Summary Statement:
In connection with the construction of the Ellis Creels Water Recycling Facility (AW), Pacific Gas and
Electric Company (PG&E) is required to relocate approximately nine utility poles to facilitate the
construction of the access to the WRF. Therefore, the grant of easement from the City to PG&E is
necessary for PG&E to have access to the poles for long-term maintenance. City Council is requested to
approve an ordinance authorizing the City Manager to execute all documents relating to granting of an
easement to PG&E for relocation of utility poles.
Recommended Citv Council Action/Suggested Motion:
City Management recommends the City Coimcil approve the ordinance authorizing the City Manager to
execute all documents relating to granting of an easement to PG&E for relocation of utility poles. The
ordinance will receive a second reading on October 17, 2005.

INTRODUCTION (FIRST READING) OF AN ORDINANCE AUTHORIZING
THE CITY MANAGER TO EXECUTE ALL DOCUMENTS RELATING TO
GRANTING OF EASEMENT TO PACIFIC GAS AND ELECTRIC COMPANY FOR
RELOCATION OF UTILITY POLES
EXECUTIVE SUMMARY:
In connection with the constriction of the Ellis Creek Water Recycling Facility (WRF), Pacific
Gas and Electric Company (PG&E) is required to relocate approximately nine utility poles to
facilitate the construction of the access to the WRF. Therefore, the grant of easement from the
City to PG&E is necessary for PG&E to have access to the poles for long-term maintenance.
City Council is requested to approve an ordinance authorizing the City Manager to execute all
documents relating to granting of an easement to PG&E for relocation of utility poles.
City Management recommends the City Council introducing the ordinance authorizing the City
Manager to execute all documents relating to granting of an easement to PG&E for relocation of
utility poles. The ordinance will receive a second reading on October 17, 2005.
2. BACKGROUND:
The Department of Water Resources & Conservation opened and received two bids for the
construction of the WRF on July 14, 2005. The City Council awarded the construction contract
to the low bidder, Kiewit Pacific Company, on August 1, 2005.
In order to facilitate the construction of the access to the WRF off Lakeville Highway, PG&E is
required to relocate approximately nine utility poles along Lakeville Highway approximately 25
feet west from their existing locations. These poles are in conflict with the Caltrans required right
turn pocket for the WRF. Therefore, the City needs to grant PG&E an easement so that PG&E
can relocate and service the new utility poles on City -owned property.
ALTERNATIVES:
Alternative available for this action include:
• Alternative 1 — Take other action as directed by the City Council
• Alternative 2 — Adopt the ordinance.

4. FINANCIAL IMPACTS:
None.
CONCLUSION:
Following the adoption of the ordinance, the City Manager will execute all documents relating to
the Grant of Easement and the City Cleric will record the document with Sonoma County
Recorder.
6. OUTCOMES OR PERFORMANCE MEASUREMENTS TMAT WILL IDENTIFY SUCCESS OR
COMPLETION:
Timely construction of the Ellis Creels Water Recycling Facility.
RECOMMENDATION:
City Management recommends the City Council approve the ordinance authorizing the City
Manager to execute all documents relating to granting of an easement to PG&E for relocation of
utility poles. The ordinance will receive a second reading on October 17, 2405.

hereinafter called first party, hereby grants to PACIFIC GAS AND ELECTRIC COMPANY, a
California corporation, and Pacific Bell Telephone Company, a California corporation DBA (doing
business as ) SBC California "SBC", hereinafter collectively called second party, the right from time to
time to construct, reconstruct, install, inspect, maintain, replace, remove, and use facilities of the type
hereinafter specified, together with a right of way therefor, within a strip or parcel of land or along a
route as hereinafter set forlh, and also ingress thereto and egress therefrom, over and across the lands
situate in the county of Sonoma, state of California, described as follows:

The parcel of land described and designated TRACT TWO in the deed from David Martinelli and
others to the city of Petaluma dated February 24, 2004 and recorded as Official Records Series Number
2004026254, Sonoma County Record.
Said facilities shall consist of:
Such poles, aerial wires, cables, electrical conductors with associated crossanns, braces, transformers,
anchors, guy wires and cables, and such underground conduits, pipes, manholes, service boxes, wires,
cables, and electrical conductors; aboveground marker posts, risers, and service pedestals; underground
and aboveground switches, fuses, terminals, and transformers with associated concrete pads; and
fixtures and appurtenances necessary to any and all thereof, as second party deems necessary; all to be
located within the strip of land described as follows:
1. A strip of land of the uniform width of 10.0 feet extending southeasterly from the northwesterly
boundary line of said lands, and lying 5.0 feet on each side of the line described as follows:
Commencing at a found 2 inch brass cap tagged RCE 11226 marking the most northerly
comer of said lands and running along said northwesterly boundary line

