HomeMy WebLinkAboutMinutes 04/01/1974137 MINUTES'OF MEETING OF CITY COUNCIL PETALUMA, CALIFORNIA April 1, 1974 Council Meeting Regular meeting of the City Council of the City of'Petaluma was called to order by Mayor Putnam at the hour of 7:35 o'clock p.m. Attendance Present: Councilmen Brunner, Cavanagh, Jr., Daly, Harberson, Mattei, *Perry, Jr., and Mayor Putnam. Absent: None. Invocation Approval of Minutes CONSENT CALENDAR *Councilman Perry, Jr., arrived at 8:04 o'clock p.m. The invocation was given by the Reverend Roland Bond, Christian Church. The minutes of March 18, 1974, and March 25, 1974, were approved as recorded. At the request of Councilman Mattei, Agenda Item #2 calling for bids on warning signs, regulatory signs, and other related equipment was removed from the Consent Calendar. A motion was made by Councilman Harberson and seconded by•Councilman Daly adopting the Consent Calendar, Agenda Items #1, #3, and #4. Motion carried unanimously. Agenda Item #1 Resolution #6571 N:C.S. adopted declaring Weed Abatement that the weeds growing and the rubbish, Res #6571 NCS refuse,. and dirt existing upon the streets, parkways, sidewalks; and parcels of private property referred to and described in the resolution constitute and are a public nuisance (public hearing date April 15, 1974) . Agenda Item #3 Ordinance #11.31 N.C.S. authorizing the Purchase of Land purchase 12,306 square feet of land at a (Little Property) price of $2,830.38 was adopted. (Little Ord #1131-NCS property for Caulfield Lane Extension.) (Second Reading) �v Agenda Item #4 Board of Directors-of Sonoma County Water Sonoma County Agency Resolution #DR43929 agreeing to Ordinance #1108 administer Sonoma County Ordinance #1108 (regulating drainage in the cities of Cotati and Petaluma, submitted and filed. Warning, Regulatory Specifications for the sale to the City of Signs, etc. warning signs,-regulatory signs, and other Res #6572 NCS related equipment, submitted and filed. Director of Public Works David Young explained that an amount of $15,0.00 was appropriated under Federal Revenue Sharing funds in the Capital Outlay Projects Program for 1973 -74 (RS 5 -73). After some discussion, it was decided to wait until after the )bids are received to consider whether or not it would be more-economical-for the City to make its own street name signs. ,� 1 � April 1, 1974 Warning, Regulatory Resolution #6572 N.C.S. approving specifications Signs, Etc. and calling for bids for street warning and Res #.65`72 NCS regulatory signs and other related equipment (continued) was introduced by Councilman Cavanagh, Jr., seconded.by Councilman'Mattei, and adopted by 6 affirmative votes, 1 absentee. KTOB Proposal -- Letter dated March 25, 1974, from Bob Air Council Lipman, President, Radio Station KTOB, re Meetings proposal to broadcast Council meetings was held over for the April 15, 1974, Council meeting. Sidewalks -- Cherry Letter dated'March 25, 1974, from.Fred and Valley Area Deborah Schram, 515 Walnut Street,. asking that sidewalks be provided in the Cherry Valley area so that the children will have a safe route to walk to school and urged that the "Safest Route to School Study" be hastened to a successful conclusion, read and filed. It was noted that when reviewing-the "Safest Route to School" study at a recent Council study.session, an alternative was recommended to form an assessment district in the area for sidewalks. The staff was directed' to prepare cost estimates on sidewalks for an assessment district in the Cherry Valley area for a report to the Council thereon. The City Clerk was directed to notify'Mr. and Mrs. Schram of the Council's action.. Bicentennial Letter dated March 27, 1974, from Kenneth Committee J. Colin, Chairman., Petaluma Bicentennial Steering Committee., requesting that the City Council consider converting the old library building into a library- museum complex held over for the Apr.il.15th Council meeting as,Mr. Colin was unable to attend the meeting tonight. The City Clerk was directed to so notify Mr. Colin. MTC-- Regional Memorandum dated March 13, 1974, from the Transportation Plan Metropol -itan Transportation Commission requesting comments on the Regional Trans -. portation Plan or on proposed amendments to-. the Plan be submitted any time before or during the amendment process; and further stating, that the planned amendment proposals will be discussed and considered concurrently with the draft EIR for the Plan at regular MTC meetings on May 8th and 22nd and June 12th and 26th. and at public meetings held in various Bay Area locations in May, submitted and filed. Director of Public Works David Young informed the Council that'he had no recommendations at this time; however,,he was asked to report the Council if there are.any recommendations or suggestions after reviewing the subject matter. t April 1, 1974 Zone 2A Advisory Councilman Brunner questioned the "I" Committee Street-Project recommended as Priority #5. (continued) He felt that the project should be given a higher priority because the Council indicated to the opposition at the