Summary Statement:
The Underground Utility District in the vicinity of Water Street, between Washington Street and Western
Avenue, was established by Resolution N. 2002-158 N.C.S. on September 17, 2002. Phase I construction
is complete and the utilities have been under grounded. The Water Street/Turning Basin Improvements
Phase II—At Grade Site Improvements Project is the second phase of the project which consists of
streetscape features including street and sidewalk resurfacing with brick, cobble and concrete overlays;
landscaping; and site furnishings to enhance the pedestrian environment in the historic downtown.
The proposed construction package, prepared by CSW/Stuber-Stroeh Engineering Group, Inc., will be
performed in three stages requiring the closure of certain streets on portions of the project during each
stage. Property owners and merchants were asked to attend an information meeting about the staging of
the project on March 11, 2005. Additional outreach in now underway.
Phase II bids were opened on March 9, 2005 and two bids were received. North Bay Construction, Inc.
was the low bidder. Copies of the bid packages are available for review in the City Clerk's Office.
The purpose of this item is to award the bid to North Bay Construction for Base Bid + Alternate I,
Alternate 2 + Alternative 4, and then reduce the bid by $146,200 for value engineering.
Recommended Citv Council Action/Sueeested Motion:
Adopt the PCDC resolution, as described, approving the project budget and awarding the contract to North
Bay Construction, Inc. for Base Bid + Alternate I, Alternate II + Alternative IV, and then reduce the bid by
$146,200 for value engineering, for a total adjusted construction cost A$2,339,311.

DISCUSSION AND ACTION APPROVING A RESOLUTION AUTHORIZING THE PROJECT
BUDGET, THE PURCHASING OF SITE FURNISHINGS, AND AWARDING THE CONTRACT FOR
THE WATER STREET/TURNING BASIN IMPROVEMENTS PHASE II—AT GRADE SITE
IMPROVEMENTS PROJECT # C200403
EXECUTIVE SUMMARY:
The Underground Utility District in the vicinity of Water Street between Washington Street and `B"
Street was established by Resolution N. 2002-158 N.C.S. on September 17, 2002. Phase I is complete
and the utilities have been under grounded. The Water Street/Tuming Basin Improvements Phase II—At
Grade Site Improvements Project is the second phase of the project which consists of streetscape
features including street and sidewalk resurfacing with brick, cobble and concrete overlays; landscaping;
and site furnishings to enhance the pedestrian environment in the historic downtown.
The proposed construction package, prepared by CSW/Stuber-Stroeh Engineering Group, Inc., will be
performed in three stages requiring the closure of certain streets on portions of the project during each
stage.
The PCDC received two (2) bids on March 9, 2005, for the Water Street/Tuming Basin Improvements
Phase II —At Grade Site Improvements Project No. C200403, for $3,862,024 from Granite Construction
and $3,506,403 from North Bay Construction, Inc. Copies of the bid packages are available for review
in the City Clerk's Office.
The bid package for Water Street/Turning Basin Improvements Phase II—At Grade Site Improvements
Project is organized as follows:
• Bid: The low bidder was determined by the addition of the base bid plus Altemative#1, 2, 3, and 4.
• Alternate #1- Provides price for new brick instead of used brick.
• Alternate #2- Provides price for concrete curbs instead of granite curbs.
• Alternate #3- Provides pricing to replace stone retaining wall with soldier pile wall.
• Alternate #4— Provides pricing for radial installation of granite set circular elements instead of grid
pattern.
2. BACKGROUND:
Petaluma has a long history and tradition as a working river town. Its Victorian iron -front buildings
have seen the transition from an agricultural center to boutique destination. The redevelopment of Water
Street enhances the district's historic character while promoting new uses of the street to stimulate the
local economy.
Bids were opened on March 9, 2005, for the Water Street/Turning Basin Improvements Phase II—At
Grade Site Improvements Project No. C200403, for $3,862,024 and $3,506,403. The following is the
summary of the bids:

ALTERNATIVES:
A. Award a contract to North Bay Construction Inc. for the base bid and alternates #1, 92 and 94
for a total award of $2,485,511 (Base Bid $2,613,401 +Alt. 91, -$100,000 + Alt. 2, -$57,915, +
Alt. #4, + $30,025 = $2,485,511), and direct value engineering to reduce costs by $146,200 by
deleting work by change order, for bid items A-2 and E -2b for a total adjusted construction cost
of $2,339,311.
B. Reject all bids and re -advertise.

CONCLUSION:
Following the award, the contractor will enter into a contract with the PCDC and submit the required
contract documents, bonds and insurance. The Water Street/Tuming Basin Improvements Phase Il—At
Grade Site Improvements Project begins immediately after the construction contract is executed.
Construction is anticipated to start in late May 2005 and be completed by December 2005.
6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION:
The Water Street/Turning Basin Improvements Phase H—At Grade Site Improvements Project will be
completed and accepted in FY 2005-06.
RECOMMENDATION:
Adopt the PCDC resolution, as described, approving the project budget and awarding the contract to
North Bay Construction, Inc. for the base bid and alternates #1, #2 and #4 for a total award of
$2,485,511. This total is the sum of the base bid plus alternates #1, #2 and #4.
By choosing alternate #1, installing new brick instead of used brick there is a deduction of
$100,000.
By choosing alternate #2, installing concrete curbs instead of granite curbs there is a deduction of
$57,915. Both of these options will not compromise the design intent.
Alternate #4, installing the major design feature in a radial pattern instead of a grid pattern, is an
addition of $30,025.
The total of the base bid plus alternates, #1, #2 and #4 is $2,485,511 which will be the amount of the
award.
(Base Bid $2,613,401 +Alt. #1, -$100,000 + Alt. 2, -$57,915, + Alt. #4, + $30,025 = $2,485,511)
Bid alternate #3, the installation of a retaining wall is not chosen because through value
engineering it has been deterniined that the cost is too high for little benefit.
In addition, other items can be deleted by change order, after award of bid, by eliminating bid
item A-2, construction signs, and by elimination of bid item E -2b palm trees, for $75,000 and
$71,200 respectively for a total adjusted construction cost of $2,339,311.

