APPROVAL OF MINUTES
CITY MANAGER'S REPORTS:
An Adjourned 'Mee'ting of the Petaluma City Council was
called to order by Mayor Helen Putnam at the hour of
7:30 p.m.
Present: Councilmen B'alshaw, Bond, Cavanagh., Harberson,
Hilligoss, Vice -Mayor Perry *, and Mayor Putnam.
Absent: None.
*Vice - Mayor Perry arrived at 7:38 p.m.
The minutes of June 20, 1977, were approved as mailed.
AMEND WATER ORDINANCE City Manager Robert Meyer explained the ordinance was F o
TO PROVIDE "ODD /EVEN' to clarify the od'd /even watering privilege extended to
IRRIGATION AND GIVE the community. The ordinance would now be similar to
DIRECTOR AUTHORITY TO the one adopted by the City during the last summer
GRANT VARIANCES season. Hand watering and watering by irrigation,
ORD 41258 AS i.e., sprinkler systems, would be permitted on odd
(EMERGENCY ORDINANCE) number days; east of Highway 101, and on even numbered
days west of said Highway and not confined to the hours
of 6:00 to. 8:00 p.m.. The ordinance also would give the Director of Water
Utility Operations'-the authority to grant variances for.commercial and indus-
trial use of water. If the Director denied an, application, the applicant could
appeal to the City Council.
Ordinance #1258 N.C.S.-amending Subsection 5 of Section 15..18.050 of the
'Petaluma Municipal Code to provide for irrigation on odd numbered days east of
Highway 101, and on even numbered days west of said Highway,, and amending
Subsection 3 of Section-15.18.100 to give the Director the power to grant
variances, was introduced by Vice -Mayor Perry, seconded' by Councilman Hilligoss,
and adopted by 7 aff rmative,vo.tes. Effective date of ordinance, July 25,
197-7,
EXECUTIVE SESSION The Council, and some staff members, John Scharer, Frank
Gray, David.Breninger, and Larry Klose, adjourned to an
Executive Session in the Conference Room of City Hall
at 7 :32 p.m. The Council reconvened at 8:45 p.m.
PEDESTRIAN WALKWAY Community Development and Services Coordinator Frank
BETWEEN 1097 AND 1099 Gray reminded the Council the pedestrian walkway be-
CRINELLA DRIVE tween these two residences had been abandoned approxi-
mately six months.a_go. At the time of the abandonment,
the staff was not aware there was an eight inch water main in the walkway.and
since the abandonment, an electrical service had been installed to service the
ball diamond at Casa Grande High School. The recommendation from the staff was
that the City not 'sell the.l.and, but grant an encroachment on the property to
one of the owners. This would give the property owner use of the land, but
title would remain with the City. The property owner, would not be able to
build any structures on this 10 -foot portion-. Mr. Gray indicated he was not
certain which of the property owners would receive the easement and indicated
the residents would work the problem out themselves. City Attorney Larry Klose
advised the transaction would be 'recorded with the County Recorder, thus_assur-
ing the City access for service to the utilities in the easement.

Resolution X6`7845 N.C.S. of the City of Petaluma authorizing.execution of amend-
ment toWater Well Agreement ( Miwok Manor Subdivision) to permit the- construct -ion
of 'model homes, was introduced by Councilman Cavanagh, seconded by Councilman
Hilligos.s, and adopted by 7 affirmative votes.
WESTERN AVENUE Community Development and Services Coordinator Frank
HILLSIDE STUDY _ -AREA Gray stated, in response to the Council's request for a
suggested area to be stud -ied in the vicinity of Western
Avenue, the City had requested and been,f urnished. data from the computer base
system. Several computer- ,generated graphs were _displayed for the Council'a
benefit: Mr. Gray outlined the drainage basin, the land uses, the types of
soil, the topography and also depicted the,area within the City's wager service
area:and the area outside the water service area.as stipulated by Council
policy.
The area recommended for study is approximately 125 acres, belonging.to between
30 and 40 property owners. This refers only to the vacant or sparsely popu
lated areas,. Mr. Gray explained, however-, if the properties on the fringe were
included, several hundred owners would be involved. Mr. Gray stated the area
shoian. was felt, by the staff, to be a logical study area. He asked , for drec-
tion from the Council whether or not they would prefer to , use this area for the
study.
Councilman Balshaw asked what the procedure would be with regard to the study
and stated he felt the landowner's should be' involved. If ,some .compromise or
agreement can be reached, then he would be in favor of proceeding; however, he
did not want the City to have to go through the same procedures as had been
done previously with Bodega Avenue. Mr. Gray indicated if this is the direc-
tion from the Council; the, staff would bring 'back specific boundaries of the
area and an ordinance would be prepared to designate the area as a, study area,,
citizens" meetings would be set up, and the Planning staff would take the
proposal to the Planning Commission. It would then be referred to the City
Council.
When asked by Councilman Balshaw if`tle Planning staff-could handle this.type
program, Mr.. Gray indicated it was not in the Program of 'Service. He has :not
had an opportunity to discus's the matter, with the Planning Director Ronald.
Hall, as he has been on vacation, and was not. certain if scheduling could be
arranged.. No action 'was, taken on 4the matter.
ESTABLI ZONES -.- Discussion of: the fire zone's had been-held at the
CHAPTER 7.22, PETALUMA Special Meeting July 18 ; , 1,977. The ordinance had been