time public hearings were he_ ld for the Condiotti rezoning ( "I" Street and Sunny Street and Sunny Slope Road area) that every effort would be made to get a high priority for a drainage project in the area. Because of the concerns expressed by the Council relative to the "I" Street Project, Councilman Cavanagh, Jr., was asked to discuss with the Zone 2A Advisory Committee the.Council's desire of advancing the project to a higher priority (possibly Priority #2), but at the same time indicate the Council's recognition that the Washington Creek Project is critical. He was requested to report back to the Council thereon. Taxicab Committee Councilman Cavanagh, Jr., reported that the Council Taxicab Committee has received no further word from Mr. Myrel Moss regarding his proposal for a rate increase. Councilman Cavanagh, Jr., added that the intra -city transportation study being prepared by Kaiser and Associates will be received by the City within the next ten days. Street Trees Opinion dated March 28, 1974, from City Attorney Robert on "Street Trees," submitted and filed. Mr. Robert stated that the care, control, and maintenance of street trees are the responsibility of the City and the cost of such must be borne by the City. A street tree which creates a.hazard of any kind may impose a liability upon the City and the same sort of liability may arise when a street tree has damaged,a sidewalk so as to cause a tripping hazard; and, in such instances, it would be the responsibility of the City to correct the situation and replace the sidewalk, if necessary. He recommended that the Petaluma Municipal Code be revised to provide for more precise regulations of street trees as detailed in Item #1 and #2 of his report. He also recommended that the Parks and Recreation Commission revise the- existing approved tree list and street tree planting standards and ,further establish a,list of trees which are proposed to be planted within five to ten feet of the public right -of -way. A brief discussion followed in which City Manager Robert Meyer referred to a sidewalk repair ordinance adopted by the City of Stockton. April 1, 1974 Street Trees The City Attorney was directed to prepare (continued) an ordinance on street trees incorporating- Items #1`and #2 and the City's responsibility n thereon for Council consideration. j� Federal Aid Copy of letter dated March 22, 1.9:74,, from Urban Funds Director of .Public ••Wor -ks of Sonoma County Donald-Head,-stating that the.next•meeting to consider the , Federal , -Aid Urban Program is 1:.30•g..m:; April- 2, 1974, and enclosed with the letter was a draft resolution establishing procedure for determining Federal aid for-urban-systems projects," submitted and filed.. Director of Public Works David Young explained the Federal Aid Urban. Program. The State of-California passed- legislation by which Federal fu"nds-may be made available for use on County-highways,-city streets, State highways; and transit projects in accordance with the intent of the Federal Act. The State Department of -- Transportation has required that a three -year program be established for the- These projects-are to be approved by the State Department of Transportation and MTC'for conformance with the Regional Transportation Plan:" The Federa•1 avid will be made available for urban , systems projects within Sonoma County-and-the draft resolution to be presented to the Board.of Supervisors establishes procedures and criteria for determining•the projects to be approved for-' the three-year-program apportionment. The State will receive $90,000,000 annually and -.Sonoma-County will be eligible for $520,00 "0 of these funds. The County of Sonoma has volunteered to be chairman of the process-, and those attending, the last meeting to consider the program were asked to - solicit comments on. the draft resolution and nomination for projects from their° respective-Agency in order to.move ahead in determining project priorities for the three - year program'. In discussing the projects to be nominated, Mr. Young suggested - that Magnolia Avenue Widening-and Liberty- Street,Extension be - 'because - °plans and specif ications are--already prepared f'or the two projects.. He also ment orried the "wash dollars approach, which-is not covered in the resolution but discussed-•at the ;meeting and which may be used-for.