HomeMy WebLinkAboutOrdinance 2395 N.C.S. 02/28/2011EFFECTIVE DATE ORDINANCE NO. 2395 N.C.S OF ORDINANCE March 30, 2011 Introduced by Seconded by Mike Healy Teresa Barrett ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PETALUMA APPROVING OF AN AMENDMENT TO THE IMPLEMENTING ZONING ORDINANCE FOR THE PEP WOOD SORREL SENIOR HOUSING PROJECT (50 UNITS) ASSESSOR'S PARCEL NUMBERS 137 - 170 -037 AND 137 - 061 -023 WHEREAS, Jim Langford of Petaluma Ecumenical Project (PEP Housing) submitted applications for an amendment to the Implementing Zoning Ordinance (IZO) to reclassify property known as the PEP Wood Sorrel, located at 855 Wood Sorrel, APNs 137 -170 -037 and 137- 061 -023 from Planned Community District (PCD) and Planned Unit District (PUD) to R -5 for the purpose of constructing a 50 unit low income residential senior housing project WHEREAS, by action taken on December 14, 2010 the Planning Commission at a duly noticed public hearing considered the proposal and forwarded a recommendation to the City Council to approve the rezoning; and WHEREAS, the City Council finds that the requirements of the California Environmental Quality Act (CEQA) have been satisfied through the preparation of an Initial Study and approval of a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program to address the specific impacts of the PEP Wood Sorrel Senior Housing Project; and WHEREAS, on February 7, 2010, the City Council held a duly noticed public hearing to consider the zoning ordinance amendment of the subject properties from Planned Community District and Planned Unit District to R -5, and 32 NOW THEREFORE, BE IT ORDAINED that the Petaluma City Council hereby 33 approves the reclassification of the subject parcels from Planned Community District and 34 Planned Unit District to R -5 for the Project based on the findings made below: 35 1. The proposed amendment to the Implementing Zoning Ordinance to Rezone the subject 36 properties from PUD - Planned Unit District (APN137 -170 -037) and PCD - Planned Community 37 District (APN 137 -061 -023) to R -5 is consistent with and implements the High Density 38 Residential land use classification of the General Plan. 39 40 2. The proposed rezoning to R -5 is consistent with the Petaluma General Plan Housing 41 Element policies which direct the City: to continue to work with non - profit housing 42 organizations to benefit from their expertise in and resources for developing and 43 supporting affordable housing (nearly all affordable housing projects in the city have Ordinance No. 2395 N.C.S. Page 1 been developed in partnership with non - profit organizations such as Burbank Housing Development Corporation, Eden Housing, and Petaluma Ecumenical Properties). The public necessity, convenience and general welfare clearly permit and will be furthered by the proposed amended Planned Unit District and Planned Community District zoning to R -5 in that the amended zoning designation will result in residential uses that are appropriate and compatible with the existing surrounding uses; permit a project design that provides a greater useable open and community space, increase the City's affordable housing stock; and provide infill residential development of fairly high intensity that is close to public transportation and services, furthering the City's greenhouse gas reduction efforts and climate protection goals. The project plans present a unified and organized arrangement of lots and public streets, appropriate to adjacent and nearby properties. Proposed landscaping would further ensure compatibility. The proposed project would also require Site Plan and Architectural Review and approval by the Planning Commission. The requirements of the California Environmental Quality Act (CEQA) have been satisfied through the preparation of an Initial Study and Mitigated Negative Declaration for the Project. Mitigation measures have been proposed and agreed to by the applicant that will reduce potential impacts to less than significant. A copy of the notice of intent to adopt a mitigated negative declaration was published in the Argus- Courier and provided to residents and occupants within 500 feet of the site, in compliance with CEQA requirements.
