The contract was awarded to C. Hardy General Engineering Contractor, Inc. of Petaluma, for an amount of $400,286.03 with an additional $20,000 set aside for contingencies. Change orders totaled $31,734.61 to address unexpected soil conditions in the area of the parking lot, additional material needs, and additional work including a storm drain outlet dissipater component and improvements to Copeland Street outside the project site. Interdepartmental transfers covered the storm drain and Copeland Street improvements totaling $16,176 of the change orders. Donated materials and services for project construction have totaled $43,240.52 to date. HARDY GENERAL ENGINEERING CONTRACTOR, INC. OF PETALUMA 1. EXECUTIVE SUMMARY: The City Council awarded the contract for construction of the McNear Peninsula Phase I improvements Project (now Steamer Landing Park) at the meeting of January 3, 2005. The contract was awarded to C. Hardy General Engineering Contractor, Inc. of Petaluma, for an amount of $400,286.03 with an additional $20,000 set aside for contingencies. Change orders totaled $31,734.61 to address unexpected soil conditions in the area of the parking lot, additional material needs, and additional work including a storm drain outlet dissipater component and improvements to Copeland Street outside the project site. BACKGROUND: The City Council, at their January 3, 2005 meeting, awarded the contract to construct the McNear Peninsula Phase I Improvements Project (now Steamer Landing Park) to C. Hardy General Engineering Contractor, Inc. (C. Hardy) of Petaluma, for an amount of $400,286.03 with an additional $20,000 set aside for contingencies. Three change orders were executed over the course of construction to address unexpected soil conditions, increased material needs, and additional work outside the original contract. Change orders amounted to $31,734.61. Interdepartmental transfers from the Department of Water Resources and Conservation and Public Works covered $16,176 of these additional costs with the remainder covered by a portion of the contingency. The Department of Water Resources and Conservation provided $4,225 to construct a storm drain outlet dissipater component of the project included in the original plans as "Not in Contract"; this work was paid from Storm Drainage Impact Fees. The Department of Public Works provided $11,951 from the Street Maintenance Fund for improvements to Copeland Street. These improvements included addressing an existing significant drainage problem resulting in ponding of water across Copeland Street, connecting the existing sidewalk to the park improvements, and paving a portion of Copeland Street to ensure a seamless and safe connection to the City's new Steamer Landing Park. C. Hardy was extremely helpful in ensuring that the project was completed per plan and within budget. In addition, donated goods and services during construction totaling $43,240.52 were received from the following: C.Hardy General Engineering — entrance gate valued at $17,550 Dutra Materials — crushed rock valued at $3,609.62 Eastside Cycles — bike rack valued at $500.00 Shamrock Materials — pervious concrete parking lot valued at $20,732.50 V. Dolan Trucking — transport of crushed rock valued at $848.40 Jericho Products — construction staging area use 7 An important component of this project was the sale and placement of commemorative donor bricks as part of the three local Rotary Clubs' Centennial Project. Unfortunately a small number of donor bricks were vandalized during construction. These bricks, along with additional donor bricks ordered to cover the damage and raise additional funds for the project have been ordered but not yet received. Shipping is set for July 26, 2005; C. Hardy has agreed to install these pavers when they arrive. We request that the Council accept project completion with the condition that C. Hardy install these pavers prior to release of the 10% retention. Five educational Idosks have been designed for the project and are presently being manufactured. Installation of the kiosks along the overlook area and trails will be undertaken in concert with a Rotary hands-on work day to install a decorative fence along the north edge of the parking lot. ALTERNATIVES: a. Approve the Resolution accepting the project as complete, and authorizing the City Clerk to file a Notice of Completion with the County Recorder. b. Not accept this project. This alternative is not recommended since the contractor has performed per and even beyond the approved plans and specifications. 4. FINANCIAL IN] PACTS: The project has been completed within budget with additional funds remaining in the project contingency and in the inspection services contract. The remaining funds will be used to purchase additional site furnishings for the project. CONCLUSION: The Contractor has completed the project to construct the McNear Peninsula Phase I Improvements Project per the plans and specifications. Since the project has been completed as required, it is appropriate to accept the project and authorize the City Clerk to file a Notice of Completion. 6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION:. Once the City Council accepts the project as complete, the City Clerk can file a Notice of Completion with the County Recorder. The Finance Department will release the 10% retention to the contractor forty-five (45) days after the recordation of the Notice of Completion, provided there are no liens on the project. 7. RECOMMENDATION: Adopt the Resolution accepting the completion of the project to construct the McNear Peninsula Phase I Improvements Project, and authorize the City Clerk to file a Notice of Completion. HARDY GENERAL ENGINEERING CONTRACTOR, INC. OF PETALUMA. PROJECT #C400304 WHEREAS, at the meeting of January 3, 2005, the Petaluma City Council awarded the Contract to construct the McNear Peninsula Phase I Improvements Project to C. Hardy General Engineering Contractor, Inc. of Petaluma, California; and WHEREAS, the firm of C. Hardy General Engineering Contractor, hic. has satisfactorily completed the construction of the Project per the plans and specifications at a total cost of $432,020.64; and WHEREAS, C. Hardy General Engineering Contractor, Inc. will replace the blank bricks with donor bricks prior to the release of the 10% retention. NOW, THEREFORE BE IT RESOLVED, that the Petaluma City Council does hereby accept the project known as the McNear Peninsula Phase I Improvements and authorizes the City Clerk to file a Notice of Completion with the Sonoma County Recorder. 1+
