This has happened with the Technology and Telecommunications Advisory Committee, Tree Advisory Committee, and Youth Commission. I have consulted Elizabeth Pianca of Meyers Nave on this matter, and she informs me that in the case of most City bodies, the legislation passed by Council establishing the body identifies the number of members. This is true for both the "TechTel" Committee and Tree Committee. Council did not specify the number of members when establishing the Youth Commission. Because of this discrepancy, when advertising the vacancies to be filled at the June 19 meeting, I did the following: TechTel Committee: This committee is supposed to have nine members. There are currently two extra members. Four terms expire this year. That would mean that Council should only appoint two members for two-year terms expiring June 30, 2008. However, member Leo Laporte has recently resigned. His term expires June 30, 2007. So we are left with three vacancies. We only have one application, from Carol Eber, who is currently a member, and who has served one of the four one-year terms intended to prevent the members' terms from all expiring at the same time. Tree Committee: This committee is supposed to have seven members. There are currently three extra members. Two terms are expiring. I did not advertise any vacancies on this committee, but have received three applications (two from members currently on the committee). Youth Commission: The enabling legislation does not limit the number of members on this committee. Five terms and expiring, and I advertised five vacancies for terms expiring June 30, 2008. Adopting the Creation of the Technology and Telecommunications Advisory Committee • Petaluma Municipal Code Excerpt: Chapter 2.80 -Tree Advisory Committee Resolution No. 2005-079 N.C.S. of the City of Petaluma, California RESOLUTION ADOPTING THE CREATION OF THE TECHNOLOGY AND TELECOMMUNICATIONS ADVISORY COMMITTEE WHEREAS, great interest has been expressed by members of the community and City Council regarding the formation of a committee that would assist the City of Petaluma in maldng efficient, economical, and productive use of computer technology and telecommunications; and, WHEREAS, the Committee would help promote access to electronic information and community resources for all citizens while protecting individual privacy and free expression; and; WHEREAS, members of the Committee would study local issues and submit recommendations to the City Council. NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council does hereby approve the formation of the Technology and Telecommunications Advisory Committee under the following guidelines: Membership: Nine members Representation: To be determined by the Council Terms: Five members would serve two-year terms; four members would serve one-year terms. Meeting Location: City Hall, or another location by consensus of the Committee. Meeting Time: Meet once a month, at a time to be determined by the Committee. Staff Liaison: I.T. Manager or his designee. City of Petaluma Municipal Code CHAPTER 2.80 TREE ADVISORY COMMITTEE 2.80.010 Establishment. A tree advisory committee consisting of seven members is hereby established for the city. (Ord. 1874 NCS § 1 (part), 1991.) 2.80.020 Qualifications and appointment of members. Three members of the tree advisory committee shall be representatives of the planning commission, recreation, music and parks commission, and the site plan and architectural review committee, and shall be selected by their respective memberships. The remaining four committee members shall be appointed from the community at large by the city council, and of these, one member shall have professional training in arboriculture. All members except the tree professional must have resided in the city not less than one year prior to appointment. (Ord. 1874 NCS § 1 (part), 1991.) 2.80.030 Terms of office. Members of the tree advisory committee selected from the planning commission, recreation, music and parks commission, and the site plan and architectural review committee, shall serve until the 30th day of June after his/her appointment, and until a successor is appointed and qualifies, or until he/she ceases to be a member of the represented commission or committee, whichever occurs first. Terms of office for the other four members of the committee shall be two-year overlapping terms, and they shall serve until the 30th day of June or until his/her successor is appointed. (Ord. 1874 NCS § 1 (part), 1991.) 2.80.040 Vacancies. Upon the death, resignation, disability to perform the duties of a member of the committee, or upon the loss of permanent residency from the city, or upon the failure to attend any meeting of the committee for five consecutive regular meetings, except in case of illness or for some other unavoidable cause, the city council shall review and if found to be appropriate, declare the office of such member vacant and thereupon appoint a qualified person to fill such vacancy for the unexpired term of such member. (Ord. 1874 NCS § 1 (part), 1991.) 2.80.050 Duties. The tree advisory committee shall perform the duties designated and delegated by the city council on matters pertaining to the management of tree resources within the city. The committee shall also serve as a forum for the coordination of tree -related city policies, and shall advise the city on matters referred by city departments, and other council -appointed hearing bodies. (Ord. 1874 NCS § 1 (part), 1991.) 2.80.060 Rules and regulations. The tree advisory committee shall have the right and duty to adopt such rules and regulations as it shall determine for the holding and conducting of its meetings and hearings and the selection of its officers and for the performance of any of its functions or responsibilities. The tree advisory committee shall not have the right to employ any persons or incur expenses or obligations against the city except as provided by and for which appropriations are made by the city council pursuant to and in accordance with budgets adopted by the city council.
