AMEND CONTRACT OF Resolution No. 8636 N.C.S. authorizing amendment to BREACHING LEVEE contract for engineering-services for the levee, on- RESO 48636 NCS site grading and disposal of excess materials, and authorizing the Mayor to sign said amendment.to contract. FIRE DEPARTMENT Resolution No. 8637 N.C.S,. awarding contract for the VEHICLE purchase of one G.M.C. van for Command Vehicle for Fire RESO 48637 NCS Department. COMPLETION CONTRACT .Resolution No. 8638 N.C.S. accepting completion of BREACHING LEVEE contract for breaching,the on- site =grading and RESO #8'638 NCS disposal of excess materials, and authorizing payment to Western Dock Enterprises. CENTER RESO 448640 NCS ABOLISH WATER Adopt Ordinance No. 1376 N.C.S. repealing Chapter 2.16 COMMISSION of the Petaluma Municipal Code to abolish the Water ORD. 4413 NCS Commission. 1 1 W,-, AUGUST 20, 1979 EAST WASHINGTON ST. Resolution No. 8641 N.C.S. of necessity to condemn WIDENING certain real property located adjacent to the right -of- RESO 48641 NCS way East Washington Street in the City of Petaluma between U.S. Highway 101 and Lakeville Street. Mr. Ed DeCarli, representing property at 722 and 732 E. Washington Street, addressed the Council. Council asked staff to place top priority on scheduling a meeting between Mr. DeCarli, a representative of Standard Oil Company, a representative of CALTRANS, the City Attorney, City Engineer and the Planning Department to attempt to obtain answers to the property owner's questions. Council also heard from Victor DeCarli regarding his property at Edith and E. Washington . Street. Council directed staff to set up a similar meeting for Victor DeCarli, CALTRANS and staff to answer his questions. Council directed staff to advise them each time it would be necessary to use the authority which is granted by this resolution. The resolution was introduced by Councilman Balshaw,, seconded by Councilman Perry. AYES: BALSHAW /BOND /HARBERSON /PERRY /MAYOR MATTEI NO: CAVANAGH ABSENT: BATTAGLIA REQUEST TO MODIFY Council heard from Mr. Willis F. Stewart, whose son, COMMERCIAL PARKING Gary,.speaking,on his father's behalf, requested the RESTRICTIONS Council reconsider the prohibition of commercially licensed vehicles from parking in residential areas. His contention is that his commercial vehicle weighs less and has less horse- power than most recreation vehicles which are not restricted. Council referred the question to staff for recommendation. MATTEI ABSENT: BATTAGLIA SCHOOL FACILITIES Ordinance No.` 1377 N.C.S. amending the Petaluma Municipal ORDINANCE Code on an urgency basis by adding Chapter thereto, ORD. 1377 NCS to adopt a School Facilities Ordinance. Introduced by Councilman Balshaw, seconded by Vice -Mayor Bond. Before the vote was taken on the - resolut on, Tom Baker addre'ssed'the'Council expressing his objections to the proposal. Vote -2- AUGUST 20, 1979 AYES: BALSHAW /BOND /CAVANAGH /HARBERSON /PERRY/ MAYOR MATTEI ABSENT: BATTAGLIA Mayor Ma•ttei suggested the following names for a Marina Committee: Robert'McLaughlin, Matt Hudson, Al Alys, Jim Morris, Dave Hilendahl, Councilman"Cavanagh and Vice -Mayor Bond. The Mayor asked staff to designate a staff person whom the-Army Corps of Engineers could use for all their contacts with the City. RECESS 8:30 p.m. to 8:37 p.m. PUBLIC HEARINGS WCTU DRINKING FOUNTAIN Ordinance No. 1375 N.C.S. designating the Women's LANDMARK Christian Temperance Union drinking fountain at the ORD. #1375 NCS corner of Western Avenue and Petaluma Blvd. North in the City of Petaluma an historic landmark. Vice -Mayor Bond said that the W.C.T.U. has been in this town since 1879. During their upcoming conference, they will dedicate a new bench in Walnut Park as well as visit the fountain. The hearing was opened. There was no oral or written comment offered. The hearing was closed and a vote was taken to adopt the ordinance. AYES: BALSHAW /BOND /CAVANAGH /HARBERSON /PERRY/ MAYOR MATTEI ABSENT: BATTAGLIA CARD ROOM - Police Chief Murphy answer red Council's questions. The EXTENSION OF HOURS hearing was opened. Stanley DeBernardi, card dealer at the Hide -A -Way on Kentucky Street, Lola Harrick,, of Petaluma Blvd. Bowl, and 0. Davis Nelson, an interested card player, addressed the Council in support of extending the hours Friday night (Saturday morning) to include the - hour ' s between 2 a.m, and 9 a.m, for card playing. Comments were also made regarding authorization of having drinks at the table during allowable drinking hours. Mr. Ray Wilson, owner of the ^Hide -A -Way, noted that Mr. DeBernardi's competition in surrounding towns and county areas has authorization to stay open on Friday nights, all night, as well as'authorization to serve drinks at