Summary Statement: In March 2003 the City of Petaluma acquired three parcels (Banker/Amaral) to
expand upon an earlier grant and property acquisition (Grange) to total approximately 10 -acres. Over a 2 -
year period the City received $1,559,682 in State funding for acquisition of the four parcels and
construction of a range of improvements including creation of a flood terrace, public access, habitat
restoration, parking lot, trails, and educational features on this site consistent with the Petaluma River
Access and Enhancement Plan (adopted May 1996). The City used Storm Drainage Impact Fee funds to
meet City share requirements for obtaining the grants. Phases l and 2 were completed in December 2004.
The responsive low base -bid price for the final phase (Phase 3) was $605,110.50 by C. Hardy General
Engineering Contractor, Inc. In addition to the awarded grant funds, Storm Drainage Impact Fee funds of
$295,000 have been allocated toward the project. To cover the costs of placement of engineered fill and
grading on the PCDC owned parcel on Industrial Avenue, $327,000 of PCDC funds are being brought into
the project, bringing the available funds for project construction to $772,000.
Recommended City Council Action/Sugeested Motion:
Staff recommends that Council direct staff to conclude contract negotiations with the contractor and
authorize the City Manager to execute a construction agreement with C. Hardy General Engineering
Contractor, Inc. for completion of Denman Reach, Phase 3 improvements.

RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE
CONSTRUCTION OF THE DENMAN REACH PHASE 3 IMPROVEMENTS PROJECT TO
C. HARDY GENERAL ENGINEERING CONTRACTOR, INC., AND
AUTHORIZING THE CITY MANAGER TO
EXECUTE THE CONSTRUCTION AGREEMENT.
EXECUTIVE SUMMARY:

The project was put out to bid in June with six (6) firms responding as follows:

The Engineer's Estimate for construction of the Denman Reach Phase 3 Improvement Project is
$601,982. With a bid of $605,110.50, the apparent low bidder is C. Hardy Engineering Inc. The
references gave good reviews of C. Hardy's work; staff verified C. Hardy possesses a valid Class A
California Contractor's license number 745509, expiration date April 30, 2006, qualifying C. Hardy to
perform this project. Staff recommends that Council direct staff to conclude negotiations with the
contractor; and authorize the City Manager to execute a construction agreement with C. Hardy General
Engineering Inc.
ALTERNATIVES:
a. Direct staff to conclude negotiations with the contractor; and authorize the City Manager to execute
a construction agreement with C. Hardy General Engineering Inc.
b. Provide alternate direction for awarding contract.
c. Take no action (deadline to expending grant funds may be compromised, second year funding grant
expires in December 2005). 2

FINANCIAL IMPACTS:
The Denman Reach project is an approved Capital Improvement Project (#500303 with adopted budget
allocations). To date, grant funds have been allocated as follows: $1,296,623 for property acquisition,
appraisal, environmental assessment and administration, $15,000 for regulatory agency permitting and
monitoring, and $248,059 for design, engineering and construction for a total of $1,559,682. All
approved funding sources for the project are outlined below. Currently $772,000 of funding remains
available for construction of Phase 3. Based on existing funding, the proposed budget will be:

CONCLUSION:
Implementation of the River Plan has long been recognized as a City Council priority. This project
represents the third phase (Phases 1 and 2 were completed in December 2004) in making public access
and flood reduction improvements to the lower section of Denman Reach of the Petaluma River a
reality. Coupled with the flood elevation reduction benefits, the project will serve as an example of bow
restoration of the riverine habitat while implementing the River Access and Enhancement Plan can work
together to achieve significant improvements along the Petaluma River.
OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION:
Staff will work with the proposed contractor to conclude contract negotiations. Once the required bonds
and insurance are received, reviewed and accepted, the City Manager can execute the construction
agreement and a Notice to Proceed can be issued. Construction is anticipated to take approximately
three months, with site dedication planned for early December 2005.
RECOMMENDATION:
Staff recommends that Council direct staff to conclude contract negotiations with the contractor and
authorize the City Manager to execute a construction agreement with C. Hardy General Engineering
Contractor, Inc. for completion of Denman Reach, Phase 3 improvements.

RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE
CONSTRUCTION OF THE DENMAN REACH PHASE 3 IMPROVEMENTS
PROJECT TO C. HARDY GENERAL ENGINEERING CONTRACTOR, INC.
AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE
CONSTRUCTION AGREEMENT - PROJECT# C500303.
WHEREAS, the City of Petaluma, per the River Access and Enhancement Plan, is
prepared to construct a flood terrace and riverine restoration area on City -owned land to
meet the needs of the Petaluma community; and
WHEREAS, the City has hired the firm of Questa Engineering to design the proposed
improvements; and
WHEREAS, the City Council and SPARC have reviewed and approved the Conceptual
Design Plan; and
WHEREAS, plans and specifications were prepared, and bids solicited in June 2005 by
the Department of General Plan Administration and the Department of Water Resources
and Conservation to construct the Denman Reach Phase 3 project; and
WHEREAS, 6 bids have been received, with the responsible low base bid from C. Hardy
General Engineering Contractor, Inc. of Petaluma in the amount of $605,110.50.
NOW, THEREFORE BE IT RESOLVED, that the Petaluma City Council does hereby
authorize the allocation of $747,636 in grant and approved budget funds, and to award
the construction contract to build the Denman Reach Phase 3 Project to C. Hardy General
Engineering Contractor for a total amount of $605,110.50; and authorizes the City
Manager to execute the construction agreement, subject to review and approval of all
contracts, insurance certificates, and bonds by the City Attorney.
