APPROVAL OF MINUTES
CITY MANAGER'S REPORTS:
An Adjourned Meeting of the Petaluma.City Council was
called to order. by Mayor Helen Putnam at 5:00 p.m.
Present: Councilmen Cavanagh, Harberson, Hilligoss,
Perry, and Mayor Putnam,
Absent: Councilmen Balshaw and Bond.
The minutes of the Regular Meeting of January 16, 1978,
were approved as corrected.
ENVIRONMENTAL City Manager Robert Meyer advised the matter has been
MANAGEMENT PLAN -- before the Council on various occasions. A draft of U
SURFACE RUNOFF the Surface Runoff Management Plan was reviewed by the
Council early in the year and again in October of 1977.
A series of hearings have been scheduled by the Association of Bay Area Govern-
ments, and the Environmental Management Task Force is expected to adopt the
final Environmental Management Plan recommendation on February 22. On March
16, the Executive Board will recommend the Plan and proposed amendments to the
General Assembly, and the General Assembly will be held on April 6.
Mr. Meyer then referred to the Surface Runoff Management Plan and pointed out
there are a number of things required to be done by the City between 1978 and
1980. In reviewing the Environmental Management Plan,. Mr. Meyer stated other
communities do not have this schedule for implementation; in some cases,
implementation is not until 1980 or 1981. Mr. Meyer indicated the Council
should give serious consideration to the time schedule set up for the City of
Petaluma and review what is required to be started in the next three years.
The Sonoma County Water Agency has submitted a $36,150 Budget to the Board of
Supervisors. The County has yet to determine who is going to be the lead
agency for the. Surface.Runoff Management Plan.
Mr. Meyer stated, as the program is now written, it will be very costly and
felt the cost factor should be discussed by the Council at this meeting so the
City's recommendations can be taken back to the Association of Bay Area Govern-
ments.
Councilman Hilligoss stated it was her understanding the Sonoma County Water
Agency was to be the lead agency. Mr. Gray stated a letter he had received
from the.Agency indicated they could not legally act in this capacity.
City Manager Robert Meyer stated the purpose of the hearings scheduled by ABAG
is to receive input from the legislative bodies. He expressed concern, if the
various agencies in the Bay Area did not oppose or approve portions of the
plan, it would be adopted as presented.
Councilman Hilligoss questioned the feasibility of creating the quality com-
mittee as she felt many of the items suggested are already being handled by
various other agencies. Community Development and Services Coordinator Frank
Gray stated he felt the planning is being done on a crisis basis as the Federal
government is giving agencies an opportunity to do the planning, but if it is
not done, they will "come in and do it for them. Mr. Gray also stated the
County is the only logical legislative body to be called the lead agency.
City Manager Robert Meyer reviewed the excerpts he had given to the Council of
Volume II of the Environmental Management Plan, Pages II -37 through II -42. In
each instance, where the City of Petaluma and the City of Sonoma were mentioned,
either additional manpower or additional funding would be required to comply
with the requirements between 1978 to 1980. ' It was pointed out the greatest

were unreasonable and send their comments back to
ABAG. The staff has no authority to do this and Councilman Cavanagh indicated
it is up to the Council to give some direction to ABAG as it is not a staff
matter.
Mayor Putnam selected a Committee to be chaired by Councilman Harberson and
the members to be Councilman Cavanagh and Hilligoss;, to review the Surface
Management Runoff Plan. No action was taken on the matter.
DISCUSSION REGARDING City Manager Robert Meyer advised the ordinance is

V \ AND WATERWAYS _ORD. comments and recommendation before it is brought back
in a final form for introduction. He stated Mr. Gray,
has been working on the ordinance for some time and will -:meet with various
organizations, including the new formed Petaluma Yacht Club and other persons
in the vicinity of the river who might be interested.
City Attorney Klose referred to his memo dated February 9,,1978, regard-
ing the subject, a copy of 'which is on file with the City Clerk. Basically,
the ordinance would require a permit for a vessel to be moored for more than
72 hours anywhere along the river banks, inlets or turning basin inside the
City limits. The problem has been the situation where there are rows of long-
term boats moored in the basin or in the river with people living aboard,
dumping raw sewage into the river, which is one of the sources of pollution.
Mr. Klose indicated he was concerned regarding liability problems where there
may be overloading of docks or possible damage by storms. Any vessel coming
up the river for a visit and staying for less than 72 hours would not require
a permit. The proposed ordinance would give the City authority to control the
use of the river for house boating.or persons living aboard other vessels
Long -term permits could only be,granted if pump -out facilities were available.
Mr. Klose did not foresee such facilities being placed in the area in the
immediate future and the closest pump -out facilities are in Marin County.
Councilman Hilligoss pointed out there are some vessels which have self-
contained units that may not need to be pumped out for about two .weeks. Mr.
Klose pointed out the ordinance doesn't provide for a stay longer than 72
hours. He did state, however, a clause could be included which would permit
vessels with ample capacity to obtain permits if shoreside facilities are
provided or for the length of the holding capacity of the vessel.
Mayor Putnam asked who would determine what the size of the holding tanks were
on the vessels, and Mr. Klose indicated it probably would have to be the
Public Works Superintendent when he inspected before the permit was issued —
Mr. Klose did state, however, he felt there was a basic policy that needed to
be established by the Council to determine whether or not they wanted "live -
aboards "mooring the river.
Frank Gray indicated most of the problems the Council is discussing do not
come from the pleasure craft visitng.Petaluma for a short period of time.
The problem arises with the long-term mooring of commercial fishing vessels.
These boats do not have holding tanks.
Mayor Putnam asked if the ordinance would be discussed with other groups.
Frank Gray indicated he would hold:meetings Vith the Chamber of Commerce, the
Petaluma Yacht.Club, the fishermen, and with major upland property owners
along Petaluma River.
Mr. Bob McLaughlin was in the audience, and asked if, as a member of the
Petaluma Yacht Club and the Harbor Advisory Committee, he could speak to the
Council on some matters. Mr. Gray indicated he would be meeting with "the
Petaluma Yacht Club and bring all of their comments back to the Council.
Mayor Putnam invited Mr. McLaughlin to speak to the Council..