the table during allowable drinking hours. There being no further comment offered in either written or verbal form, the hearing was closed. Chief Murphy requested if the Council supported this extenison of card playing time,, then the card rooms.be physically separated from the bar. M/s Balshaw- Bond, to deny the request. AYES: BALSHAW /BOND /HARBERSON NOES: CAVANAGH /PERRY /MAYOR MATTEL ABSENT: BATTAGLIA (Motion Failed) The Mayor asked the City: Attorney to prepare'a suitable ordinance which would permit.card playing Saturday mornings from 2 a..m. to 9 a.m., alcoholic drinks at the table when the bar is open, require a barrier between the bar and the card tables, and require that a licensed . guard be hired by the card business. After some discussion over the parliamentary procedure on the question, Council asked that the ordinance be brought back only at a meeting when there would be a full seven - member Council present. -3- 201 AUGUST 20, 1979 LANDSCAPING AND Council went over the 36 policy points, item by item, IRRIGATION POLICY with Planning Director Freitas and a representative of RESO 48644 NCS the Chamber of Commerce. Resolution No. 8644 N.C.S. adopting City Landscape and Irrigation System Policies. Introduced by Councilman Harberson, seconded by Council - .. man Balshaw. WASTEWATER IRRIGATION Margaret Kullberg presented a petition signed by 57 IN PETALUMA /LAKEVILLE landowners stating they do not want any of their land AREA bought,. leased or condemned for the use of waste- water reservoirs or for,the use of spraying of wastewater for health, land, and water contamination and economic.reasons. She asked that Council consider their request when they attend the Regional Water Quality Board hearing August 21 on the Revised Order establishing a revised compliance time schedule for the Water Pollution Control plant -in Petaluma. SITE DESIGN COMMITTEE Due to the lateness of the hour, this item was continued ORDINANCE to the next Council meeting. WATER -RATES Ordinance No. 1374•N. -..of the City of Petaluma ORD. T41374 NCS amending Subsection•.B .of . Section 15.16.040 of the Municipal Code (Water Ordinance) to increase the metered rate for water from $0.38/100 cubic feet to $0.50/100 cubic feet. Council agreed to hold a special meeting after learning the results of the hearing on the California Regional Water Quality Control Board on Tuesday afternoon, if such meeting be necessary to,proceed with grant application.: . TRAFFIC SIGNAL City Engineer Hargis reported the property owners on LAKEVILLE & 101 SOUTH .the west of that. ntersection have indicated their willingness to participate in the cost of.the signal, and staff is waiting for their written statement to that effect. SURPLUS PROPERTY Resolution No. 8645 N.C.S. declaring_that.certain.real OLD McNEAR WATER TANK property known as McNear Tank Site to be surplus and RESO #8645 authorizing the City Manager to dispose of same. BOARD OF APPEALS/ Resolution No. 8646 N.C.S. appointing Charles Phillips BOARD OF BUILDING to the Board of Appeals /Board of Building Review for a REVIEW term to expire at the pleasure of the.City Council. Priority #3: South McDowell Blvd., from McNeal to It was the consensus of the Council to accept that LEAGUE OF CALIFORNIA Council agreed by unanimous consent that the Mayor and CITIES Vice- Mayor would be the voting and alternate voting . delegates at the annual League meeting in , September. MAYOR'S ADVISORY The following persons were appointed to the Committee: COMMITTEE FOR HUMAN Rev. Herb Bauch, Chairman; Mary Isaac; Teresa Leonard; SERVICES (COMMITTEE R. Goetzinger; G. Callahan; Ann Pepper:; Ed Benedict; TO CLOSE DOWN William Beatie'; William ,Schneider; Mrs. Jerry Beatty; MARCH 1, 1980) . Harold Alexander; Simon; and Vice - Mayor Bond. Their charge is to study the possibilities of a Senior Day Care. Center, ideas for financing such a center and coordination with the Petaluma Ecumenical Program. FORCED,ANNEXATIONS Mayor Mattei asked Council's support in sending a letter- to local Agency Formation Commission (LAFCO) opposing forced annexations. TENTATIVE MAP Architect Dick Lieb presented plans for Liberty Meadows LIBERTY MEADOWS Subdivision of town houses. He requested variances on RESO 48647 NCS meandering sidewalks, number of accesses to the develop - ment, and permission to save an Oak tree on the corner of the property.. Barry Parkinson, attorney for adjoining property owner Milt Foreman, addressed the Council relating to the possibility of; ,using the, "Foreman property for temporary, emergency access to the Liberty Meadows_Subdvision. Resolution No. 8.647 N.C.S. approving Tentative Map Liberty'Meadows, introduced by Councilman Perry, seconded by Vice -Mayor Bond.
