Correspondence with County of Sonoma Treasurer -Tax Collector Summary Statement: The Central Petaluma Specific Plan (CPSP) provides for the redevelopment of North Water Street, also known as Poultry Street. Currently, the street is privately owned. Efforts are underway to create a plan line for a public street from Washington Street to Lakeville Street. To this end, the City is worldng to acquire the right-of-way for the street. A parcel, number 006-163-054, is located in the middle of the proposed street. According to the County Treasurer -Tax Collector's records, its ownership has Iapsed. Under Sections 3791 and 3791.3 of the Revenue & Taxation Code, the City of Petaluma is authorized to purchase real property offered for sale pursuant to the tax sale procedures contained in Division 1, Part 6, Chapter 8. Therefore, the purpose of this item is to introduce an ordinance authorizing the purchase of the parcel and requesting that the Sonoma County Board of Supervisors approve the transaction. Currently, the street is privately owned. Efforts are underway to create a plan line for a public street from Washington Street to Lakeville Street. To this end, the City is working to acquire the right-of-way for the street. A parcel, number 006-163-054, is located in the middle of the proposed street. According to the County Treasurer -Tax Collector's records, its ownership has lapsed. BACKGROUND: The Treasurer -Tax Collector has advised that he is supportive of the transaction and will, upon receipt of a Council ordinance authorizing the purchase, forward his recommendation to the Sonoma County Board of Supervisors to authorize the transaction. 3. ALTERNATIVES: None 4. FINANCIAL IMPACTS: Delinquent property taxes on the parcel are $1,556.80. As part of the ordinance, the City will request that the Sonoma. County Board of Supervisors waive payment of these taxes due to the proposed public use of the parcel. If the Board declines the request, the City will pay the delinquent taxes. CONCLUSION: The implementation of the Central Petaluma Specific Plan requires the redevelopment of a private street into a public street. A parcel in the middle of the street is no longer privately owned. There is a process in State law for its acquisition. A Council ordinance is required to authorize the purchase. 6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION: By August 2005, the City of Petalwna will have an approved plan line for North Water Street and acquired a portion of the right-of-way. 7. RECOMMENDATION: It is recommended that the City Council introduce the attached ordinance authorizing the purchase of parcel number APN 006-163-054 2 Attachment I ORDINANCE NO. 2005- N.C.S. OF THE CITY OF PETALUMA, CALIFORNIA ORDINANCE OF THE CITY OF PETALUMA AUTHORIZING THE PURCHASE OF REAL PROPERTY PURSUANT TO DIVISION 1, PART 6, CHAPTER 8 OF THE CALIFORNIA REVENUE AND TAXATION CODE IN CONNECTION WITH PARCEL NUMBER: APN 006-163-054 LOCATED ON NORTH WATER STREET IN PETALUMA, CALIFORNIA WHEREAS, the City of Petaluma adopted the Central Petaluma Specific Plan (CPSP) which provides for the redevelopment of North Water Street, also known as Poultry Street; and WHEREAS, the CPSP requires that a plan line be established for a public street on North Water Street; and WHEREAS, a parcel, APN 006-163-054, is located in the proposed new street right-of-way and is no longer privately owned; and WHEREAS, the City of Petal -Lima has need for this real property to be utilized for public right-of-way; and WHEREAS, the City of Petaluma intends to utilize the property described in Exhibit A for such proposes and desires to purchase such property for such intended use. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. The City of Petaluma authorizes and directs its City Manager to purchase the property referred to as APN 006-163-054 offered for sale pursuant to the provisions of Division 1, Part 6, Chapter 8 of the California Revenue and Taxation Code and related provisions of law, 2. That its City Manager is hereby authorized to execute any document necessary and take any other reasonably necessary action to consummate the transaction contemplated herein. 3 3. The City Council of the City of Petaluma hereby requests that the Sonoma County Board of Supervisors waive the payment of delinquent property taxes in the amount of $1,556.80 due to the public nature of the use of the property by city and county residents. 4. The City Council of the City of Petaluma hereby provides that if the Sonoma County Board of Supervisors does not waive the $1,556,80 for payment of delinquent property taxes, the City will pay the $1,556.80 for delinquent property taxes and any related fees and transaction costs, not to exceed $5,000.