DISCUSSION AND ACTION ADOPTING A RESOLUTION AWARDING A CONSTRUCTION
CONTRACT FOR THE PETALUMA WATER STREET/TURNING BASIN IMPROVEMENTS
PHASE II —AT GRADE SITE IMPROVEMENTS PROJECT # C200403 AND APPROVING THE
PROJECT BUDGET
WHEREAS, at its meeting of July 19, 2004, the PCDC adopted the 2004-05 PCDC Budget and appropriated
funds for the Water Street/Turning Basin Improvements Phase H—At Grade Site Improvements Project; and
WHEREAS, the Commission finds that the transactions authorized in this resolution are consistent with and
effectuate the purposes of California Community Redevelopment Law (Health and Safety Code Section 33000
et seq.); and
WHEREAS, of the amount appropriated to the 2004-05 PCDC budget, $3,500,000 is currently budgeted for the
Petaluma, Water Street/Turning Basin Improvements Phase 11—At Grade Site Improvements Project No.
C200403 ("Project"); and
WHEREAS, PCDC staff have worked diligently with CSW/Stuber-Stroeh Engineering Group, Inc and Zac
Landscape Architects, Inc., to design and prepare construction bid documents and advertise for construction of
this Project; and
WHEREAS, in accordance with California Public Contract Code Section 20688.2 and other applicable law,
PCDC staff solicited bids for the Project; and
WHEREAS, the project was bid on March 9, 2005, and two (2) bids were received and opened in accordance
with applicable law; and
WHEREAS, the lowest bid for the Project, determined by the sum of the base bid plus Alt. Nos. 1, 2, 3 & 4
was the bid of North Bay Construction, Inc. for $3,506,403; and
WHEREAS, value engineering resulted in the selection of the base bid plus alternatives Nos. 1, 2 and 4 for a
total project cost of $2,485,511; and
WHEREAS, staff has determined that North Bay Construction Inc. bid satisfies the bidding requirements for
the Project; and
WHEREAS, staff has verified that North Bay Construction, Inc. possesses a valid California Contractor's
License, Class A, number 357560 that qualifies North Bay Construction, Inc. to perform the Project; and
WHEREAS, SPARC has requested and approved the installation of street furniture, including benches, tree
grates, trash receptacles, bike and traffic bollards, planters pots in the Project area with specifications which are
consistent with the historic character of the district; and
WHEREAS, the Project has a Negative Declaration pursuant to the California Environmental Quality Act
("CEQA") pursuant to Article 19, Section 15301, of Title 14 of the California Code of Regulations ("CEQA
Guidelines").
NOW, THEREFORE, BE IT RESOLVED by the Petaluma Community Development Commission hereby:
1. Determines the above recitals are true and correct and hereby declared to be findings of the Petaluma
Community Development Commission.
2. Approves the Project Budget in the amount of $3,325,000.
3. In accordance with California Public Contract Code Section 20688.2 and other applicable law waives
any and all non -conformities in the bid of North Bay Construction, Inc. for the Petaluma Water
StreetlTuming Basin Improvements Phase 11—At Grade Site Improvements Project and finds the bid of
North Bay Construction, hic. to be the lowest, responsive bid.
4. Awards the contract for the Petaluma Water Street/Turning Basin Improvements Phase 11—At Grade Site
Improvements Project to North Bay Construction, Inc. in the amount of $2,485,511, the amount of the
lowest responsible bid + selected alternatives, conditioned on North Bay Construction, Inc. timely
executing the project contract and submitting all required documents, including, but not limited to,
executed bonds, certificates of insurance, and endorsements, in accordance with the project bid
documents.
5. Direct staff to issue a notice of award to North Bay Construction, Inc.
6. Authorizes and directs the Petaluma Community Development Commission Executive Director to
execute the project contract on behalf of the Petaluma Community Development Commission upon
timely submission by North Bay Construction, Inc., of the signed project contract all other required
documents, including, but not limited to, executed bonds, certificates of insurance, and endorsements, in
accordance with the project bid documents.
Further authorizes the Petaluma Community Development Commission Executive Director to execute
on behalf of the Petaluma Community Development Commission any and all change orders and other
amendments to the project contract that are necessary to effectively complete the project and/or to
realize project and/or cost benefits for the Petaluma Community Development Commission and the
public. Staff is hereby directed to value engineer the project to reduce the costs by $146,200 by
deleting work by change order, for bid items A-2 and E -2b for a total adjusted construction cost of
$2,339,311.
7. Based on the foregoing, finds that (i) the expenditure of tax increment funds to undertake the Projects
set forth in this Resolution will be of benefit to the Project Area, (ii) no other reasonable means of
financing the Projects are reasonably available, (iii) completion of the Projects will eliminate blighting
conditions in the Project Area; and (iv) completion of the Public Improvements is consistent with the
Implementation PIan of the Project Area.
8. Authorizes and approves the sole source purchase of benches, tree grates, trash receptacles, bike and
traffic bollards and planter pots in accordance with the SPARC -approved specifications in an amount
not to exceed $50,000.

9. Authorizes and directs the Executive Director to execute contracts with Petaluma High School, Ridge
Cast Metals Corp., Napa Valley Cast Stone, Edgar Harris and Company, and East Bay Brass Foundry
for street furnishings.
