RESOLUTION ACCEPTING COMPLETION OF THE
SEWER OUTFALL REPLACEMENT PROJECT
RECOMMENDATION:
It is recommended that the City Council adopt the resolution accepting completion of the Sewer
Outfall Replacement Project.
2. BACKGROUND:
Treated effluent is conveyed from the wastewater treatment oxidation ponds to the Petaluma
River during the winter months through an outfall which is located adjacent to the river. The
outfall was damaged when struck by a large vessel in the river and needed to be repaired. The
repaired outfall included demolition and removal of the damaged outfall, installation of new
check valves (24") and navigation aids to improve safety and try to alleviate any future incident
by adding additional warnings for vessels navigating in the area of the outfall.
On August 4, 2008, the City Council awarded the contract to DRS Marine, of Vallejo, California.
The Notice Inviting Bids was issued on July 3, 2008. Bids were received and opened on July 17,
2008. Construction began on October 20. 2008 and was completed on June 4. 2009.
DISCUSSION:
Following the acceptance of the project, the City Cleric will file a Notice of Completion with the
Sonoma County Recorder and the Finance Department will release the retention money to the
contractor within 60 days.
4. FINANCIAL IMPACTS:
The final contract cost is

The total construction budget is $275,000.
RESOLUTION ACCEPTING COMPLETION OF THE
SEWER OUTFALL REPLACEMENT PROJECT
WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter,
Section 20162 of the California Public Contract Code and other applicable law, the City of
Petaluma solicited bids for the Sewer Outfall Replacement Project ("Project"); and
WHEREAS, bids for the Project were opened on July 17, 2008 in accordance with California
Public Contract Code Section 4104.5 and other applicable law; and
WHEREAS, the apparent low bid for the Project was the bid of DRS Marine, Inc. ("DRS
Marine") in the amount of $138,191; and
WHEREAS, by Resolution No. 2008-149 adopted August 4, 2008, the City Council of the City
of Petaluma found the bid of $138,191 for the Project to be the lowest responsive bid and
awarded the Project to DRS Marine in the amount of $138,191 conditioned on DRS Marine's
timely executing the Project contract and submitting all required documents and authorized and
directed the City Manager to sign the Project contract on behalf of the City upon such timely
submission and to execute on behalf of the City any amendments to the Project contract that are
necessary to effectively complete the project and/or to realize the Project and/or cost benefits for
the City so long as such amendments do not increase the original contract not -to -exceed amount
by more than $25,000; and
WHEREAS, the following change order affecting the Project amount has been approved:
Change Order No. 1: Remove Tide Flex Valve for Re -manufacture $4,450
Total Change Orders: $4,450; and
WHEREAS, the final contract amount as amended including all change orders is $142,641, and
WHEREAS, City staff has inspected the Project and determined that it has been completed in
accordance with the contract requirements subject to the Contractor's continuing warranty and
other obligations pursuant to the contract; and
WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of
the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as
follows:
The contract entitled Sewer Outfall Replacement Project, City Project Number
C66400904 with a final contract amount of $142,641, is accepted as complete subject
to the Contractor's continuing warranty and other obligations pursuant to the contract.
2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice
of Completion concerning the Project with the Sonoma County Clerk's Office within
ten (10) days of the date of this Resolution.
3. Staff is hereby authorized and directed to release all undisputed retention not subject
to pending change orders within sixty (60) days of the date of this Resolution and in
accordance with the terms of the Project contract, California Public Contract Code
Section 7107 and applicable law.
