• CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION: Significant exposure to litigation
pursuant subdivision (b) of §54956.9 (California Government Code): one potential case. Existing facts
and circumstances that support that a significant exposure to litigation exists are reflected in requests
for additional compensation submitted by Kiewit Pacific Company to the City concerning the Ellis
Creek Water Recycling Facility project. Compensation requests will be made available for public
inspection on request.

Agreements between the PCDC and the City, Pledging PCDC Funds in Support of
Programs and Projects, Including Publicly Owned Improvements.

Public Comment on Item 1.A
George Weiner, Petaluma, asked if money could be set aside to repair or repave
Copeland Street.
Richard Brawn, Petaluma, said he did not feel this proposal had been adequately
thought through.
Zen Destiny, Petaluma, said that he supports tying up funds before the state steals
them from us.
Bryant Moynihan, Petaluma, stated that Governor Jerry Brown has proposed that
the cities can retain 420 of the incremental property taxes for bond financing. He
suggested that instead of dedicating all this money to projects, the City should
be paying down some of the bonds and not have that kind of exposure in the
future.

Council choose someone with no history, no bias.
