Location Map Summary Statement: The Central Petaluma Specific PIan (CPSP) provides for the redevelopment of Water Street North, also known as Poultry Street. Currently, the street is privately owned. Recently, the City Council adopted a plan line for a public street from Washington Street to Lakeville Street. Over the past year, the City has worked to acquire the right-of-way for the street. Property -owners along Water Street North have generously embraced the intention of revitalizing the street by giving up right-of-way in favor of public improvements. Fred Dillett, the developer of the Water Street North Mixed Use Condominium Development has agreed to (mance the cost of public improvements as part of his project. Concurrently, the City is developing a River Trail and reconstructing the defunct floodwall. The two projects will be coordinated so as to maximize the economies of scale. Under Section 37350 of the Government Code, the City of Petaluma is authorized to purchase real property and control and dispose of it for the common benefit. Therefore, the purpose of this item is to pass an ordinance authorizing the purchase of parcels within the North Water Street plan line. EXECUTIVE SummARY: The Central Petaluma Specific Plan (CPSP) provides for the redevelopment of Water Street North, also known as Poultry Street. Currently, the street is privately owned. Therefore, the purpose of this item is to pass an ordinance authorizing the purchase of parcels within the North Water Street plan line. 2. BACKGROUND: Water Street North is currently privately held. With the creation of the CPSP Plan Line for the street there remains only for the City to take title to the right-of-way so that public improvements can be constructed. Fourteen parcels are within the right-of-way circumscribed by the Water Street North plan line. The effected property -owners have agreed to sell their respective right-of-way for $5,000 per owner. This figure was established as a transaction fee and is being paid for by Fred Dillett. Fred Dillett has agreed to make the public improvements approved by Site Plan and Architectural Review Conurrittee (SPARC) in connection with the Water Street North Streetscape Plan. This includes: streetlighting, sidewalks, trees/grates, relocation and repositioning of the railroad tracks, street paving, drainage, and curbs/gutters. As an accommodation to the property -owners, the City will provide them with a license agreement to use portions of the dedicated right-of-way for parking until such time as construction begins. 3. ALTERNATIVES: This approach is consistent with the provisions of the Central Petaluma Specific Plan. Other alternatives would be contrary to the Plan. 11 4. FINANCIAL IMPACTS: A transaction value of $5,000 per property -owner was established in concert with the property -owners. Fred Dillett has deposited sufficient funds with the City to cover the acquisition costs. A total of three property owners are impacted in this transaction. 5. CONCLUSION: The implementation of the Central Petaluma Specific Plan requires the redevelopment of a private street into a public street. Fourteen parcels must be acquired for the public right-of-way. The City is following the State law process for their acquisition and is adopting the ordinance required pursuant to the Petaluma City Charter. 6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION: By August 2005, the City of Petaluma will have an approved plan line for North Water Street and acquired the necessary right-of-way for public improvements. 7. RECOMMENDATION: It is recommended that the City Council introduce the attached ordinance authorizing the purchase of parcel numbers APN's 006-284-028; 006-284-025; 006-284-021; 006-284-034; 006-284-032; 006-284-035. 3 Attachment I AN ORDINANCE OF THE COUNCH, OF THE CITY OF PETALUMA ACCEPTING CONVEYANCE OF REAL PROPERTY ALONG WATER STREET NORTH AND AUTHORIZING THE CITY MANAGER TO EXECUTE CERTIFICATES OF ACCEPTANCE FOR TIIE PARCELS Introduced by ORDINANCE NO. Seconded by BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: WHEREAS, certain owners of real property along Water Street North ("Grantors"), individual persons, own in fee simple parcels of land in the City of Petaluma located along Water Street North as APNs 006-284-028; 006-284-025; 006-284-021; 006-284-034; 006-284-032; 006-284-035; (collectively, the "Property") as more specifically described in Exhibit A attached hereto and incorporated by reference; and WHEREAS, the Grantors have agreed to sell the Property to the City for valuable consideration; and WHEREAS, pursuant to Government Code Section 37350, a city may purchase, lease, receive, hold, and' enjoy real and personal property, and control and dispose of it for the common benefit; and WHEREAS, pursuant to section 46 of the Petaluma City Charter, the City Council must adopt an ordinance to acquire real property; and WHEREAS, the City Council finds that it is desirable for the City to acquire fee simple title to the Property, and further conditioned upon title being delivered to the City clear of any outstanding taxes, assessments, liens or other monetary encumbrances; and WHEREAS, the City Council finds that the actions authorized and granted to the City Manager under this ordinance were considered and approved under the Specific Plan EIR pursuant to the California Environmental Quality Act, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PETALUMA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Section I'Upon execution and delivery by Grantors of grant deeds for the Property, and conditioned upon delivery of title to the Property that is clear of any outstanding assessments, taxes, liens or other monetary encumbrances, the City Council accepts the conveyance of the Property from the Grantors. 4 Section 2. If and when the conditions of Sections 1 are met, the City Manager is hereby authorized and directed to execute Certificates of Acceptance accepting the conveyance of the Property on behalf of the City of Petaluma and cause recordation of the same. Section 3. The City Manager is hereby authorized to undertake such further action as necessary to carry out the intent of this Ordinance, including the issuance of license agreements for the interim use of the deeded property until such time as construction of public improvements begins. Section 4. This ordinance shall become effective thirty (30) days after the date of its adoption by the Petaluma City Council. Section 5.