-the benefit of-the smaller cities. ( "Wash dollars" approach is a process whereby the smaller- entities might agree to put-all the-money on County projects and then the County, in turn, releases equivalent sums back to city-of County tax revenue.) Upon conclusion of the discussion, Mr. Young was asked to convey the following at the 139' April 1, 1974 Claims and Bills Resolution #6573.N.C.S. approving claims Res #6573 NCS and bills #5480 to #5500, inclusive, #101 to #180, inclusive, and #2179 to #2198, inclusive, approved for payment by the City Manager was introduced by Councilman Cavanagh, Jr.,.seconded by Councilman Mattei, and adopted by-6 affirmative votes, 1 absentee. Annexation Fees Memo dated March 29, 1974, from City Attorney Edouard E. Robert to City Manager Robert Meyer regarding annexation fees, submitted and filed.. Memo dated April 1, 1974, from Director of Recreation James Raymond to City Manager Robert Meyer regarding annexation fees- - neighborhood park.development, submitted and filed. City Manager Robert Meyer asked for input from the Council with regard to the proposed annexation fees as related to inhabited and uninhabited areas and specifically the approach to be taken with an inhabited area such as Sunnyslope Avenue. He said that the matter of annexation fees for park development has been requested as a considera- tion with other fees submitted in report dated March 18, 1974. Referring to park development fees, Councilman Harberson informed the Council that after its next meeting, the Recreation, Music, and Parks Commission will be recommending an increase in the "bedroom tax" (park development tax) to the Council. Commenting on the subject, Councilman Daly reiterated his opposition to annexations. After some discussion, it was decided to consider the issue of annexation fees further at the Council meeting on April 15th in order to determine the direction to pursue. Federal Wage and Referring to the League of California Hour Bill Cities' Bulletin, City Manager Robert Meyer read the summary of the Federal Wage and Hour Bill which has been submitted to the President for his signature. The bulletin pointed out that firemen are not exempt from the "time- and -a -half overtime" provision. The.League suggested that cities adversely affected by the provisions should immediately wire the President requesting a veto. Mr. Meyer noted that a number of firemen will have to be added to the department to meet the schedule of the Bill requiring fifty- four hours per week by 1976 -77. Governmental The League of California Cities Bulletin Conflict of also announced that on March 28, 1974, the Interest Law California Supreme Court issued an order in connection with "County of Nevada vs MacMillen" transferring the cause,from the District R U April 1, 1974 Governmental Court of- Appeals.to the Supreme Court. The - Conflict of Court also ordered that pending final. Interest Law determination of the appeal, the operation (continued) of SB -71.6 is stayed, and it will not be necessary for Mayors, members of Council, City Managers, or chief of administrative officers-, members'of Planning Commissions, or Planning Officers to file financial disclosure statements until a decision of the Supreme Court in the Nevada County case is determined. Final determination could be late summer or early fall. Zone 2A Advisory Counclma -n Cavanagh, Jr., reported on the Committee Zone 2A Advisory - Committee meeting held March 27, 1974, at which time projects for fiscal year 1974-75 were considered for recommendation to the Board of Supervisors. The following priorities were established by .the' Committee from a list of 18 .projects totalling $4,073 -,000: Priority #1 Maintenance and channel clearing Master Plan Study Rights' -of -way Wilson Street Total Priority #2 Drainage Project Washington Creek, to Ellis Street Washington- Creek, Madison Street Washington Creek, to Highway 101 Total Priority #3 Petaluma River Ellis Street to Madison Street $ 18,000.00 20,000.00 40,000.00 620,000.00 �.•S 111 11 $ 85,000.00 30,000.00 North Corona Creek, Petaluma thru Highway 101 Priority #4: Lynch - Creek, Petaluma River to Highway 101 Priority #5 I Street Project 80,000.00 $195,000.00 $200,000.00 $ 35,000.00 $485,000.00 The total estimated 1974 -75 fund capacity amounts to $850-,00 Councilman Cavanagh, Jr., also reported that the Committee approved the continuation of the 25G per $.100 tax rate to :finance drainage projects.. He added that the County -'will also explore the Bodega Avenue drainage problem. 1 1 April 1, 1974 Federal Aid Urban Funds (continued) Amendment to Dog Ordinance Ord #113.2 NCS (Second Reading) Adjournment meeting tomorrow: That the City of Petaluma is in favor of the "wash dollars" approach; and, if the process is not considered, then the projects nominated are Magnolia Avenue Widening and Liberty Street Extension. Some discussion ensued with Animal Control Officer William Matthews regarding the proposed Leash Law Ordinance which requires that dog owners keep their dogs on a leash rather than under voice control as presently required. Also discussed was the procedure to be followed in citing violators. City Manager Robert Meyer emphasized that the ordinance does not establish new fees and that a resolution will follow in the future for Council consideration. The Mayor asked for comments from the floor and as none were heard, Ordinance #1132 N.C.S. amending Title 9 of the Petaluma Municipal Code to regulate and license dogs, to establish methods of setting certain fees and to establish minimum fine for violation was introduced by Councilman Matte , seconded by Councilman Brunner, and adopted by 7 affirmative votes. 143 vd,- There being no further business to come before the Council, the meeting was adjourned at 9:30 o'clock p.m. to a meet and confer session.
