HomeMy WebLinkAboutResolution 2008-214 N.C.S. 11/17/2008Resolution No. 2008-214 N.C.S. of the City of Petaluma, California APPROVING MEMORANDUM OF UNDERSTANDING REGARDING SONOMA MARIN WATER SAVING PARTNERSHIP WHEREAS, the City of Petaluma operates and maintains an extensive water supply, storage and distribution system, whose primary source of water is wholesale water purchased from the Sonoma County Water Agency (Agency); and, WI-IEREAS, the Sonoma County Water Agency (Agency) operates and maintains a water supply and transmission system (Transmission System) authorized by the Restructured Agreement for Water Supply between and among the Agency and eight Water Contractors: Cotati, Petaluma, Rohnert Park, Santa Rosa, Sonoma, Windsor, NMWD, VOMWD, dated June 23, 2006, by means of which water is furnished to the parties thereto. The Agency furnishes water to MMWD pursuant to the Third Amended Off-peak Water Supply Agreement and Agreement for Sale of Water Between the Sonoma County Water Agency and Marin Municipal Water District both of which were last amended by the Supplemental Water Supply Agreement dated January 25, 1996; and, WHEREAS, the Restructured Agreement authorizes the Agency to undertake or fund any cost effective Water Conservation Project that has been approved by the Water Advisory Committee (WAC); and, WHEREAS, for the 10-year period ending June 30, 2008, the Agency collected, through its water charges, $15 million, which was returned to the Water Contractors for implementation of water conservation programs and projects; and, WHEREAS, the purpose of the 10-year water conservation funding program was to provide water contractors with an incentive to jump-start their water conservation programs; and, WHEREAS, the Water Contractors and MMWD recognize the benefits of forming a partnership to enhance water conservation in Marin and Sonoma counties; and, WHEREAS, the Memorandum of Understanding Regarding the Sonoma Marin Water Saving Partnership commits the Water Contractors and MMWD to implementing water conservation measures and annually budgeting and expending funds in support. of water conservation; and, WHEREAS, on March 3, 2008, the WAC unanimously recommended approval of the MOU and recommended that each Water Contractor take the MOU to their respective Boards and Councils for adoption; and, WHEREAS, the requirements of the MOU are consistent with Petaluma's water conservation program, including implementation of the California Urban Water Conservation Council's Best Management Practices, support of efficient irrigation practices, incentives for purchase and use of water efficient fixtures and appliances, implementation of new construction Resolution No. 2008-214 N.C.S. Nage 1 water conservation standards, commitment of City staff resources for program implementation, and collection and review of water conservation data. and information. NOW, THEREFORE, BE IT RESOLVED BY THE PETALUIVIA CITY COUNCIL, THAT: 1. The Memorandum of Understanding Regarding the Sonoma Marin Water Saving Partnership is hereby approved. 2. The Mayor is hereby authorized and directed to sign the Memorandum of Understanding Regarding the Sonoma Marin Water Saving Partnership on behalf of the City of Petaluma. Under the power and authority conferred upon this Council by the Charter of said City.