Mr. McLaughlin stated the Petaluma Yacht Club has passed a resolution favoring
the proposed mooring ordinance.

DISCUSSION REGARDING Councilman Cavanagh questioned the nature of the

Mr. McLaughlin also stated the advisory committee
would probably turn out to be the'Petaluma Yacht Club.
Mr. McLaughlin stated he would like t.o believe the Petaluma Advisory Committee
for the Harbor would be similar to the Golf Club Committee. He'stated at the
CMPH Meeting last August, Mr. Jim Matsueda of the Department of Navigation and
Ocean Development suggested that if a person was not going to be appointed for
the harbor development, perhaps a Citizens' Advisory Commission could be
formed. Mr. McLaughlin felt this Commission should be very closely related to
City Hall, which has the entire responsibility for the harbor program.
Mr. McLaughlin also stated Dick Gray is a member of the Petaluma Yacht Club
but is also a boating inspector in Marin County. Mr. Gray advised Petaluma is
frequently mentioned by house boaters who are looking for mooring places and
urged the City to move forward on the proposed ordinance. Mr. McLaughlin also
mentioned there is a who spends approximately six months of the year
in Petaluma, he is quite elderly and has no other home other than his boat,
and questioned whether some exception could be made for him. Mayor Putnam
stated there are many difficult and complex problems which will have to be
resolved.
Mr. McLaughlin also spoke about the visiting yacht clubs' tours to Petaluma.
Their visits are usually over a weekend and last no more than 72 hours. He
has worked in past years as liaison with the yacht clubs, trying to arrange
their trips so that no more boats come to Petaluma than can be safely moored
in the turning basin. He indicated they are trying very hard to turn this
entire operation over to the Chamber of Commerce.
Community Development and Services Coordinator Frank Gray indicated this
problem has been discussed before. The City's floats are not reserved but are
there for the convenience of all clubs coming to Petaluma and are open to the
general public on a first come, first served basis.
The Council took no action on the matter, and Mayor Putnam asked that the
meeting with interested persons be held and the input brought back to the City
Council.
REVIEW OF DRAFT ORD. City Attorney Larry Klose advised he had drafted an
RE DEDICATION OF ordinance, based on the Council's direction given pre -
RIGHTS -OF -WAY AT viously, to provide for dedication of necessary street
SITE DESIGN REVIEW right -of -way as a condition of site design review.
The ordinance relates only to those projects which
would be subject to site design review and are involved in a parcel map or
subdivision map. If the Council wishes to include projects which are not
subject to site design review, such as single - family residences on existing
lots, the ordinance would have to be changed to include this provision.
There was a brief discussion by the Council, primarily on the amount of land
Which may be required for dedication. 'Councilman Hilligoss suggested in some
instances, the dedication of the right -of -way for a half - street would preclude
development of the parcel.
City Manager Robert Meyer asked the Council if they were interested in having
the staff continue to develop the ordinance and work on it. Mayor Putnam felt
it should be studied and brought back when all of the Council members could be
present for the review.
City Attorney Larry Klose stated, basically, what the ordinance would do is to
extend the present development policy to a lower level. It is a policy ques-
tion for the Council to decide, and if it looks promising to the Council, the
staff would continue to work on it.
Mr. McLaughlin
then mentioned the

will hold a meeting and
expect to
receive input regarding
the proposed small
craft harbor. The meet-
ing is to
be held March 7, 1978.
Mr. Gray indicated
the staff has been work-
ing very
closely with the Corps of
Engineers and the

available
very shortly and he will
be bringing it to
the Council.

REVIEW OF DRAFT ORD. City Manager Robert Meyer noted the ordinance gives

SITE DESIGN REVIEW there would be any rght,of. appeal. Mr. Klose stated

other zoning requirement has.
There was a consensus of. the Council, with Councilman Cavanagh dissenting to
have the ordinance defined and brought back for Council's review. No action
was taken.
City Attorney Larry Klose invited comments from members of the Council or
staff for any revisions or amendments to the document.

Development Department. The comparison includes
comments from the Planning Commission; the - Citizens' Committee, the document,

National League of Cities Conference will be in
Washington, D. C., on March 5 - 7, the City has budgeted
for two representatives to attend the conference. He`
asked ;if any Council member plans to attend to p -lease
advise his of=fice.
Ordinance #1277 N.C.S. adding Section 11.36.'050 to the
Petaluma Municipal Code, prohibiting pedestrian use of
certain drainage facilities, was , dopted by •5 affirmative
and 2 absentee votes: Effective - date of the ordinance
is March 16, 1978.
TAX RE-FORM MEASURES City Manager Robert Meyer advised the Council he would
keep them informed on the - differences between the
Jarvis Initiative and the bill introduced by Senator Peter Behr for tax
reform. Mayor Putnam stated -she advised Senator Behr that the Finance Direc-
tor', John Scharer, had done some work on how the Jarvis Amendment might affect
our City. Senator 'Behr. indicated he would like-to have something submitted to
him in writing. There will be a series of debates between Mr. Jarvis and
Senator Behr. Mayor Putnam stated Senator Behr is anxio to work with the
communities and learn their problems.