The Council reviewed the proposed Interim.Residential
Development Control System, which is an extension of
the' system used' for the last construction year. Sev-
eral recommendations for changes were - made by Council-
man Balslaw,, however; it was felt if major. :changes were
to be made, the. k
City should ;see.the advice: and guidance
as they had done "for the Environmental Design Plan in
the City's position. Changes made to the proposed
Section VII, Award of Allotments, that.a minimum of 100

Commission this ,year. as had been done the previous year
under the Interim System, of if a citizens;' committee should be appointed.
Councilman Bond indicated., although he felt the Planning Commission did,a good
job the previous year, if the City can involve citizens without an unnecessary
delay, this.would be the preferable way to go.
Community Development and S.ergices Coordinator Frank Gray stated, in order to
provide some continuity on the citizens' committee, the new Environmental
Design Plan should make provisions for appointments to the committee,to be for
two -year overlapping terms'. It•was the consensus of the Council to Have the
citizens' committee review the development`s and award the allotments during the
interim period, thus relieving the Planning Commission of this function. The
structure of the citizens' committee is to be defined at a later date.
Community Development and Services Coordinator- Frank Gray pointed out the fact '.
the citizens' committee would.n'ow be awarding the points, not the Council, as
had been previously done. If there is an appeal by a developer or•builder, the
appeal would come dire'c'tly to the City Council.

All'the recommendations by the Council were incorporated in the Interim Resi-
dential Development Control System for the City of :Petaluma as revised July,
1977, and Resolution #7846 N.G.S., adopting the Interim Residential Development
Control System was introduced by Councilman Balshaw, seconded by Vice -Mayor
Perry, and adopted by '7 affirmative.votes.

Councilman Hilligoss> asked that the 108 units

and not be deducted from

The Council also agreed the final date to apply for 'development allotments for
the.1978 -79 building year would be August 31, 1977, until 5-:00 p.m

Numerical Limits for the 1978 -7'9' construction year, and establishing final date
to apply for residential allotments -- Interim Resd"enti•a1 Development Control
Syst=em, was introduced by Councilman Bond„ seconded by Councilman Balshaw, and
adopted by 7 affirmative votes.

Before adjourning the meeting, Mayor Putnam indicated
if'there were other matters to, be .brought before the

A member of the audience addressed the Council stating he knew ;they were in.a
hurry to adjourn, but he had a question to"ask. Mayor Putnam rescinded the
adjournmemt of the:meeting and allowed the citizen to speak.
The citizen did' not identify himself, and stated he.had filed a claim with the
City Clerk.on Friday, July 22, and questioned why the matter was not on the
Agenda for the meeting,. City Manager Robert. Meyer advised in order for items
to appear:on the Agenda, they :must received by the City Clerk by 4:00 p.m.
on Wednesdays prior to a Council Meeting,
Mayor Putnam also advised a copy of the claim filed with the City had been
presented -to all members; of the Council this evening. The Council packets had
been delivered t.o the members of the Council on Thursday, July 21, 1977. The
claim had been copied and given to the Council evening, but not as an
agenda item.
City .Attorney Larry Rlose stated another point for the Council's :consideration
was the Council has 4.5 days within which to approve or deny any claim against
the City and the may not come up until that time has expired..
ADJOURNMENT There being no further business to come before the
Council, the meeting was adjourned at 10 p..m.
