Police Department staff has determined that the Santa Rosa Junior College Training Center is in need of
used police vehicles to enhance the police training experience. They rely upon the support of local law
enforcement agencies who have historically donated used police cars to the Training Center. The Petaluma
Municipal Code currently requires all surplus personal property valued over $500 to be sold to the highest
bidder, and prevents the Police Department from selling used police cars to the Training Center. This
amendment will enable the City of Petaluma to provide the Training Center with outdated police cars that
are no longer useful to the City of Petaluma.

It is recommended that the City Council hold the first reading and introduction of the attached ordinance,
authorizing the sale of surplus police vehicles to educational institutions without advertisement for bids or
public auction, and pass the Ordinance to its second reading on September 26, 2005.

Discussion and consideration of first reading of an ordinance authorizing the City Manager
to sell surplus police vehicles to educational institutions without advertisement for bids or
public auction, to benefit the Santa Rosa Junior College Training Center (Police Academy).
EXECUTIVE SUMMARY:
Police Department staff has determined that the Santa Rosa Junior College Training Center is in need of
used police vehicles to enhance the police training experience. They rely upon the support of local law
enforcement agencies who have historically donated used police cars to the Training Center. The
Petaluma Municipal Code currently requires all surplus personal property valued over $500 to be sold to
the highest bidder, and prevents the Police Department from selling used police cars to the Training
Center. This amendment will enable the City of Petaluma to provide the Training Center with police
cars that are no longer useful to the City of Petaluma.
2. BACKGROUND:
The City of Petaluma Police Department routinely relies upon the Santa Rosa Junior College Training
Center in providing newly hired police officer trainees with mandated police academy training. Most of
the law enforcement agencies in this region have relied upon this training facility for decades. Not only
is the Santa Rosa Junior College Training Center conveniently located, but it has also developed an
excellent academic reputation. Many City of Petaluma Police Department employees are employed as
instructors, evaluators and training officers at the Santa Rosa Junior College Training Center, as are
employees of other Sonoma County law enforcement agencies.
The Santa Rosa Junior College Training Center has historically relied upon local law enforcement
agencies for support insofar as training vehicles are concerted. The Training Center's training vehicle
fleet consists primarily of police vehicles donated and/or sold at reduced cost by local law enforcement.
The Petaluma Municipal Code requires all surplus property with a residual value over $500 to be sold to
the highest bidder or at a public auction. Therefore, the Petaluma Police Department cannot provide
used police vehicles to the Training Center for the purpose of law enforcement training.
In an effort to facilitate the transfer of used police vehicles to the Santa Rosa Junior College Training
Center it is necessary to authorize the City Manager to sell these vehicles without advertisement for bids
or public auction. The Police Department anticipates the surplus vehicles would be sold to the Training
Center for no more than $250.00, which is a cost that the Santa Rosa Training Center could afford.
Approval of this amendment to the Municipal Code will enhance peace officer training and facilitate
more efficient law enforcement throughout the County and State.
Vehicles sold to the Santa Rosa Training Center in accordance with this amendment will continue to be
subjected to existing pre -sale conditions such as the removal of City of Petaluma markings and
appropriate waivers will be retained. The only difference is that the vehicles will not be completely
stripped (saving labor costs), because the Training Center would have appropriate use for installed
emergency equipment. However, any equipment on cars destined for transfer that is appropriate for our
re -use will be removed from the cars prior to the transfer.

The Police Department currently has three (3) patrol vehicles destined for surplus that it would sell to
the Santa Rosa Junior College Training Center if this ordinance is adopted. The future number of police
vehicles sold to the Training Center would most likely average 1 per year and could be limited if the
Council chooses to limit it.
Transferring these patrol cars to the Training Center also prevents them from being bought at auction
and made into "facsimile" police cars which are driven throughout our community and often mistaken
for on duty police officers.
3. ALTERNATIVES:
• Do not approve the proposed amendment to authorize the sale of surplus police vehicles to
educational institutions without advertisement for bids or public auction.
4. FINANCIAL IMPACTS:
The City of Petaluma would not recover costs estimated to range from $1,250.00 to 2,750.00 per used
police vehicle destined for auction. In considering this un -recovered cost, the value of enhanced police
training for our future recruits, and the value of more efficient law enforcement throughout the County
and State, must be taken into account to offset the direct immediate financial impact. This transfer also
saves conversion labor costs which the police department pays to make cars ready for resale, as much of
the wiring and some parts can be left in the vehicle.
5. CONCLUSION:
If the City Council approves this amendment, the police department will initiate processes to facilitate
the sale of the used police vehicles destined for surplus to the Santa Rosa Junior College Training Center
as outlined in this report.
6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION:
The Santa Rosa Junior College Training Center will purchase used police vehicles and utilize said
vehicles in police training environments wherein the vehicles enhance the reality of the training. This
contribution will have a direct impact on Petaluma police officer recruits who are trained at the Santa
Rosa Training Center.
7. RECOMMENDATION:
Recommend City Council approves the amendment to authorize the sale of surplus police vehicles to
educational institutions without advertisement for bids or public auction.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF PETALUMA
AMENDING CHAPTER 3.12 OF THE PETALUMA MUNICIPAL CODE TO
AUTHORIZE THE SALE OF SURPLUS LAW ENFORCEMENT VEHICLES TO
EDUCATIONAL INSTITUTIONS WITHOUT
ADVERTISEMENT FOR BIDS OR PUBLIC AUCTION
WHEREAS, the Petaluma City Council recognizes the importance of maintaining quality training for
police officer recruits attending the regional police academy at Santa Rosa Junior College; and
WHEREAS, the Santa Rosa Junior College is forced to rely upon the support of local law enforcement
in continuing to provide police vehicles that enhances the training environment at the regional police academy;
and
WHEREAS, the Santa Rosa Junior College Training Center has expressed a substantial need in keeping
its training vehicle fleet as modern and reliable as possible; and
WHEREAS, the sale of used Petaluma police vehicles destined for surplus, at a reduced cost, would
facilitate the ongoing quality of law enforcement training offered by the Santa Rosa Junior College Training
Center.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:
Section 1. Addition. Section 3.12.045 is hereby added to the Petaluma Municipal Code to read as
follows:
3.12.045 Certain transactions exempt from auction or bidding.
A. Notwithstanding any other provision of this chapter, any police vehicles declared to be surplus
by the Police Chief, regardless of value, may be sold by the City Manager to any educational
institution, or political subdivision thereof, without public auction or advertisement for bids, if
the City Manager finds that the sale will enhance peace officer training.
B. Prior to executing a bill of sale for property covered by this section, the City Manager shall
obtain a written waiver from the purchasing agency releasing the City and its officers and
employees from all liability related to the sale. All property sold pursuant to this section must be
accepted by the purchasing agency without any warranty or guarantee regarding the condition of
the property.
C. The City Manager is authorized to sign bills of sale and any other papers or documents
evidencing sales under this section.
Section 2. If any section, subsection, sentence, clause or phrase or word of this ordinance is for any
reason held to be unconstitutional, unlawful or otherwise invalid by a court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of
Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions
thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional, unlawful or
otherwise invalid.
Section 3. This ordinance shall become effective thirty (30) days after the date of its adoption by the
Petaluma City Council.
Section 4. The City Clerk is hereby directed to post this ordinance for the period and in the manner
required by the City Charter.
