hook on the right shoulder strap for
attachment of a D -ring at the top of the TwentyTwentyl�l Plus facepiece. This
protects the facepiece from dirt infiltration when not in use by placing it against
the user's body.

the top left of the backpack. It is protected by a cover, and it is close to the user's

this section, but the material is a blend of. Kevlar and Nomex, rather than a
rubber compound.

The Warrior cylinder band is stainless steel, not fabric. It can be detached with
tools, but cleaning and disinfection is easily accomplished without the need for
detaching the band. Fabric bands, on the other hand, would need to be detached
for thorough cleaning, disinfection, or possible replacement.

The voice amplifier is not offered with an optional ear speaker. It's not clear what
benefit this would provide for voice amplification. An ear speaker is provided
for the Radio Interface System.

The CornmCommandT" Radio Communication System (RCS) is wireless_ It
utilizes a lapel microphone (a speaker mic) that acts as a transceiver and
communicates wirelessly with the RCS module and ear speaker on the facepiece.
There is no shielded quick connect that connects the lapel mic to the RCS
module, because the wireless system eliminates it, thus eliminating a major snag
hazard if the user is walking near obstructions or crawling close to the floor.

Sperian offers an optional dual fitting buddy breather that utilizes a 36" hose that
is coiled in a Nomex pouch on the waist belt_ However, this does not work in
conjunction with the UAC. For filling a firefighter's air cylinder via the UAC, a

minute air cylinders and 20 additional SOBA masks as outlined in the RFP due Thursday, March

We are providing for this proposal, Draeger Safety SCBAs model PSS 7000 and related
equipment which meets all sections of the specifications detailed in this Request for Proposal.

warranty service contact individual(s). In all purchases made by the City, availability and
accessibility of warranty service and service after warranty may be considered in determining
the lowest responsible quote.
See attached section in binder. In addition to the attached warranty, there are no required
overhauls of the pneumatic system including both the 1" and 2nd stage regulators making our
unit the lowest cost of ownership available on the market today. There are 2 o -rings that are
replaced annually during the Ir1FPA required flow test and our central battery pack has 5 AA
batteries to be replaced annually during that time. The HUD has 1 CR123a battery and the
voice amp if selected, has 2 AAA batteries again malting us the lowest cost of ownership of
any SCBA on the market. These batteries are readily available anywhere and we stock a
supply in our facility. Batteries are the hidden costs to any SCBA program and should be
compared when determining cost of ownership. Our batteries are designed for I hour use per
day for 365 days, unmatched in the industry.

EXCEPTIONS TO THE SPECIFICATIONS
Exceptions to the specifications of any items state herein shall be fully described and
explained in writing by the contractor in the space provided below:
Section 7.b. Optional RIT/UAC
Our RIT/UAC will have a safety check valve to prevent transfill from one firefighter
to another. It prevents loss of air outbound from the fitting and only allows air to be received
by a RIT pack etc. This safety feature is maintained due to the many instances for high
pressure leakage as evidenced by the User advisories in both December 2008 and January
2009 from the manufacturer who does not incorporate the safety check valve.
If a UAC has a high pressure leak when transfilling from firefighter to firefighter, then both
firefighters will quickly find themselves without air in an IDLH atmosphere, even if only
one of the UAC fittings is leaking. With a RIT pack for emergency air, this dangerous
situation is eliminated. If you also have a buddy breather installed, then this feature is
completely independent of the UAC and both firefighters can safely share air without
endangering the rescuer. The Buddy Breather can be used firefighter to firefighter, or with a
RIT pack if available and also an airline hose which could be brought in to give air to
someone who is low and may be trapped.
Section 9. Extension Hose for Emergency Air Refill
We have offered as an option the RIT pneumatics to supply either high pressure
emergency air via the UAC as well as the option to provide medium pressure air through a
buddy breather connection eliminating the hazards described in the above section.
We will not provide this Dose as stated due to the safety concerns of enabling a firefighter to
connect to another firefighter with a high pressure UAC fitting which has proven to IM: with
use and requires monthly checks and any tightening, adjusting or replacement must be done
by a factory authorized service center.

RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT TO EMERGENCY
EQUIPMENT MANAGEMENT, INC. FOR THE REPLACEMENT OF FIRE
DEPARTMENT SELF CONTAINED BREATHING APPARATUS (SCBA)
WHEREAS, City staff has worked diligently to prepare performance specifications and
bid documents and advertise for quotes on this Project; and,
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code and
other applicable law, City staff solicited bids for the Project; and,
WHEREAS, five (5) bids were received on March 5, 2009 and opened in accordance
with applicable law; and,
WHEREAS, the lowest base -bid for the Project was from Emergency Equipment
Management, Inc. for $168.334.15; and,
WHEREAS, staff has determined that the Emergency Equipment Management, Inc. bid
satisfies the bidding requirements for the Project; and,
WHEREAS, staff has verified that Emergency Equipment Management, Inc. meets all
performance specifications contained in this Project; and,
NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council hereby:
1. Approves the Project Budget in the amount of $168,334.15.
2. In accordance with the City of Petaluma Charter and Municipal Code and other
applicable law, waives any and all non-conformance in the bid of Emergency Equipment
Management, Inc. for the replacement SCBA project, finds the bid of $168.334.15 to be the
lowest, responsive bid and further finds that Emergency Equipment Management, Inc. is the
lowest responsible bidder.
3. Awards the contract for the Emergency Equipment Management, Inc., in the
amount of $168.334.15, the amount of the lowest responsive base -bid, conditioned on

Emergency Equipment Management, Inc. timely executing the purchase contract and
submitting all required documents, including but not limited to, the executed purchase contract
and any required insurance and warranty documents, in accordance with the bid documents.
4. Directs staff to issue a notice of award to Emergency Equipment Management,
Inc., 800 Lindberg Lane, Suite 150, Petaluma, CA 94952.
5. Authorizes and directs the City Manager to execute on behalf of the City the
purchase contract, provided Emergency Equipment Management, Inc. timely executes the
purchase contract and submits all required documents in accordance with this Resolution.
