The invocation was led by Rev. Shields of the Church of Christ. The Pledge of Allegiance was led by Marilyn Moved by Councilman Perry, seconded by Councilman Cavanagh. CLAIMS & BILLS Resolution No. 8496 N.C.S. approving claims and bills RES #8496 NCS audited.by the City Auditor and approved for payment by the City Manager. April 2, 1979 LOYALTY OATH City Clerk administered the loyalty oath to Thomas S. CITY ENGINEER Hargis, City Engineer. RECREATION,.MUSIC AND The following persons addressed the Council expressing PARKS COMMISSION their interest to be on the Recreation, Music and Parks Commission to replace Glade Giles: Paul. Pedroni, Robert Tribble, Marilyn Hoff'and Cliff Cole. The first vote of the Council resulted in: Tribble - 3, Pedroni - 2, Cole - 2. On the second vote, the result was Tribble - 3, Pedroni - 2, Cole - 2. On the third vote, Council- revised its.method of voting and rated,each candidate in order of preference, one being most preferential. The result follows: Tribble - 15, Cole - 17, Pedroni - 18 and Hoff - 20. APPOINTMENT TO RE- Resolution No. 8502 N.C.S. to appoint Robert Tribble CREATION, MUSIC AND to the Recreation, Music and Parks Commission. CERTIFICATE OF The Mayor presented a Certificate of Appreciation to APPRECIATION Glade Giles for his service to the City. APPEAL - CASA DEL ORO Planning Director Greg Freitas revieWed .the Pl.anninq Com- SUBDIVISION mission action to recommend denial of the requested - rezoning and noted that their reasoning was the small size of the sewer lateral that now connects the area to the sewer plant and the Planning Comrntssi on' s concern over Proposition 13 constraints on the City. Michael Harlock of Robert E. Ecklund Inc. on behalf of Novak Development Company addressed the Council and noted the developer is willing to provide an 18" sewer for this area and is willing to pay an equitable share of traffic control systems that may be developed in the area, although he felt this development would add only a minor contribution to the'tr.affic burden on Lakeville Highway. He re- quested that the Council uphold the appeal. APPEAL UPHELD RES #8503.NCS Resolution No. 8503 N.C.S. upholding the appeal of Randy Straub and Michael Harlock for Novak Develop- ment Company on behalf of the property owner. Council recessed from 8:30 p.m. to 8:40 p.m. GENERAL PLAN AMEND- Resolution No. 8508 N.C.S. adopting an amendment to the MENT, LIBERTY, KEOKUK Environmental Design element of the General Plan at MAGNOLIA AVENUE AREA Liberty; Keokuk, Magnolia Avenue. AYES: BALSHAW /BOND /CAVANAGH /DALY /HARBERSON /PERRY AND MAYOR HILLIGOSS. 2 April 2, 1979 ORDINANCE REZONING Ordinance No. 1356 N.C.S. amending Zoning Ordinance LIBERTY' MEADOWS No. 1072 N.C.S. by and rezoning the ORD #1356 NCS property located between Keokuk .Street and Liberty Street Extension (AP #6- 030 -31) (Approximately 4.58 acres) from R -M -G (Garden Apartments) to PUD (Planned Unit) District. (Liberty Meadows) Principal Planner Fred Tarr reviewed the action to be taken on this property. The hearing was opened. Richard Lieb, architect for the Dro,ject. spoke to the Council and commented that there was an oak tree -i.n.- the - : proposed right - of -way of Liberty Street, and asked if the Council would be willing to try to save this tree from destruction. The City Engineer was asked to work with the developer towards designing Liberty Street in order to save the tree. COUNCIL PACKET MAP Council asked staff to furnish as many maps as pos- sible in.8 -1/2 x 11 size. GENERAL PLAN AMENDMENT City Clerk read letters from Messrs. Nelson and Hagopian ADJACENT TO WESTRIDGE / , urging Council not to approve the General Plan amend - LAVIO PROPERTY ment. Derrick Simmons, representing a property owner RES. #8509 NCS on "D" Street; Wayne Jenkins, 179 Westridge Drive; John Nelson, 206 Sunnyslope avenue; Richard Falls, 143 Westridge Drive; Diane Nelson, 206 Sunnyslope Avenue; Arthur Hagopian, Tom Richmond, and Dr. Jonas addressed the 'Council regarding the proposal. Some concerns expressed were: Thompson Creek flooding; Proposi-ti:on 13. cohstrM,hts on t he city relating to police and fire.service; traffic from.the proposed subdivision as it would affect "I" Street and Sunny-slope - lope Avenue and SunnyslopeRo6 and'desirabil of having a green belt between the currently standing subdivision of Westridge and the proposed subdivision. Chuck Linthecomb of Debra Homes addressed the Council supporting the proposal and said the developer.is willing to work with a neighborhood and noted that the EIR did identify the traffic and Thompson Creek problems. The -re being no further comment, the 'heari,ng was closed. Council directed the following concerns be stated in an Exhibit to the resolution: A. There shall be access to "I "Street Extension. B. The interphase of the density of the current Westridge with the planned development. C. Traffic on Sunnyslope Avenue and Sunnyslope Road, D. The drainage to Thompson Creek. Resolution No. 8509 ,N.C.S. adopting amendments to the General Plan and to its Environmental Design Element - Westridge. Introduced by Councilman Balshaw, seconded by Councilman Harberson. NOES: VICE -MAYOR HARBERSON, Councilman Perry TRANSFER OF ALLOTMENTS Council agreed to'discuss.a mechanism for trans - ferring residential devel opment allotments at a future study session. April 2, 1979 AIRPORT SUBCOMMITTEE Councilman Bond.noted the. Subcommittee.will be meeting prior to April 16, at which time they will report their recommendations to the Council. SCHOOL LOCATION Mayor Hilligoss made the following appointments to the COMMITTEE School Location Committee: Chairman - Vice -Mayor Harberson Councilman Balshaw Planning Commissioners Shearer and Popp; Recreation, Music and Parks Commissioners Read and Mamone; Adobe School District, Directors Currier and Johnson; Petaluma.School Board members Conley and one to be named later; Construction Industry Assoc- iation representatives Jon Joslyn and Van Norden Logan, and representatives of the airport, Robert Mackey and Don Smith. MAYOR'S COMMITTEE ON Mayor Hilligoss made the following appointments to the DEVELOPING FIRE Committee on Developing Fire'Ordinance: ORDINANC Skip Sommer, Charlie Hassell, Jean Winterhalder, Walt Smith, George Sutherland, Rich Yonash, Halter Kieckhefer, Councilman Bond, Chairman; Councilmen Harberson and Cavanagh, Fire Chief Sharp, , John Scharer and Clyde Thomas.
