HomeMy WebLinkAboutMinutes 04/15/1974MINUTES OF- MEETING OF CITY COUNCIL PETALUMA, CALIFORNIA April 15, 197= Council Meeting Regular meeting of the City Council of the City of Petaluma was called to order by Vice -Mayor Cavanagh, Jr., at the hour of 7:30 o'clock p.m. Attendance Present: Councilmen Brunner, Daly, Harberson, Mattei, *Perry, Jr., and Vice -Mayor Cavanagh, Jr. Absent: Mayor Putnam. Invocation Approval of Minutes CONSENT CALENDAR *Councilman Perry, Jr., arrived at 8:15 o'clock p.m. The invocation was given by the Reverend Marvin Barbee, First Assembly of God Church. The minutes of April 1, 1974, were approved as recorded. At the request of Councilman Brunner, Agenda Item #13 amending Zoning Ordinance #1072 N.C.S. to regulate indirect glare was removed from the Consent Calendar. A motion was made by Council- man Harberson and seconded by Councilman Mattei adopting the Consent Calendar, Agenda Items #1 through #12, #14, and #15. Motion carried unanimously. Agenda Item #1 Resolution #6574 N.C.S. adopting by reference Re Senate Senate Resolution #77 passed by the California Resolution #77 State Senate on February 6, 1974, was adopted. Res #6574 NCS (This relates-to an investigation by the PUC of the State of California concerning the inter- connection of miscellaneous customer provided devices to the facilities of telephone utilities.) Search Lights A proposed ordinance_ to regulate indirect glare Ord #1134 NCS (search lights) was considered next. Councilman Brunner observed that the - majority of the committee who redrafted th Ordinance in 1972 did..not favor such lights and he felt that there was no need to allow them within the City; however, Vice - Mayor Cavanagh, Jr., who also served on the same committee, indicated that he felt differently about the provision. Director of Community Development Frank Gray explained that the proposed ordinance requires a temporary sign permit to use search lights. April 15., 1974 Searcy: Lights City Manager Robert Meyer informed the Council Ord #1134 NCS that the five -day carnival at the Petaluma (continued) Plaza Shopping Center and the Sonoma /Marin Fair are two events that will be using the search lights, if the ordinance is adopted. The Planning Commission will consider the amendment at its meeting April 16th for a recommendation to the Council on May 6, 1974. Ordinance #1134 N.C.S. amending Zoning Ordinance #1072 N.C.S., Article 22, Section 22.304.2, to regulate indirect glare was introduced by Councilman Harberson, seconded by Councilman Mattei, and ordered published by the following vote: Ayes: Councilmen Daly, Harberson, Mattei, and Vice -Mayor Cavanagh, Jr. Noes: Councilman Brunner. Absent: Councilman Perry, Jr., and Mayor Putnam. North Petaluma This being the time set to hear.protests Annexation #6 and /or comments regarding North Petaluma Ord #1135 NCS Annexation #6, Vice -Mayor Cavanagh, Jr., declared the public hearing open. City Clerk announced that no written protests were received. Director of Community Development Frank Gray presented a map showing the parcels involved with the proposed annexation area and stated that there is a definite plan on file for the development of the Wojciechowski parcel, which will be processed for site design review upon approval of the annexation. Mrs. Mary V. Buchanan, 8 Ellis Street, confirmed that she had no objection to annexing the narrow strip of-land which formerly served as access to her property. Mr. Harold Wojciechowski, 831 Madison Street, spoke in favor of the annexation and reviewed the five -year problems involved with the annexation.procedure of the area. As no other comments were heard, the public hearing was declared closed. Ordinance #1135 N.C.S. annexing territory described as "North Petaluma Annexation #6" to the City of Petaluma was introduced by Council- man Brunner, seconded-by Councilman Mattei, and ordered published by the following vote: Ayes: Councilmen Brunner, Mattei, and Vice - Mayor Cavanagh, Jr. Noes: Councilmen Daly and Harberson. Absent: - Councilman Perry, Jr., and Mayor Putnam. Earlier in the meeting, Councilman Daly voiced objection to -any annexations until the City's position is resolved with the Court ruling on the growth control suit. ,4 April 15, 1974 Weed Abatement This being the time set to hear any comments or Res #6585 NCS protests regarding the weed abatement proceedings, Vice Mayor Cavanagh, Jr., declared the public hearing open. The City Clerk announced that no written protests were received. Vice -Mayor Cavanagh,.Jr., then called for comments from the.floor and as none were heard, the public hearing was declared closed. Resolution #6585 N.C,.S. ordering abatement of nuisances consisting of weeds growing and rubbish, refuse,.and. dirt existing upon the streets., sidewalks, parkways, and parcels of private property in the City of Petaluma and ordering the Fire Chief to remove said weeds, refuse, rubbish, and. dirt was introduced by Councilman Harberson, seconded -by Vice -Mayor Cavanagh, Jr., and adopted by 5 affirmative votes, 2absentees. ( Bicentennial Letter dated March 27, 1974, from Ken Colin, Committee--Re Chairman., Petaluma Bicentennial Steering Com- -� Use of Library mittee, requesting the City Council to consider