3. A strip of land of the uniform width of 10.0 feet extending from the northeasterly boundary of

The approximate location of said facilities are shown upon second parry's Drawing Number 30421260 attached

First party grants to second parry the right to install, replace, maintain, and use anchors with appurtenant guy
wires, which will extend outside of said strip of land, at locations second party shall from time to time deem
necessary.
First party further grants to second party the right to assign to another public utility as defined in Section 216 of
the California Public Utilities Code the right to install, inspect, maintain, replace, remove and use
communication facilities along said route (including ingress thereto and egress therefrom).
The Iegal description herein, or the map attached hereto, defining the location of this utility distribution
easement, was prepared by Pacific Gas and Electric Company pursuant to Section 8730 (c) of the Business and
Professions Code.

Second party shall also have the right from time to time to trim and to cut down and clear away or otherwise
control any and all trees and brush now or hereafter on said strip or said parcel of land or along said route, as
herein before set forth, and shall have the furdter right from time to time to trim and to cut down and clear away
any trees on either side of said strip or said parcel of land or along said route, as herein before set forth, which
now or hereafter in the opinion of second party may be a hazard to the facilities installed hereunder by reason of
the danger of falling thereon, provided, however, that all trees which second party is hereby authorized to cut and
remove, if valuable for timber or wood, shall continue to be the property of the first party, but all branches and
brush shall be burned or removed by second party.
First party shall not erect or construct any building or other structure or drill or operate any well under or within
1 o.o feet of the center line of second party's electrical conductors within said strips of land.
First party acknowledges that they have read the attached Grant of Easement Disclosure Statement, which by this
reference, is made part of this Grant of Easement Deed.
The provisions hereof shall inure to the benefit of and bind the successors and assigns of the respective parties
hereto.

GRANT OF EASEMENT DISCLOSURE STATEMENT
This Disclosure Statement will assist you in understanding your rights as a property owner when granting an easement to
Pacific Gas and Electric Company (PG&E) to accommodate your, or your neighbor's, new utility service extension. Please
read this disclosure carefully before signing the Grant of Easement.
• You are under no obligation or threat of condemnation by PG&E to grant this easement
• The granting of this easement is an accommodation to PG&E's applicant requesting the extension of PG&E
utility facilities to the applicant's property or project, pursuant to the Line Extension Rules 15 and 16, as
authorized by the California Public Utilities Commission. As this is an accommodation to a single customer or
group of customers and not PG&E, the California Public Utilities Commission has not authorized PG&E to
purchase such easements.
• By granting this easement to PG&E, the facilities installed within the easement across your property may be
used to serve additional customers in the area.
• Removal and/or pruning of trees or other vegetation on your property may be necessary for the installation of
PG&E facilities. You have the option of having PG&E's contractors perform this work on your property, or
having the applicant or the applicant's contractor perform this work. Additionally, in order to comply with
California fire laws and safety orders, PG&E or its contractors will periodically perform vegetation maintenance
activities on your property as provided for in this grant of easement.
• The description of the location in which the PG&E utility facilities are to be installed upon, in, on, or across
your property must be satisfactory to you.
• The California Public Utilities Commission has authorized that the installation of certain utility facilities for
utility service may be performed by the applicant. In addition to granting this easement to PG&E, you will need to
give your consent to the applicant, or applicant's contractor, working on your property. Upon completion of the
applicant's installation, the utility facilities will be inspected by PG&E. When the facility installation is
determined to be acceptable the facilities will be conveyed to PG&E.
By signing the Grant of Easement, you are acknowledging that you have read this disclosure and understand that
you are granting the easement to PG&E of your own free will. Please return the signed and notarized Grant of
Easement and this Disclosure Statement to PG&E. 'the duplicate copy of the Grant of Easement and this
Disclosure Statement is for your records.

