RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA
APPOINTING GABE KEARNEY TO FILL VACANCY AND SERVE UNEXPIRED
TERM CREATED BY ELECTION OF DAVID GLASS AS MAYOR
WHEREAS, Council Member David Glass was elected Mayor of the City of Petaluma
in the November, 2010 regular general municipal election, and took office as Mayor on January
3, 2011; and,
WHEREAS, before Mayor Glass was seated, he was serving as Vice Mayor on the City
Council, and approximately two years remained in the unexpired term of the Council seat Mayor
Glass left vacant when he assumed the office of the City of Petaluma's separately- elected mayor;
and,
WHEREAS, Article IV, Section 13, "Elective Officers," of the Charter of the City of
Petaluma ( "Charter ") provides that, "If a vacancy should occur in the office of mayor or
councilman, the council shall appoint a person to fill such vacancy until the next general
municipal election... "; and,
WHEREAS, Article IV, Section 11, "Elective Officers," of the Charter states that, "To be
eligible for the office of mayor or councilman, a person must be a citizen of the United States and a
qualified elector of the State of California and of the City of Petaluma "; and,
WHEREAS, Gabe Kearney is a citizen of the United States and is registered to vote
within the city limits of the City of Petaluma; and,
WHEREAS, in accordance with Article IV, Section 13 of the Charter, at its regular
meeting of January 3, 2011, the City Council directed staff to prepare an application form and
solicit applications from qualified individuals interested in filling the vacancy on the City
Council; and,
WHEREAS, in accordance with Article IV, Section 13 of the Charter, at its special
meeting of January 31, 2011, and regular meeting of February 28, 2011, the City Council met

and considered the applications submitted and heard from candidates applying to fill said
unexpired Council Member term; and,
WHEREAS, the City Council, on February 28, 2011, unanimously selected Gabe
Kearney to fill the seat left vacant by Mayor Glass and directed staff to return to the Council at
its March 7, 2011 regular meeting with agenda materials for formally appointing, swearing -in,
and seating Gabe Kearney as a Petaluma City Council Member, in accordance with Article IV,
Section 13, of the Charter to serve as a member of the City Council until a successor is seated
following the next regular general municipal election on November 6, 2012.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma
that Gabe Kearney is hereby appointed in accordance with Article IV, Section 13, of the
Petaluma City Charter to the City Council to fill the unexpired Council Member term left vacant
by the election of Mayor Glass, commencing immediately upon his taking the oath of office, for
a term to expire upon the seating of the newly elected council members following the regular
general municipal election in November, 2012.