Building allowing the present Petaluma Public Library to be converted into a library - museum complex wh en the new library facility is completed, and suggesting,.tha:t a friendly suit be filed in court to settle the issue of the legality of - using the facility in this manner, submitted and filed. April 15, 1974 Bicentennial Mr. Colin was present to discuss the request Committee - -Re and obtain a legal clarification of the uses Use of Library for the existing library building. Building (continued) It was the City Attorney's opinion that if the use of the library is combined with a museum use, there is no necessity of a suit. He explained that under the original deed, the property reverts to the heirs if the library use of the building is abandoned. An alternative suggested by Mr. Robert would be to contact all of the heirs, if at all possible, to obtain quit claim rights on the reversion. It was his recommendation to proceed along the lines of having a library function in the building and, as Councilman Mattei suggested, to term the use as a "historical library," and let the heirs challenge rather than have the City bear the burden. It was the consensus of the Council to pursue the matter further. W ]F Logo Contest -- Mr. Kenneth Colin informed the Council that th Bicentennial local Bicentennial Logo Contest will be completed Celebration in two weeks and requested the awards be presented at the first Council meeting in May. The City Clerk was directed to place the item on the May 6th agenda. Intra County Letter dated April 3, 1974, from Sue T. Parker,�� Bus Service Chairman, California State College, Sonoma Transportation Committee, requesting that the �-�- Sonoma County Board of Supervisors be encouraged to adopt a 25� County -wide fare intra- County bus service on the Golden Gate Transit System for the fiscal year 1974 -75, submitted and filed. Mr. Michael Troy appeared on behalf of Sue Parker to explain that the money for public transit subsidy is available from SB 325 and that the Sonoma County Board of Supervisors has the authority to establish new intra- County fares. He continued by saying that the current fare structure within Sonoma County is inequit- able. He asked for Council support on the 25� fare proposal. After - a brief discussion, it was agreed by the Council to refer the matter to the Mayors' and Councilmen's Association of Sonoma County for its consideration of the request on a County- wide basis.- Mr. Troy was informed that he will be contacted by the Chairman of the Association with regard to the proposal. County -wide Letter dated April 1, 1974, from David L. Library System Nichols on the revised proposal for County- wi Proposal Library System developed by the Library Study Committee of-the Mayors' and Councilmen's Association of Sonoma County, submitted and filed. In his letter Mr. Nichols listed the five elements in the proposal and requested action by Councils of the cities involved be- fore the Committee's next meeting on April 24, 1974. 150 April 15, 1974 County -wide Letter dated April 1.1, 1974, from Mr. Kenneth Library System Wi_ghtman,. President, Petaluma. Board of.Libr.ary Proposal Trustees, expressing its preliminary approval (continued) of the concept of establishing the County,,. Students Library Commission by'a joint powers: agreement with so:le.taxing.authority held by the Board of Supervisor.; approving the proposed equaliza- . tion of tax rates,. but recommending that the County -w,ide library tax be paid in the case of Petaluma on an "in l.ieu" basis as propo.s:ed in the 1968 draft agreement for merger. (Article :. 6); approving a appointment of a seven member.commission, but recommending that one of the four commissioners to be named by cities be appointed by the City of Petaluma so that permanent representation is assured; and, listing the fohowing points of concern for clarification before consideration of the final approval: (1) Level. of service to be provided; (2) status of. present personnel; (3) title to existing and future buildings; (4) provision for termination withdrawal, submitted and filed. Mr. Wightman,,accompanied by Dorothy Bertucci of the Library.Board of Trustees, appeared before the Council to discuss the Board's four points of concerns and particularly the problems involved with element #4 of the Library Study. as follows: "Equalization of tax rates to be accomplished through a single County -wide library tax established annually by the Board of .Supervisors." Mrs.,Bertucci.pointed.out that at this stage of the proceedings, agreement by the Council with the concept'of the proposal and the one member appointment from Petaluma is required. She specifically noted that #4 of the Committee's proposal is a problem unique.to Petaluma and does not affect the other points of the proposal. Following some discussion, the Council concurred with .items #-1,. #,2, #3, and #5 (#4 questionable) of the proposal.and Councilman. Brunner and Dorothy Bertucci,, who are represent the City at the April 24th meeting, were. authorized to conve.y.the Council's, concurrence with the concept o;f the proposal and the concerns . expressed. y Disadvantaged CCareer Letter dated April 7.0, 1974, to Mayor Putnam /-� Guidance from