DOCUMENTS RELATING TO GRANTING OF EASEMENT TO PACIFIC GAS AND

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:
Section 1.
City of Petaluma (Grantor) is the owner of a parcel of real property located at 4404 Lakeville
Highway, in the City of Petaluma, County of Sonoma, California, Sonoma County Assessor's
Parcel No. 068-010-033.
Section 2.
Pacific Gas and Electric Company (Grantee) is acquiring from Grantor an easement for
relocation of utility poles.
Section 3.
For such purposes, Grantee intends to relocate existing utility poles onto the Easement.
Section 4.
The City Council, on August 1, 2005, awarded a contract for the construction of the Ellis Creek
Water Recycling Facility Project to Kiewit Pacific Company, the low bidder.
Section 5.
Pacific Gas and Electric Company, in consultation with the Grantor, has prepared a draft grant of
easement, which is included as Exhibit A.
Section 6.
The City Manager is authorized to execute all documents related to this action of granting the
Grant of Easement.

boundary line of said strip of land and continuing
(1) north 15° 27' 08" east 21.1 feet, more or less, to a point in the northeasterly boundary
line of said lands.
The approximate location of said facilities are shown upon second party's Drawing Number 30421260 attached
hereto and made a part hereof.
First party grants to second party the right to install, replace, maintain, and use anchors with appurtenant guy
wires, which will extend outside of said strip of land, at locations second party shall from time to time deem
necessary.
First party further grants to second party the right to assign to another public utility as defined in Section 216 of
the California Public Utilities Code the right to install, inspect, maintain, replace, remove and use
communication facilities along said route (including ingress thereto and egress therefrom).
The legal description herein, or the map attached hereto, defining the location of this utility distribution
easement, was prepared by Pacific Gas and Electric Company pursuant to Section 8730 (c) of the Business and
Professions Code.

Second party shall also have the right from time to time to trim and to cut down and clear away or otherwise
control any and all trees and brush now or hereafter on said strip or said parcel of land or along said route, as
herein before set forth, and shall have the further right from time to time to trim and to cut down and clear away
any trees on either side of said strip or said parcel of land or along said route, as herein before set forth, which
now or hereafter in the opinion of second party may be a hazard to the facilities installed hereunder by reason of
the danger of falling thereon, provided, however, that all trees which second party is hereby authorized to cut and
remove, if valuable for timber or wood, shall continue to be the property of the first party, but all branches and
brush shall be burned or removed by second party.
First party shall not erect or construct any building or other structure or drill or operate any well under or within
10.0 feet of the center line of second party's electrical conductors within said strips of land.
First party acknowledges that they have read the attached Grant of Easement Disclosure Statement, which by this
reference, is made part of this Grant of Easement Deed.
The provisions hereof shall inure to the benefit of and bind the successors and assigns of the respective parties
hereto.

GRANT OF EASEMENT DISCLOSURE STATEMENT 1
This Disclosure Statement will assist you in understanding your rights as a property owner when granting an easement to
Pacific Gas and Electric Company (PG&E) to accommodate your, or your neighbor's, new utility service extension. Please
read this disclosure carefully before signing the Grant of Easement.
• You are under no obligation or threat of condemnation by PG&E to grant this easement
• The granting of this easement is an accommodation to PG&E's applicant requesting the extension of PG&E
utility facilities to the applicant's property or project, pursuant to the Line Extension Rules 15 and 16, as
authorized by the California Public Utilities Commission. As this is an accommodation to a single customer or
group of customers and not PG&E, the California Public Utilities Commission has not authorized PG&E to
purchase such easements.
• By granting this easement to PG&E, the facilities installed within the easement across your property may be
used to serve additional customers in the area.
• Removal and/or pruning of trees or other vegetation on your property may be necessary for the installation of
PG&E facilities. You have the option of having PG&E's contractors perform this work on your property, or
having the applicant or the applicant's contractor perform this work. Additionally, in order to comply with
California fire laws and safety orders, PG&E or its contractors will periodically perform vegetation maintenance
activities on your property as provided for in this grant of easement.
• The description of the location in which the PG&E utility facilities are to be installed upon, in, on, or across
your property must be satisfactory to you.
• The California Public Utilities Commission has authorized that the installation of certain utility facilities for
utility service may be performed by the applicant. In addition to granting this easement to PG&E, you will need to
give your consent to the applicant, or applicant's contractor, working on your property. Upon completion of the
applicant's installation, the utility facilities will be inspected by PG&E. When the facility installation is
determined to be acceptable the facilities will be conveyed to PG&E.
By signing the Grant of Easement, you are acknowledging that you have read this disclosure and understand that
you are granting the easement to PG&E of your own free will. Please return the signed and notarized Grant of
Easement and this Disclosure Statement to PG&E. The duplicate copy of the Grant of Easement and this
Disclosure Statement is for your records.
