Summary Statement:
The Shollenberger Park fishing pier is the last requirements per an agreement with the County of Sonoma
when re -locating the park to its present Iocation, Five responsible bids have been received. Staff is
recommending that the project proceed with the City Council allocating additional Park Development
Funds, and authorizing staff to conduct values engineering with the contractor to bring the project budget in
line with available funds.

Resolution Awarding the Contract to Construct
A Fishing Pier at Shollenberger Park
EXECUTIVE SUMMARY:
The proposed Fishing Pier for Shollenberger Park is the final obligation due the County of Sonoma
regarding the relocation of the park to its present location. Five responsible bids have been received
and staff is recommending awarding the contract by allocating additional Park Development Fees
and authorizing staff to conduct values engineering with the lowest bidder.
BACKGROUND:
The current location of Shollenberger Park is the result of an agreement with the County of Sonoma
which allowed the City to build the Petaluma Marina at the original Shollenberger Park. location. As
part of the agreement, the City was to build a replacement park which would include a parking lot,
restroom, trail head and trail system, picnic areas, interpretive sign boards and an ADA accessible
fishing pier. To assist the City with the park construction the County had given the City a grant of
$75,000 towards the project. All aspects of the agreement have been completed except for the
fishing pier. With the construction of the Shollenberger Park Trail Expansion Project, the fishing
pier was to be an aspect of that project. All jurisdictional agencies had been notified, required
permits obtained and lumber purchased (stored on site). At the last minute California State Lands
claimed jurisdiction of the disposal site dike and the fishing pier had to be withdrawn from the trail
project. With the rapidly closing fish window, there was insufficient time for any construction along
the river.
All required permits have since been acquired and the project put out to bid. Twenty Two bid
packets were distributed, with five firms bidding on the project. Bidding responses are as follows:

The engineers estimate was $88,573.
The CIP budget has $90,000 budgeted towards this project of which up to $23,000 is designated for
architectural / engineering / re -acquisition of required permits / preparation of bidding documents
($14,000) and job survey check / construction observation / inspection ($ 9,000). Staff recommends
that the City Council award the contract and allow staff to perform Values Engineering with the
contractor to reduce the price by $10-15,000. Areas of reducing costs include shorter piles obtained
from local vendors thus reducing the cost of shipping from out of state vendors and installation, and
substitution of the fishing pier handrail to one similar to the rail used for the "D" Street River walk
project.
In addition, staff recommends allocating an additional $50,700 from Park Development Fees to
allow this project an obligation to be completed.

With the bidding of the Fishing Pier project, five responsive bids were received. Due to the high cost
of materials and the nature of the work (i.e. pile driving), the costs have escalated over prior years.

Conclusion;
Through the awarding of this contract, a long standing obligation with the County of Sonoma can be
completed. Through Values Engineering the price of the project can be reduced by approximately
$10-15,000 without sacrificing the quality of the project. With the completion of the fishing pier,
Shollenberger Park will be complete per the original obligations with the County, with a truly ADA
accessible path and fishing pier to accommodate all populations.
OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR,
COMPLETION:
With the approval of the City Council, construction agreements can be signed, appropriate insurance
and bonds obtained and a notice to proceed issued. Construction must be completed by October 15,
2005.
RECOMMENDATION:
Recommend approval of the resolution awarding the contract, allocating additional Park
Development Funds and authorizing staff to work with the contractor regarding Values
Engineering of the project.

RESOLUTION AWARDING THE CONTRACT TO CONSTRUCT A FISHING PIER AT
SHOLLENBERGER PARK TO MAS AQUA OF SANTA ROSA, ALLOCATING $50,700 FROM
PARK DEVELOPMENT FEES TO AUGMENT THE PROJECT BUDGET, AUTHORIZE STAFF
TO VALUES ENGINEER THE PROJECT TO BRING THE PROJECT WITHIN BUDGETED
AMOUNTS AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE CONSTRUCTION
AGREEMENT
WHEREAS, the City of Petaluma has bid the project to construct a fishing pier at Shollenberger
Park; and
WHEREAS, five responsive bids were received, with Mas Aqua of Santa Rosa, California the low
Bidder; and
WHEREAS, the low bid was at an amount that exceeded the project budget, and by values
engineering the project with the low bidder, a project budget can be established that
meets with identified budget funds; and
WHEREAS, in order to have sufficient funds for the project, staff recommends that $50,700 from
Park Development Fees be allocated to augment the project budget.
NOW, THEREFORE BE IT RESOLVED, that the Petaluma City Council does hereby award the contract
to build a fishing pier at Shollenberger Park to Mas Aqua of Santa Rosa, Calif., for an
amount of $125,853; authorizes staff to values engineer the project and through the change
order process, reduce the cost of the project within budget limitations; allocate $50,700 from
Park Development Fees to augment the budget; and authorizes the City Manager to execute
the construction contract, subject to review and approval of all contracts, insurance and
bonds by the City Attorney.