Gerald J..'Dady,. Princ Petaluma High " Center--Senior School, Edward L. Davis, Work Experience High School Coordinator, Petaluma High School., Fran Stevens, Students Career Center Coordinator, Petaluma High School, that High.School District has.received a Federal Vocational Educational Grant and considers e guidance to initiate a Disadvantaged Career Guidance Center, for senior high school students and inviting the Mayor to a tour of the Guidance Center on Wednesday, April 17th, 4:00 p.m. to :. _8:00 p.m._,, read and filed. Councilman.Mattei volunteered to represent the City on behalf of the Mayor who is out of town.this week. The City Clerk was asked to so notify the School District. April 15, 1974 151 Claims and Bills Resolution #6587 N.C.S. approving claims and Res #6587 NCS- bills #181 to #317, inclusive, and #2199 to #2226, inclusive, approved for payment by the City- Manager was introduced by Councilman Mattei, seconded by Councilman Daly, and adopted by 6 affirmative votes, 1 absentee. Residential City Manager Robert Meyer referred to a list ofd 3 F Development residential development applications with Applications previous action and new applications. He asked `� for Council direction with regard to establishing a priority on processing the applications by the staff. Copy of list submitted and filed. In reviewing the list, Councilman Daly noted that there are 591 units presently zoned within the City and he submitted that a priority be set of these units as time allows. Councilman Harberson felt that those applications involving prezonings or annexations should not be considered. In answer to Councilman Daly's question of delaying building permits until after the written court order on the growth control suit is received, City Attorney Robert stated that if a tentative map has been approved and the final map conforms with the tentative map, the City is not in a position to deny a building permit and that process of the application - should proceed normally. He further stated that if the City takes action which attempts to subvert-the-judge's ruling, then the aggrieved person has an opportunity to file a petition with the Federal Court for a ruling on the matter. He recommended to proceed normally with the tentative /final map stage and not aggrieve an applicant. Indirect Sources of Air Pollution In answer to a procedural question asked by Director of Community Development Frank Gray, it was the opinion of the City Attorney with Council concurrence that fees paid by developers for prezoning applications not activated be refunded to all applicants. The fees were originally required under the Residential Development Control System. After some discussion, it was the general consensus of the Council that applications be processed by state of readiness in the following order: (1) final maps; (2) tentative maps (3) rezon- ings -;.(4) the complete process. The City Manager noted that when all of these applications have -been processed, the staff will submit prezoning and annexation applications at that time for Council consideration. Letter dated April 4, 1974, from D. J. Callaghan, Air Pollution Control Officer, stating that the Board of Directors of the District will hold a public hearing on the control of indirect sources of air pollution at 10:30 a.m., Wednesday, May .1•, 1974 -, submitted and filed. A draft of changes -to Regulation #2, which will be the subject of the hearing, was enclosed with the - letter:- City Manager Robert Meyer reviewed the basic changes and asked for Council direction on the matter. Mr..Bill Bettinelld, Chairman of the Board of Directors , o;f the . Chamber of Commerce,, .stated that,tesstimony is being prepared by the Chamber and he requested that comments from the City be incorporated with.their statement. r Program of Service At the request of City Manager Robert Meyer, a Y� and Preliminary motion was made by Councilman Daly and seconded Budget for 1974 -75 by Councilman Perry, Jr., that the City Manager submit the P, of Service on May 6, 1974, and the Preliminary Budget on June 4, 1974. Motion carried unanimously. I Proposed Underground Vice -Mayor Cavanagh, Jr., reported that the Utility District -- Underground.Utility Committee met on Apri1 "C" Street from 1974, to consider various underground utility Petaluma Boulevard districts and it was the recommendation of the South to Fourth Committee that a district be formed to cover Street undergrounding public utilities on "C" Street Res #6588 NCS from east of Petaluma Boulevard South to west of Fourth Street. This is the area for the proposed North Bay and Loan Association facility. Resolution #6588 N.C.S. calling a public.hearing to determine whether public necessity, health, safety, or welfare require the formation of an underground utility district as more particularly described in the body of the resolution was introduced by Councilman Mattei, seconded by Councilman Ha r"ber;son, and adopted..by 6 affirmative votes, 1 absentee. Universal Gym Letter dated March 29, 1974, from Jim Raymond, Facility - - Director of Recreation and Dan Longaker, President, ` Storage Petaluma Municipal Petaluma Swim Club, stating that. the Petaluma Swim Center Swim Club recently purchased a Universal