ENCROACHMENT PERMITS Adopt Ordinance No. 1366 N.C.S. adding Section 13.04.1052,
ORD. 41366 NCS to and amending Section 13.04.110 of the Municipal Code
to prohibit utilization of sidewalks for access unless
an encroachment permit is obtained. (Staff was requested
to do a photographic survey of the driveways that will
have to be corrected under this Ordinance.)

ABAG - AHOP Resolution No. 8673 N.C.S. supporting the Area Wide
RESO #8673 NCS Housing Opportunity Plan (AHOP) of the Association of
Bay Area Government (ABAG). Introduced by Councilman
Cavanagh, seconded by Councilman Battaglia. Gordon Jacoby from ABAG described
the federally mandated "incentive" program which should bring additional housing
subsidies and a higher priority on Department of Housing and Urban Development
(HUD) review of Grant applications for discretionary ,Community Development
.Block Grant Funds in Petaluma. AHOP would also provide an opportunity for
cities and counties to determine the distribution of Federal housing subsidies,
rather than HUD determination. It was estimated the additional support in
Petaluma from HUD would be 60 dwelling units over the next three years. After
considerable discussion, the vote showed:

LICENSED CARD ROOMS Introduce Ordinance No. 1383 N.C.S. amending Section
ORD. #1383 NCS 6.20.020 of the Municipal Code to revise regulations
.for the operation of licensed card rooms in accordance
with Council direction of August 20. Introduced by Councilman Perry, seconded
by Councilman Cavanagh.

FLOODWAY MORATORIUM. Resolution,No. 8674 N.C.S. modifying the moratorium

Introduced by Councilman Harberson, seconded by Councilman Perry. Planning
Director Freitas indicated- this.is an attempt to lift the moratorium, with
conditions, in order to,enhance building in the Industrial Parks area.

INFLUENCE Director Freitas indicated there have been some illegal

MANAGER EXECUTE Resolution No. 8677 N.C.S. authorizing City Manager to

Perry. Staff indicated this is step towards reduction of paper work and time
involved in processing certain matters.

SLOPE DENSITY MAPS City Manager called Counci'l's attention to the 5% Slope
Density Map the Planning staff had prepared and hung on
the wall. Mayor asked that the staff prepare the same in reduced form for
distribution to each Councilman.
CITY ATTORNEY The Manager reviewed the City Attorney's list as revised.
WORK PRIORITIES It was Council "s consensus to approve this list to
indicate that each of the projects on this list 'should
be completed within'a reasonable period of time.

SITE:DE`SIGN COMMITTEE Adopt Ordinance.No. 1382 N.C.S. amending Zoning Ordinance
ORD. #1582 NCS No. 1072:N.C.S. by repealing Sections 26 -400 through
2.6 -4.09 and adopting new Sections 26 -400 through 26 -410
and making related definitional changes to Section
1 -203. This five - member committee would consist of a Councilman and a Planning
Commissioner for one -year terms.; two from the community at large; and one
member who is either a landscape architect, landscape designer or nurseryman,
the latter 3 members will serve for overlapping two- year'terms. The hearing
was opened._ There being no comment oral or written, the hearing was closed and
a vote was taken to adopt the ordinance.

SHELTER HILLS REZONING Adoption of Ordinance No. 1381 N.C.S.. amending Zoning
ORD. 441381 NCS Ordinance 1072 N.C.S. by reclassifying and rezoning the
property located off Ely Blvd. South., adjacent to
Shelter Hills Unit I,.(Assessor's Parcels No.'s 17- 060 -0.9 and portions of 17-
06.0-08 and 17- 060 -10) from Planned Community Development to Planned Unit
Development, Duffel Financial Company, Shelter Hills Subdivision Unit II. The
public hearing was opened. Planning Director F spoke to the Council and
answered questions. There being no testimony, oral or written, offered on the
rezoning, the hearing was closed and a vote was taken to adopt the ordinance.

TENTATIVE MAP map of Shelter Hills Subdivision Unit II. Introduced
RESO 48680 NCS by Councilman Perry, seconded by Councilman Balshaw.
Mr. Van Norden Logan of Duffel Financial Corp. requested
that Council require the.develop'ers of adjacent property to participate in the
cost of the school.s:ite which Duffel is setting aside for this area on a cost -
payback type of agreement..—Staff-advised Council this would be ready for
Council action on October 1.

SHELTER HILLS UNIT I -I Resolution No. 8681 N.C.S. authorizing grading of
ROUGH GRADING Shelter Hills Subdivision Unit II and authorizing Mayor
RESO 448681 NCS to sign agreement therefor. City Engineer Hargis
recommended against issuing grading permits prior to
approval of final plans. City Manager urged Council

SIGN ORDINANCE 'Mayor Mattei noted receipt of a September 7 letter from
the Chamber of Commerce requesting that representatives
of the Chamber be appointed-to the committee to work with staff on the Sign
Ordinance. Mayor advised, having met with the Chamber President and reaching
agreement with him, that the staff will continue the sign survey of the business
district, and notices will be sent out advising property owners of signs that �n�.'
are not in compliance with the current regulations. However, enforcement�� 9 ft
____will be delayed until staff has.an opportunity to study all
signs not in compliance, the.three person committee to be appointed by the
Mayor has worked with staff on this, and Council has an opportunity to see the
situation as it exists when the study , is through.
VARIANCE FEE Staff was directed-to prepare a resolution eliminating
fees for variance applications for signs for a 60 -day
period for Council consideration on Wednesday, September 19.
TRAFFIC COMMITTEE City Engineer, Hargis, indicated there are several
items relating to parking downtown that the Traffic
Committee has requested be referred to the Downtown Parking Committee for their
consideration and recommendation to the City Council.
WARM SPRINGS DAM Resolution No. 8682 N.C.S. expressing the City of
RESO 48682 NCS Petaluma's.support for continued construction of the
Warm.Springs Dam project. Introduced.by Councilman
Battaglia, seconded by Councilman Cavanagh. There was discussion relating to
the advisability of urging- the citizens to vote one way or the other on the
ballot measure. p

REFUSE RATE INCREASE Resolution No. 8683 N.C•.S: establishing the rates and
RESO 4686`83. NCS charges -for -the collection of garbage and rubbish in
the City of Petaluma, in accordance with the provisions
of Chapter 8.16 of the Municipal Code and 'repealing Resolution No. 7411 N.C.S.
Introduced by Councilman Cavanagh, seconded by Vice-Mayor Bond. Councilman
Cavanagh noted this is approximately a 19% increase over our current: rates (25%
rate increase was requested). Mr. Tom',Wal'ters from Petaluma Refuse Company
spoke to the Council regarding the rate request. Vote:
