Therefore, the grant of easement from the City to PG&E is necessary for PG&E to have access to the poles for long-term maintenance. City Council is requested to approve an ordinance authorizing the City Manager to execute all documents relating to granting of an easement to PG&E for relocation of utility poles. City Management recommends the City Council introducing the ordinance authorizing the City Manager to execute all documents relating to granting of an easement to PG&E for relocation of utility poles. The ordinance will receive a second reading on October 17, 2005. 2. BACKGROUND: The Department of Water Resources & Conservation opened and received two bids for the construction of the WRF on July 14, 2005. The City Council awarded the construction contract to the low bidder, Kiewit Pacific Company, on August 1, 2005. In order to facilitate the construction of the access to the WRF off Lakeville Highway, PG&E is required to relocate approximately nine utility poles along Lakeville Highway approximately 25 feet west from their existing locations. These poles are in conflict with the Caltrans required right turn pocket for the WRF. Therefore, the City needs to grant PG&E an easement so that PG&E can relocate and service the new utility poles on City -owned property. ALTERNATIVES: Alternative available for this action include: • Alternative 1 — Take other action as directed by the City Council • Alternative 2 — Adopt the ordinance. 2 4. FINANCIAL IMPACTS: None. CONCLUSION: Following the adoption of the ordinance, the City Manager will execute all documents relating to the Grant of Easement and the City Cleric will record the document with Sonoma County Recorder. 6. OUTCOMES OR PERFORMANCE MEASUREMENTS TMAT WILL IDENTIFY SUCCESS OR COMPLETION: Timely construction of the Ellis Creels Water Recycling Facility. RECOMMENDATION: City Management recommends the City Council approve the ordinance authorizing the City Manager to execute all documents relating to granting of an easement to PG&E for relocation of utility poles. The ordinance will receive a second reading on October 17, 2405. As this is an accommodation to a single customer or group of customers and not PG&E, the California Public Utilities Commission has not authorized PG&E to purchase such easements. • By granting this easement to PG&E, the facilities installed within the easement across your property may be used to serve additional customers in the area. • Removal and/or pruning of trees or other vegetation on your property may be necessary for the installation of PG&E facilities. You have the option of having PG&E's contractors perform this work on your property, or having the applicant or the applicant's contractor perform this work. Additionally, in order to comply with California fire laws and safety orders, PG&E or its contractors will periodically perform vegetation maintenance activities on your property as provided for in this grant of easement. • The description of the location in which the PG&E utility facilities are to be installed upon, in, on, or across your property must be satisfactory to you. • The California Public Utilities Commission has authorized that the installation of certain utility facilities for utility service may be performed by the applicant. City of Petaluma (Grantor) is the owner of a parcel of real property located at 4404 Lakeville Highway, in the City of Petaluma, County of Sonoma, California, Sonoma County Assessor's Parcel No. 068-010-033. Section 2. Pacific Gas and Electric Company (Grantee) is acquiring from Grantor an easement for relocation of utility poles. Section 3. For such purposes, Grantee intends to relocate existing utility poles onto the Easement. Section 4. The City Council, on August 1, 2005, awarded a contract for the construction of the Ellis Creek Water Recycling Facility Project to Kiewit Pacific Company, the low bidder. Section 5. Pacific Gas and Electric Company, in consultation with the Grantor, has prepared a draft grant of easement, which is included as Exhibit A. Section 6. The City Manager is authorized to execute all documents related to this action of granting the Grant of Easement. First party shall not erect or construct any building or other structure or drill or operate any well under or within 10.0 feet of the center line of second party's electrical conductors within said strips of land. First party acknowledges that they have read the attached Grant of Easement Disclosure Statement, which by this reference, is made part of this Grant of Easement Deed. Please read this disclosure carefully before signing the Grant of Easement. • You are under no obligation or threat of condemnation by PG&E to grant this easement • The granting of this easement is an accommodation to PG&E's applicant requesting the extension of PG&E utility facilities to the applicant's property or project, pursuant to the Line Extension Rules 15 and 16, as authorized by the California Public Utilities Commission. As this is an accommodation to a single customer or group of customers and not PG&E, the California Public Utilities Commission has not authorized PG&E to purchase such easements. • By granting this easement to PG&E, the facilities installed within the easement across your property may be used to serve additional customers in the area. • Removal and/or pruning of trees or other vegetation on your property may be necessary for the installation of PG&E facilities. You have the option of having PG&E's contractors perform this work on your property, or having the applicant or the applicant's contractor perform this work. Additionally, in order to comply with California fire laws and safety orders, PG&E or its contractors will periodically perform vegetation maintenance activities on your property as provided for in this grant of easement. • The description of the location in which the PG&E utility facilities are to be installed upon, in, on, or across your property must be satisfactory to you. • The California Public Utilities Commission has authorized that the installation of certain utility facilities for utility service may be performed by the applicant. In addition to granting this easement to PG&E, you will need to give your consent to the applicant, or applicant's contractor, working on your property. Upon completion of the applicant's installation, the utility facilities will be inspected by PG&E. When the facility installation is determined to be acceptable the facilities will be conveyed to PG&E. By signing the Grant of Easement, you are acknowledging that you have read this disclosure and understand that you are granting the easement to PG&E of your own free will.