Gym which is,presently be -ing ,stored in the storage area of` the Kenilworth Recreation Center- and -.the Recreation, Music, and Parks Commission has recommended that the.City Council participate with; the Swim Club in-the financing of erecting a.20' x -24 pref building in the southeast corner of the Municipal Pool Complex at a cost not to exceed one -half or $1,600, submitted and filed. Mr. Raymond presented a layout-of the swim center and pointed out the proposed, location o.f the facility. A .sketch of the typical.,desgn of the proposed building was submitted for ._Council information. Mr. Raymond also explained that.the storage area at the . Kenilworth Recreation Center is not very large and causes an inconvenience for the storage of v the chairs and table's,at the center. ?V t i . y v April 15, 1974 Universal Mr. Longaker spoke to the Council about the Storage Facility -- style of the building and felt that it would be Petaluma Municipal compatible with the swim center motif. He Swim Center informed the Council that for the City's involve - (continued) ment in the project, the Swim Club has offered the,Recreation Department to utilize the gym for special adaptive classes,.physical training, and conditioning, Police training, etc. Considerable discussion followed on the funding of the City's share of the cost of the proposed building, whether to erect the building or use the classroom at the swim center and other related matters. After some deliberation, a motion was made by Councilman Harberson that the City provide $1,600 from the Contingency Fund toward the construction of the prefrabri- cated building on the assumption that the City's insurance would cover the use and the City would be allowed to use the gym by . scheduling of the Recreation Director. The motion died due to lack of a second. Because it was felt that more information was needed before a decision is made, the Petaluma Swim Club was asked to invite the Council members to its next meeting to make an on -site inspection of the storage room at the Kenil- worth Recreation Center, the site of the pro- posed building at the swim center, and the classroom at the swim center to further discuss the matter at a study session on May 13, 1974. Cambridge Square Director of Comunity Development Frank Gray 63q #4- -Final Map presented a loca tion m tion map of the subject sub - Res #6589 NCS division and stated that the subdivision includes 30 units and the final map meets all conditions set forth in the tentative map approved by the City Council. He added that the City Attorney has ruled the procedure on the final map cannot be delayed because the tentative map has been approved; whereupon, Resolution #6589 U.C.S:. approving final sub- division map of Cambridge Square #4 was introduced by Councilman Mattei, seconded by Councilman Daly, and adopted by 6 affirmative votes, 1 absentee. Historic and Planning Commission Resolution #7 -74 recommending Cultural amending ordinance #1072 N.C.S. to include Preservation Article 17 entitled "Preservation of the Cultural Article -- Zoning and Historic Environment" and recommending ordinance creating a Historic and Cultural Preservation Committee, establishing its duties and powers and providing for its organization, submitted and filed. Report dated February 26, 1974, from the Mayor's Select Committee on Historic Preservation- - "Recommendation of the Mayor's Select Committee on Historic Preservation," submitted and filed. Planning.Commission minutes dated March 19, 1974, and April 2, 1974, on the subject matter, submitted and filed. 154 April 15, 1974 Historic and Chamber of Commerce Resolution #.39 re the Cultural Historic and Cultural Preservation District and Preservation requesting that the City of Petaluma take no Article - - Zoning further action on the establishment the Ordinance district inasf-ar as the business areas are (continued) concerned until representatives of the organiza- tions affected have met and resolved the points of interest of all concerned, submitted and filed. Letter dated April 10, 1974, from George J. Silvestri-, San Rafael, California, favoring the ordinance and - wishing success in-the adoption of the legislation, submitted and filed. Letter dated April 12, 1974, from Dennis W. Pooler, Vice- President, Heritage Homes of Petaluma, requesting that he be. allowed to appear f1i'st at the opening of the public hearing with a slide presentation on the Historic Preservation and Landmark Zoning Ordinance, submitted: and filed. Director of Community Development.Frank Gray reported -that the amendment was studied by the Mayor's Select Committee on Historic Preserva- tion and presented to the Planning Commission for its considerat -ion and action. The Planning Commission held a.public hearing on the matter, and with the exception of Councilman Mattei (Council representative on the Planning Commis- sion), the members of the Planning Commission were satisfied with the ordinance and recommended that the Zoning- Or.di.nance.be amended to include the Historical and Preservation Article. Mr. Gray explained -the procedure involved for exclusion in the historical district. In response -to a question, Mr. Gray stated that the proposed ordinance does not