Councilman Cavanagh, Jr. CONSENT CA Agenda Items #3 and #4 were removed for consider - ation after the Consent Calendar; whereupon, a motion was made by Councilman Mattei and seconded by Councilman Daly approving Agenda Items #1, #2, and #5 of the Consent Calendar. Motion carried unanimously. Agenda Ite #1 Amend Job Descriptions Res #6512 NCS 31'r F Resolution #6512 N.C.S. adopted amending Resolutiorr --- #6118 N.C.S. to amend the job descriptions of the Director of Community ; levelopment and the Dirjec:tor of Public Works. Agenda I tem #2 esclution #6513 N.C.S. adopted supporting the ( "Xq - r Oppose Parking enactment of Federal legislation which will nullify Surcharge the parking surcharge, management of parking supply Res #6513 NCS and the preferential bus /carpool lanes provisions of the California Transportation Control Plan promulgated by the Federal Environmental Protection Agency'on November 12, 1973, and postpone further such regulations until Congress reviews and approves a study including the economic impact of such regulations and alternative methods of vehicle mile reduction. Agenda Item #5 Ordinance #1124 N.C.S. amending the Petaluma Muni - Sleeping In cipal Code by adding to Title 10, Section 10.24.061 Vehicles (Public and Places of-Business--Sleeping In Vehicles Prohibited "Prohibited), was ordered published. Ord #-1124 NCS Warm Springs Councilman Harberson raised a number of questions_9oyl Dam Project and points regarding the Warm Springs Dam Project; Res #6514 NCS although not opposed to the project, he urged more caution. His questions were based on the seismic safety of the project, costs involved for the tax- payers of Sonoma County, and the fact that the Dam would induce growth in the community. He felt that many facts have not been brought out on the matter and that the project should be delayed until com- pletion of the Russian River study. Mayor Putnam concurred with Councilman Harberson on the seismic safety issue and felt that this point is very critical. Mr: Ernest Curtis of the Irate Taxpayers' Associ- ation of Sonoma County addressed the Council in support of the Warm Springs Dam. mad, January 28, 1974 Warm Springs In discussing the proposed resolution, an Dam Project addition was suggested and with the consent Res #6514 NCS of the introducing and seconding Councilmen, (continued) the following paragraph was added: "Whereas, the project will provide flood relief for people and property along the Russian River area." Resolution #6514 N.C.S. supporting the Warm Springs Dam Project was introduced by Council - man Brunner, seconded by'Councilman Daly, and adopted by the following vote: Ayes: Councilmen Brunner, Daly, Mattei, and - Perry, Jr. Noes: Councilman Harberson and Mayor Putnam. Absent: Councilman Cavanagh, Jr. 3 , AB 2778 Res #6515 NCS I�zV North Marin - South Sonoma Subregional Water Quality Management Program Assemblyman Keene s Bill #2778 proposing to void Sonoma County Water Agency's authorization as it relates to construction of the Russian River to Cotati Intertie Pipeline 'Project was discussed. Councilman Harberson stated that he did not object to the resolution if it were amended to include that if the State legislation is .introduced, it not take effect until after the Cotati Intertie is constructed; and after that time,, the matter of revenue bonds be submitted to the vote of the people. He felt that the people have a right to vote on revenue bond issues. It was noted that the North Marin County Water District and the Valley of the Moon County Water District opposed the proposed Bill. Copies of their letters submitted and filed. Following considerable discussion on the ramifications of the Bill, Resolution #6515 N.C.S. opposing proposed-AB 4277`8 was int -ro- duced by Councilman Brunner, seconded by Councilman Daly, and adopted by 5 aff "i "rmative, 1 negative, and 1 absentee Councilman Harberson voted "No." City Manager Robert Meyer reported that Bartle -Wells Consultants completed the financial and administrative draft report review for the North. Marin- -South Sonoma Subregional Water.Quality Management Program, copies of which we're distributed to the Council for review. A motion was made by Councilman Matted and seconded by Councilman Perry, Jr., accepting the report which carries..out Bartle - Wells' assignment. Motion carried unanimously. BASSA Report regarding BASSA was not considered due to Councilman Cavanagh's absence. Matter to be rescheduled for a later agenda. Mr. Don Head, Sonoma County Director of Public Works, commented that the Board of Supervisors today authorized the County Counsel to investigate the matter of non- payment by the County of BASSA' assessment. 87 January 28, 1974 ` Penngrove Sewer Mr. Don Head, Director of Public Works of Sonoma County, accompanied by Hal Wood, Civil Engineer I III, appeared before the Council to discuss details of a letter dated October 18, 1973, addressed to Director of Public Works David A. Young regarding a feasibility study to construct a sanitary collection system and interceptor for Penngrove. Mr. Head reviewed two alternate proposals which the Board of Supervisors has prescribed per recommendations contained in the "Penngrove Land Use Study ": (1) A system designed to handle a service population of 3,000 within 350 acres in the center of Penngrove. (2) A system designed to serve an additional area located northerly of Penngrove for a total ultimate population of 15,000. Both alternates would involve transporting the sewage in a line from Penngrove to the City's trunk sewer at Corona Road and McDowell Boulevard. Mr. Head notified the Council that on December 27, 1973, the Regional Water Quality Control Board adopted Resolution #73- 19 waste discharges to leaching or percolation systems in the Penngrove area and that a sewer project would be eligible for a Class'B priority rating for Federal grant funds. Mr. Head added that a third alternate to study would be to build a small sewage treatment plant to serve the Penngrove area. :He stated that the Board has asked for a study of the area and that the County Department of Public Works would like to proceed and work closely with the City of Petaluma on the matter. Director of Public Works David Young recommended the following points be considered