Patricia Hilligoss. OATH OF OFFICE The City Clerk administered the Oath of Office for FOR ROBERT DALY newly appointed Councilman Robert Daly. The term will expire June 30, 1979. ROLL CALL Present: Councilmen Balshaw, Bond, Cavanagh, Daly, Harberson, Perry, Mayor Hilligoss INVOCATION The invocation was led by Councilman Reverend Bond. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilman Perry. MINUTES The following minutes were approved as submitted: December 11, 1978; December 18, 4:00 p.m. and December 18, 7:00 p.m.; and, January 2, 1979 regular meeting. AYES: BALSHAW /BOND /CAVANAGH /DALY /HARBERSON /PERRY/ MAYOR HILLIGOSS MARINA - SMALL CRAFT Mayor Hilligoss announced she owned property near one HARBOR SITE SELECTION of the sites under consideration and she stepped down from the Chair and abstained from the discussion. Vice -Mayor Harberson assumed the Chair during the discussion of this item. A tentative date of January 29th at 7:30 p.m. was established °for a workshop on this topic. Those who spoke at the Council meeting were representatives of H- K-S, the consulting firm that has been retained by the Army Corps of Engineers; John Buss and Joan Lamphiere represented H -K -S; Robert Hall, Project Coordinator for the Army Corps of Engineers; Jim Matsueda of Department of Boating and Waterways,.David Menary, Jr., Mr. McLaughlin and Mr. Combs. At the conclusion of the discussion, Council requested that_ more information be :made::ava fable for the, workshop= study.: RECESS 8:05 to 8:20, all Councilmen were present when Mayor Hilligoss resumed the meeting. SIGN ORD #1345 NCS Adoption of Ordinance No. 1345 N.C.S. repealing Sec- tions 21.204.17 and 21.204.41 of the Zoning Ordinance No. 1072 N.C.S. The Mayor opened the public hearing.. There being no comments from the audience, the hearing was closed. The vote on adoption of Ordinance No. 1345 N.C.S. was: AYES: BALSHAW /BOND /CAVANAGH /DALY /HARBERSON /PERRY/ MAYOR HILLIGOSS PUBLIC HEARINGS: APPEAL BY VALLEY Mr. Jack Harte appealed the limitation of the subdivi- OAKS SUBDIVISION sion to 50 lots. He requested.that they be allowed to REPRESENTATIVES develop 54 lots in that area (intersection of Sunny - slope Road and "I" Street Ext.). Acting Planning Director Fred Tarr read the December 22, 1978 letter of appeal. He noted the developer needs four more residential development allotments. The public hearing was opened. The following representatives of the developer spoke: Manual Pacheco of S & M Construction; Joe White, Real Estate Representative; Don Mitchell of MacKay and Somps Engineering firm, and the developer Mr. Harte. APPEAL UPHELD V Resolution No. 8422 N.C.S. upholding the appeal of Jack RES #8422 NCS Harte from the requirement that the Valley Oaks Subdivi- sion build only 50.1ots with appropriate findings and noting that lots 44, 45 and 46 at the end of the cul -de -sac would not receive building permits until residential development allotments were awarded for those lots. Acting Planning Director Fred AT "I" VALLEY OAKS Tarr reviewed the project, he read a January 9, 1979, SUBDIVISION letter from Mrs. Helen King expressing concern over ORD 41346 NCS traffic on "I" Street and drainage in the area. He stated this was an example of the concern that had been expressed by residents in the area. Residents James Caldwell, P. Loomis, Dan Libarle and Neil Landsbury expressed concern about the traffic on "I" Street and the drainage. Jon Anderson and Don Mitchell of MacKay and Somps noted this subdivision is only a small part of the watershed for Thompson Creek. City Engineer Dave Young suggested the Council ask the Sonoma County Water Agency to advise the status of the Thompson Creek project for this fiscal year. The hearing was closed and a vote was taken on adoption of Ordinance No. 1346 N.C.S. amending Zoning Ordinance No. 1072 N.C.S. by reclassifying and rezoning AP 419- 202 -03, 04, and 16 (consisting of approximately 40 acres) from Planned.Community District to R -1- 10,000 located at the inter- section of Sunnyslope Road and "I" Street Ext. There being no further public input, the hearing was closed. A vote was taken on the resolution approving the tentative subdivision map - Valley Oaks Subdivision. Vote on adoption ORD 441344 NCS of Ordinance No. 1344 N.C.S. amending Chapter 20.30 of the Petaluma Municipal Code (conversions to community housing - condominiums) to revise certain eligibility criteria, to clarify Section 20.30.040B, to add Section 20.30.045 to revise application requirements. Acting Planning Director Fred AMENDMENTS Tarr reviewed the changes recommended by the Planning CORONA ROAD & Commission and the changes recommended by Planning NORTH MCDOWELL BLVD. staff. Dick Lieb, representing medical interests, expressed concern over the Planning Commission's rec- ommended Environmental Design Plan for the area. Mr. Jim Duckworth, represent- ed property owner Dave Young, Mrs. Lucy Webb represented property owner Benny Friedman. The property owner's representatives expressed concern over the various Environmental Design Plan designations as they did not coincide with property boundaries. There being no further comment, the hearing was closed. M/s Bond - Cavanagh to re- consider the Council's January 2nd vote on Ordinance No. 1343 N.C.S. AYES: BALSHAW /BOND /CAVANAGH /DALY /HARBERSON /PERRY/ MAYOR HILLIGOSS Vote to adopt Ordinance No. 1343 N.C.S. to amend Chap- ter 17.26 of the Petaluma Municipal Code to provide for an increase of reser- vations for residential allotments in certain extraordinary circumstances. Vote on adoption: AYES: BALSHAW /BOND /CAVANAGH /DALY /HARBERSON /PERRY/ MAYOR HILLIGOSS City Attorney Klose read an emergency clause to be added to this ordinance in order that it would become effective prior to February 1, 1979. COUNCIL REPRESENTATIVE r 1 TRAFFIC COMMITTEE The Traffic Committee request for removal of two park - ing spaces on Petaluma Blvd. at the Golden Concourse was continued to a future time after the Parking and Business Improvement Area Committee have had an opportunity to meet with them on this proposal.
