AGENDA REPORT
FOR
INTRODUCTION (FIRST READING) OF A ORDINANCE APPROVING AN OFFER OF AN
EXCLUSIVE UTILITY EASEMENT TO PACIFIC GAS AND ELECTRIC (PG&E), SOUTHERN
BELL COMPANIES (SBC) AND COMCAST. INC. FOR THE PURPOSES OF INSTALLING AND
MAINTAINING "DRY" PUBLIC UTILITY LINES WITHIN CITY OWNED LAND SHOWN AS
PARCEL A OF THE STRATFORD PLACE SUBDIVISION — PHASE I FINAL MAP, FILED IN
BOOK 663, PAGES 33-37, SCR.
EXECUTIVE SUMMARY:
Delco Builders as well as PG&E, SBC and Comcast are requesting that the City of Petaluma grant a
utility easement in favor of PG&E, SBC and Comcast over the City owned "Parcel A" as shown in the
attached documents. The purpose for the easement is to allow the dry utility companies to install and
maintain the necessary utilities to serve the approved Stratford Place Subdivision project. City Council
approval is required because the easement would be located over fee title City property.
2. BACKGROUND:
The City Council previously approved the final maps for Stratford Place Subdivision and construction of
the project is underway. There are three reasons for this request. First, there are a number of existing dry
utility boxes and service lines located in Parcel A within the proposed easement boundary. By granting
this easement, the dry utility companies would obtain legal rights to maintain existing infrastructure as
well as install and maintain the proposed system. Secondly, PG&E, SBC and Comcast completed utility
design after the Stratford Place Subdivision final maps were recorded. Therefore, this easement is being
requested "after the fact". This is not uncommon practice as dry utility design typically lags behind the
City design review and approval process. The utility services are required to serve the Stratford Place
Subdivision. Lastly, as previously noted, City Council approval is required because the City owns Parcel
A in fee title. Granting of the easement and installation of the underground utilities will not affect the
Gatti Park site.
ALTERNATIVES:
Deny the request.

None
CONCLUSION:
City staff has reviewed the location of the proposed easement and dry utilities and takes no exception to
the proposed easement and utility locations.

RECOMMENDATION:
Staff recommends that the City Council adopt an ordinance approving the easement and authorizing the
City Manager to execute the necessary easement grant deeds.

18 WHEREAS, Delco Builders as well as PG&E, SBC and Comcast are requesting that the
19 City of Petaluma grant a utility casement in favor of PG&E, SBC and Comcast over the
20 City owned "Parcel A" per the Stratford Place Phase I final subdivision map (book 663,
21 pgs 33-37, S.C.R.) and;

23 WHEREAS, The purpose for the easement is to allow the dry utility companies to install
24 and maintain the necessary utilities to serve the approved Stratford Place Subdivision
25 project and;

27 WHEREAS, The City Engineer has reviewed the easement grant deeds, legal
28 descriptions and plats and has found them to be acceptable.

31 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
32 PETALUMA AS FOLLOWS;

34 1. That said grants of easement are hereby approved and shall be carried out; and,
1 2. The City Manager is hereby authorized and directed to sign the easement grant
2 deeds thereby offering the exclusive utility easement to the above mentioned
3 utility companies.

6 IF ANY SECTION, subsection, sentence, clause or phrase or word of this Ordinance is
7 for any reason held to be unconstitutional, unlawful or otherwise invalid by a court of
8 competent jurisdiction, such decision shall not affect the validity of the remaining portions
9 of this Ordinance. The City Council of the City of Petaluma hereby declares that it would
10 have passed and adopted this Ordinance and each and all provisions thereof irrespective of
I the fact that any one or more of said provisions be declared unconstitutional, unlawful or
12 otherwise invalid.
