HomeMy WebLinkAboutResolution 2008-210 N.C.S. 11/17/2008Resolution No. 2008-210 N.C.S. of the City of Petaluma, California FIXING THE EMPLOYER'S CONTRIBUTION UNDER THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT WHEREAS, Government Code Section 22892(a) provides that a local agency contracting under the Public Employees' Medical and Hospital Care Act shall fix the amount of the employer's contribution at an amount not less than the amount required under Section 22892(b)(1) of the Act; and, WHEREAS, Government Code Section 22892(c) provides that a contracting agency may fix the amount of the employer's contribution for employees and the employer's contribution for annuitants at different amounts, provided that the monthly contribution for annuitants is annually increased to equal an amount not less than the number of years the contracting agency has been subject to this subdivision multiplied by 5 percent of the current monthly contribution for employees, until such time as the amounts are equal; and, WHEREAS, the City of Petaluma, hereinafter referred to as Public Agency, is a local agency contracting under the Act for participation by members of the Petaluma Peace Officers' Association; and, WHEREAS, the City of Petaluma and the Petaluma Peace Officers' Association have agreed that the fixed amount of the employer's contribution for retired annuitants effective January 1, 2009 shall be $ 85.00 per month; and, WHEREAS, the Public Employees' Medical and Hospital Care Act (PEMHCA) formula requires a minimum contribution of $80.80 per month (The City of Petaluma has been in the program for 16 years multiplied by 5 percent = 80% times the monthly contribution of $101.00 = $80.80); and, WHEREAS, the agreed upon fixed amount of $ 85.00 per month is greater than $80.80 per month. Page 1 NOW, THEREFORE, BE IT RESOLVED that the employer's contribution toward the cost of each active employee's enrollment, including the enrollment of his/her family members, in a health benefits plan shall be up to a maximum of $101.00 per month effective January 1, 2009; and, BE IT FURTHER RESOLVED that the employer's contribution toward the cost of each annuitant's enrollment, including the enrollment of his/her family members, in a health benefits plan shall be fixed in calendar year 2009 at $85.00 per month and the contributions for employees and annuitants shall be in addition to those amounts contributed by the Public Agency for administrative fees and to the Contingency Reserve Fund Assessments.
