HomeMy WebLinkAboutPCDC Resolution 84-5 09/04/1984 ~ jj BOARD OF COMMISSIONERS PETALUMA COMMUNITY DEVELOPMENT COMMISSION, ACTING FOR THE REDEVELOPMENT AGENCY OF THE CITY OF PETALUMA RESOLUT-ION NO. 84-5 RESOLUTION ENGAGING PETT.IT &.MARTIN, ATTORNEYS AT LAW, AS BOND COUNSEL AND SPECIAL COUNSEL TO THE AGENCY WHEREAS the Redevelopment Agency of the City of Petaluma wishes to eng""age special counsel and bond counsel for its proposed f nanc.rig activities., including financing for the proposed downtown :parking facilities project; and WHEREAS Pettit & Martin, Attorneys at Law, San Francisco, California, is .willing and able to~represent the agency in such capacity,: NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Petaluma Community Development Commission, acting as the legislative body of the Redevelopment Agency of the City of Petaluma, as follows: 1. Pettit & Martin, Attorneys at Law, are hereby appointed as special counsel and bond counsel to the Redevelop- ment Agency of the City of Petaluma. 2. Said attor-Heys shall, be paid. for general work and ad-vice on a reasonable-hourly basis in accordance .with billing arrangements to be worked out between the agency and 'its Executive Director. Said attorneys shall be reimbursed all reasonable and necessary out-of-pocket expense s.~n connection with such work and advice. 3. For bond counsel services, said attorneys shall be paid on a contingent basis upon the issuance of bonds by the agency upon the following fee schedule: As to each separate issue, said bond counsel shall be paid 2% of the first $3 million and 1-l/4% of the aggregate dollar amount over $3 million of bonds issued by the agency, together •wth r'eas.onablfe;out-of-pocket expenses.
