Martin Farms Subdivision is a 17 -lot subdivision located on East Washington Street. The subdivision
received tentative map approval on July 18, 2005. The final map and improvement plans were submitted to
the Community Development Department and at least one review has been completed. The developer is
requesting permission to commence grading activity on the subdivision site prior to final map approval.

FOR
RESOLUTION AUTHORIZING THE DEVELOPER, ANTON SELKOWITZ, TO COMMENCE GRADING
ACTIVITY PRIOR TO FINAL MAP APPROVAL ON THE SITE OF MARTIN FARMS SUBDIVISION
LOCATED ON EAST WASHINGTON STREET
EXECUTIVE SUMMARY: Martin Farms Subdivision is a 17 -lot subdivision located on East Washington
Street. The subdivision received tentative map approval on July 18, 2005. The final map and
improvement plans were submitted to the Community Development Department and at least one review
has been completed. The developer is requesting permission to commence grading activity on the
subdivision site prior to final map approval.
2. BACKGROUND: The developer, Anton Selkowitz, is requesting permission to cormnence grading activity
on the subdivision site prior to final map approval. The final map and improvement plans are currently
in review by the Public Works and Community Development Departments.
According to section 20.36.010 of the Petaluma Municipal Code, no permanent improvement work shall
be commenced until improvement plans and profiles have been approved by the City Engineer and a
subdivision improvement contract has been executed in writing between the subdivider and the City.
Grading is not considered a permanent improvement as defined in this section.
The City requires the developer to enter into a grading agreement and provide a surety to secure the
performance of the grading work.
If the subdivider fails to secure final map approval, or the project is abandoned after the grading is
complete, the subdivider agrees to restore the area graded to its prior condition as stated in the grading
agreement.
3. ALTERNATIVES: Deny permission to grade the subdivision site prior to final map approval. A denial will
delay the grading activity and push the schedule later into the construction season.
4. FINANCIAL IMPACTS: N/A
5. CONCLUSION: The Public Works and Community Development Departments take no exception to the
request for grading prior to final map approval.
6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION:

7. RECOMMENDATION: The Community Development Department recommends approval of the resolution
authorizing the developer, Anton Selkowitz, to commence grading activities on the Martin Farms
Subdivision site prior to final map approval. Approval shall be subject to conditions of said resolution
and securing the standard grading agreement.

AUTHORIZING GRADING
FOR MARTIN FARMS SUBDIVISION
PRIOR TO FINAL MAP APPROVAL
WHEREAS, the developer, Anton Selkowitz, has requested permission to grade the
Martin Farms Subdivision on East Washington Street prior to final map approval.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Petaluma that
authorization to grade Martin Farms Subdivision prior to final map approval is approved, such
approval conditioned on developer's fulfillment of the following:
The developer agrees to comply with the City Grading and Erosion Control Ordinance
No. 1576 N.C.S. and No. 2210 N.C.S.
The developer agrees to comply with the Regional Water Quality Control Board's
policies, file a Notice of Intent and prepare a Storm Water Pollution Prevention Plan.
The developer agrees to enter into a grading agreement and provide surety to secure the
performance of the grading work.
4. The developer shall obtain a grading permit from the Community Development
Department.
Under the power and authority conferred upon this Council by the Charter of said City.