cover any tax relief measures-and he suggested that if the objection to the- ordinance. related to setting up historical districts, the Committee could consider the deletion of, the word "district" and make certain to still maintain the integrity of the ordinance. Mr. Dennis Pooler appeared before the Council requesting that the procedure of no hearing 'at the time of the introduction of the proposed ordinance be altered to allow a presentation and.hearing of statements tonight. It was agreed -to have a -short presentation and hold Mr. Pooler'•s slide presentation for the next Counci -1 meeting. - -Mr. Pooler presented the fol- lowing two letters in support of the ordinance: Letter dated Apr -i1 1.1, 1974, from the California Heritage Council, San Francisco, California, and letter dated April 15, 1974, from the _ National Tr- ust , for Historic Preservation, San Francisco,- California. Both letters submitted and filed, At thi-s time the City Clerk read - the Chamber of Commerce resolution. Mr. Fred Schramm, a member of the Mayor "s Select Committee on Historic Preservation, appeared before the Council and responded to the charges in the Mr. Jim Williams of the AB 103 Downtown Improve- ment Committee also spoke in objection as related to the Downtown Improvement District. Mr. Jim Webb, of the Mayor's Select Committee indicated that the Committee is willing to meet with the downtown committees and asked that the Chamber resolution be withdrawn claiming that it contained many, inaccuracies. Mr. Bettinelli agreed to contact the Chamber's Executive Board on this matter. Teerink, Protection Act Director, State Department of Water Resources, of 1973 stating that the Flood Disaster Protection Act of 1973 contains provisions which could have a significant economic impact on our community and citing portions of the Act important to communities identified as flood prone areas, submitted and filed. Director of Community Development Frank Gray referred to letter dated February 20, 1974, from H. R. Temple, Jr., Director, State Office of Emergency Services, regarding the Federal Flood Insurance Program requirements and letter dated March 8, 1974, from George K. Bernstein, Federal Insurance Administrator, Federal Department of Housing and Urban Development, giving formal notice of the tentative identification by the Federal Insurance Administration, that Petaluma contains one or more areas having special flood hazards and to inform communities that are not presently participating in the National Flood Insurance Program of the flood danger of the opportunity to enroll promptly in the program so that their residents will be protected financially against future flood losses, submitted and filed. (continued) Mr. William Bettinelli, President of the Board of Directors of the Chamber of Commerce, addressed the Council stating that the Chamber has no basic objection to the ordinance itself, but is objecting to certain aspects of the ordinance. He requested clarification of the questionable points as they apply to the downtown district. Mr. Jim Williams of the AB 103 Downtown Improve- ment Committee also spoke in objection as related to the Downtown Improvement District. Mr. Jim Webb, of the Mayor's Select Committee indicated that the Committee is willing to meet with the downtown committees and asked that the Chamber resolution be withdrawn claiming that it contained many, inaccuracies. Mr. Bettinelli agreed to contact the Chamber's Executive Board on this matter. Madick vs City City Attorney Robert reported that Or.dinance- of Petaluma #1127 N.C.S., which rezoned the Condiotti property on "I" Street to Planned Unit Develop- ment (P..U•.D.) ,- was- presented to the Court, and it was found that the Council made the appropriate findings in accordance with evidence presented and that the ordinance is legal in every respect. Federal Aid for Draft.of of the Board of Supervisors Urban System of Sonoma - adopting procedures and criteria 33 Projects for deterinining-federal aid for urban systems projects, submitted -and filed. Director of Public Works David Young pointed out the revisions-in the draft resolution and recommended that the Council approve said resolution so that a County committee can be created to determine the three-year projects program to. be forwarded by the Board of Super- visors to the Metropolitan Transportation Commission and to the State Department of Transportation. He also asked for direction as, to the projects to be nominated for consideration of FAU funding. A motion was made by Councilman Brunner and seconded by Councilman Perry Jr., approving the concept of the Board's resolution. Motion carried unanimously. In discussing projects to be nominated, Mr. Young - recommended right -of -way acquisitions to be the best 'use of the funds for the City. Upon conclusion, it was decided to nominate right -of -.way acquisitions for the following streets: East Washington Street widening, Magnolia Avenue widening, and Liberty Street extension. Mr. Young was asked to act as the City's repre- sentative at this time on the Sonoma County Urban Systems Technical Advisory Committee. The City Clerk was directed to write a letter to the Board of Supervisors of the Council's action.
