MINUTES OF MEETING
OF CITY COUNCIL
PETALUMA, CALIFORNIA
February 26, 1975
COUNCIL MEETING Special meeting of the City Council of the City of
Petaluma was called to order by Mayor Putnam at 9:00
a.m.
ATTENDANCE Present: Councilmen Brunner, Cavanagh, *Harberson,
Mattei, Perry, and Mayor Putnam.
Absent: Councilman Daly.
*Councilman Harberson arrived at 9:03 a.m.
NOTICE OF CALL Notice of the special meeting called for February 26,
1975, the certificate of the City Clerk of the delivery
of said notice, and the consent of the City Council for
holding said meeting submitted and filed.
PURPOSE OF MEETING The meeting was called to consider and act on the
following: To consider,a resolution for eminent domain
re the Carlsen property. D
City Attorney Matthew Hudson explained the reason for the special meeting was to
consider the resolution to authorize acquisition of the Carlsen property on
Magnolia Avenue and to authorize him to file eminent domain proceedings. The
resolution states it is in the public interest and public necessity to acquire
the property. The resolution is a preliminary step in the eminent domain
proceedings. It enables the City Attorney to file the pleadings in the case.
This would condemn the property for immediate possession.
Councilman Cavanagh questioned whether the City had made a reasonable offer for
the property to which City Attorney Hudson replied the offer was made based upon
the best appraisal advice the City had received.
At the conclusion of this brief discussion, Resolution 46840 N.C.S. declaring
public necessity, directing the acquiring of fee title in real property for
street widening purposes and directing the City Attorney to take such proceedings
as are necessary to acquire the real property was introduced by Councilman
Mattei, seconded by Councilman Harberson, and approved by 6 affirmative votes, 1
absentee.
ADJOURNMENT There being no further business to'come before the
Council, the meeting was adjourned at 9:05 a.