if the City accepts a program for Penngrove: (1) Each Penngrove residence connected would be charged the required $600 connection fee, the same as a Petaluma residence. (2) All costs for the line to the Corona trunk sewer be borne by the Penngrove area. (3) A contract with the County -be.considered requiring a trunk line to be constructed in the future parallelling the City's line from the Corona trunk sewer to the City's Madison Street trunk.line.when the capacity of the City's Assessment District #6 trunk sewer is needed to serve the Assessment Districts #6 and #9 areas; i.e., the trunk sewer actually in principle belongs to the assessed parcels and the City has an obligation to guarantee sewer service to Assessment Districts #6 and #9 areas. (4) The current sewer service charge applied to properties outside the City limits; i.e., City's tax rate - levied against assessed valuation of outside property.. Director of Community Development Frank Gray recommended that any commitments by the City on a sewer plan for Penngrove be correlated with.a County planning program for the area. j 1� r January 28, 1974 Penngrove Sewer In light of-the Court's decision on the "500 (continued) growth limitation, " City Attorney Robert urged that proceed with caution -on a decisIon•of the matter because of the fact.•that the 'City .based part of its testimony :on .!the inadequacy . of the capacity of the City's sewage. plant. Re1'a.tiwe to a question concerning City sewer services - for other-.unincorporated areas, it was noted that there was interest in the Straubville area to the west of the City several years-ago for sewer service. . was pointed out to Mr. Head that the projected sewer population for the City of Petaluma,in. the North Mari-n -South Sonoma Subregi_onal Water`Quality Management Program is 77 and.8.0,0'00.for the entire Petaluma Valley. On this basis, Mr. Head proposed that a study be made to include only a portion of-the 350 acres in the center of Penngrove and °`work with the:C.ity Engineer and City Planner on .a plan for presentation to the Council. The Council agreed that Mr. Head proceed on a minimal alternate with the City staff, but with-no guarantee of acceptance because of the City' position relative to the Court's ruling. Sonoma County "City- '.Mr.•Schuyler. Jeffries, Chairman, Sonoma County" Planning County-Local Agency Formation Commission, Policy Committee addressed the Council regarding a proposal for -a Sonoma "City- County" Planning Policy.•Committee. Copy of proposal submitted and filed... He briefly summarized the Committee organization-and objectives and asked for Council approval of the concept. He added that the concept has been endorsed:by three of the eight cities in Sonoma County and is an-agenda item for four more cities besides Petaluma. A motion was.made by Councilman Mattei and seconded by Councilman Harberson endorsing the concept of the Sonoma County, "City - County Planning- Policy Committee. Motion carried unanimously. 333 Sonoma County Report -dated January 25, 1974, from Director Interim General Plan of. Community Development Frank Gray on repre- sentative input into the, County's. General Plan Program, submitted and filed. Mr. Gray pointed out comments in his memo to the Council dated December 17, 1973, that the County's Interim.Plan includes the General _. Plan =and for the Petaluma, planning area as adopted by the-Board of Supervisors in September of 1962; . and that it appears the County's plan does not respect the revisions which have taken place since 1962 or reflect the City's Environmental Design Plan. He, recommended January 28, 1974 Sonoma County that the City transmit to the County a current Interim General•_ -Plan copy of its General Plan and associated (continued) elements and 'a copy of the Environmental Design Plan (with deletions referring to numerical growth control) and request that the County adopt these as a guiding criteria -for the Interim General Plan and subsequent development review within the City's planning area. The Council agreed that the City Manager and Mr. Gray send a letter to the County as recommended in the December 17th memo. As stated in the January 25th memo, Mr. Gray expressed concerns regarding the County's request for citizen input into their General Plan Program. It was his opinion that exten- sive citizen input has already been provided in the planning of the Petaluma environs through the citizens' participation in both the City's General Plan.and in Environmental Design Plans process. In line with his recommendation, the City Attorney was directed to prepare a resolution for Council considera- tion expressing these concerns. ME McDowell Boulevard Director of Public Works David Young presented South Improvements a drawing of the proposed McDowell Boulevard South improvements and explained the necessary rights -of -way to be acquired for the project. A motion was made by Councilman Perry, Jr., and seconded by Councilman Harberson author- izing the staff to proceed with McDowell Boulevard South improvements rights -of -way acquisition. Motion carried unanimously. AB 882 Following a brief explanation by Mayor Putnam 5 07 ' Res #6516 NCS of Assemblyman Knox's Bill proposing to mandate in certain instances special district representation on LAFCO's in lieu of permissive representation now in existence, Resolution #6516 N.C.S. opposing Assembly Bill #882 was introduced by Councilman Harberson, seconded by Councilman Daly, and adopted by 6 affirma- tive votes, 1 absentee. The City Clerk was directed to telephone Assemblyman Keene Tuesday morning of the Council's action on AB 882. Municipal Swim Report dated January 25, 1974, fromRecreation�� Center Director James Raymond to City Mana Robert° Meyer on the conservation of energy at the Municipal Swim Center, submitted and filed. A motion was made by Councilman Harberson and seconded by Councilman Brunner approving the recommendations listed on page #4 of Mr. Raymond's January 25th memo. Motion carried unanimously. Chlorine Tank City Manager Robert Meyer informed the Council Hoist -- Wastewater that there are problems with the chlorine Treatment Plant tank hoist at the wastewater treatment plant and it will cost approximately $2,000 to replace the equipment (from reserve funds).
