The total cost of the project was $1,429,704.12, including administration, design and construction management. Sufficient funds are available to accept and close out the project. APRIL 18, 2005 AGENDA REPORT FOR RESOLUTION ACCEPTING THE COMPLETION OF THE CONSTRUCTION CONTRACT FOR FY 2004-2005 B ST., ELY BLVD. AND E. WASHINGTON ST. (PORTION) PROJECT No. 04-C500600-1 1. EXECUTIvr SummARY: On January 20, 2005, Ghilotti Bros completed work on this project, for a final construction cost of $1,343,908.61. The total cost of the project was $1,429,704.12, including administration, design and construction management. Sufficient funds are available to accept and close out the project. 2. BACKGROUND: This contract includes three individual projects: a. B Street rehabilitation and slurry seal of 44 Residential Streets. B Street is number 30 on the CAC list and received a bonded wear coat from 4`" Street to past El Rose. Also included were 44 streets to slurry, evenly split on the East and West side of the City. $1,000,000 was budgeted for this work. b. Ely Blvd., from Frates Rd to E. Washington St., was to have received a 1.5" overlay. However, this street was eliminated from the contract, for which $1,000,000 was budgeted. c. E. Washington, from Sutter Street to the Airport, received pavement fabric and a 1.5" overlay. This project was budgeted as 0500404 in the PF&S CIP budget for $1,275,000. The funds from this project were transferred into C500600. At the start of work, the Contractor submitted a Notice of Intent to Claim regarding the water services on Ely Blvd., which were to be replaced. This work accounted for over $300,000 of item work. The Contractor submitted a revised unit price to perform the work which was rejected. Subsequently, the City, with the aid of City Attorney, determined that the water service bid item should be eliminated from the project and re- bid as a separate project. Because minor work started on Ely Blvd, there was some cost to remove steel plates, fill concrete cut-outs, etc. This project has $108,000 of outstanding claims that are in the process of being resolved. This agenda bill is being submitted to start the retention release clock to release the retention to the Contractor. Depending upon how the claims are resolved, one final contract change order might be needed to provide payment to the Contractor. The project ended with $1,953,295.88 in contingency which will be used to fund a new contract on Ely Blvd. and other streets to be determined by the Director, PF&S for fiscal year 04/05. RECOMMENDATION: Adopt the resolution accepting completion of the construction contract, authorizing the City Clerk to sign and file a Notice of Completion with Sonoma County Recorder, and the Finance Department to release 10% retention to the Contractor 45 days after the recordation of the Notice of Completion ACCEPTING THE COMPLETION OF THE 2004 STREET RECONSTRUCTION PROJECT NO. C500600 WHEREAS, on July 19, 2004, the City Council awarded to Ghilotti Bros. Inc., the construction contract for Rehabilitating B St, Ely Blvd, E. Washington and slurry sealing 44 streets; and. WHEREAS, Ghilotti Bros. Inc. has completed all the work to the satisfaction of the Director, Public Facilities & Services, with the exception of Ely Blvd, which was deleted from the contract. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma, California, that the project is hereby accepted. BE IT FURTHER RESOLVED that the City Council of the City of Petaluma authorizes the City Clerk to sign the Notice of Completion and file same with Sonoma County Recorder, and that the Finance Department is hereby authorized to release the ten percent (10%) retention to Ghilotti Bros within forty-five (45) days after the recordation of the Notice of Completion.
