PETALUMA, CALIFORNIA February 28, 1972 Council Meeting Adjourned meeting.of.the Council, of the City of Petaluma was called to order by Mayor Putnam at 7:30 o'clock p.m. Attendance Present: Councilmen Brunner, Cavanagh, Jr.,.Clecak, Daly,.Mattei,. Perry, Jr., and Mayor Putnam. Mr. Corw Williams and Mocine, City - Planning, .Consultants , .was present to discuss details regarding the Plan. (NOTE:_ Item numbers are a continuation or modification of those listed in the Minutes of January 31, 1972.) 27. AREA: TRI- ANGULAR, SHAPED: AREA. BYi LAKEVILLE HIGHWAY CAULFIELD LANE AND FREEWAY-101. Mr.. Bill Larkin, assoc a',ted with_ Horace : .Henr,i.s in developing Property located .in the subject .area appeared • befor:e , the Council requesting .that _.this' area be deleted from. the Special Planning Study.Ar.ea - and- approved as ,service- commercial designa- tion. The E. Map designated the area as service- commercial.; but the Planning.Commission recommended ;to; the Council, and the Council concurred', that this area and adjacent large industrially - ;zoned area .be designated as a Special ; Planning Study Area. Following Mr. Lark"in's presentation, the Council by consensus Absent: . None. Agenda Mayor Putnam announced that the Council, will consider the E.D.P. Map and Blan night •and adjourn at 10':0:0.o'clock to Tuesday night at 7 :30'o'e1ock p.m. g Grant Funds Resolution #5994 - N.C.S.- authorizing the Police Department City Manager to apply'for a grant to the Res #5994 NCS California.Counci'l.on Criminal Justice for special investigative equipment, was introduced by Councilman seconded by Councilman Cavanagh, Jr., and adopted by 7 affirmative ,votes. f Grant Funds''t aa� Resolution. #5995 N.C.S. authorizing the Police. McNear Park Lights OReso,lution #5996 N.C.S. authorizing the Res #5996 NCS purchase of material for McNear Park lights, was in!.tr.od.uced by Councilman Clecak, seconded by Councilman: Da -ly, and - ado.pted,, by 7 af- firmative votes. Environmental /S This.being the continuation of the.public Design Plan. hearing on the Environmental.Design Plan, Mayor. Pu tnam called . for comments from the floor in regard - to the Map. Mr. Corw Williams and Mocine, City - Planning, .Consultants , .was present to discuss details regarding the Plan. Lounibos appeared.-be-fore the • Council on behalf of - Mr., Norman Rollins (It'em #23) and Mr. Norman. Johnson ('h,tem #26) , owne'rs .o:f p:rbRerty designated on the E'.. D.,P . Map as Park Area. He cited various Sections of the GOVerhment,'Code relating to open space' and ;particularly to the :new State' law to become - effecti.e,Jan;iary 1, 1973, making it mandatory to' conform the.Zoning Ordinance to the' General. Plan•of the - City. He.claimed- reclassifying the land to parks would'const an 'inverse condemnation of the property, and in :effect:, such classification would freeze the property. He added t-hat, the City 'd;e'sires the.Land for.park purposes; it s °ho"Id.be prepared to either 'immediately negotiate for the .purchase of the land or act throu'gF.eminent, domain for the acquisition of the land RE: Item' - #23. The E:D.P. Map designates the;ar&x as .a park.with the north- east quadrant of Ca- ulfield. Lane . and South McDowell Boulevard as a neighborhood- commer:ciad... Mr. Lounibos requested "the Council•to consider.removi•ng.the park designation on the` E.D.P. Map and change the area ,to* a professional- and adrnini- stratve office designation. A proposed .plain of the development,of the"are °a was presented as part of th : e'testimbny, Mr., Lounibos stated that Mr. Rollins will donate approximately one acre of.land to: the. City of Petal.uma,for a branch public library facility. Mr. Rollins, also spoke. on the change and asked ._for an, exp-ressiorn- from the' Council. After due consideration,, the Council by consensuls' modified :Item #23•,by recommending to the P.'lanning Commission. that the park de?s- ignation- be removed and the be shown on the E..D,P. Map. He asked' that it. remain -as presently zoned -- industrial andtcomme•rcial Following a brief discussion, the Council by ,conse.nsus, recommended to tfie Planning Commission that the.E.D.P: Map be changed as requested. In reply to Mr. Amaral's question re flexibility of the Environmental Des_ign,Pla Mr.'Mocine stated that it can be. amended by pr-o.cedure of -.the Planning Commis.s,ion- and the - Council. The City Manager.added that under "The Planning Commission's Rules and. Regulations," the City' ..s General Plan, E.D.P., and Zoning Ordinance will be reviewed annually. Map designation showing his,land as agricultural. Planning Com- missioner Arthur Cerini,stated that the.Map o' longer desi- nates the.arecP as agricultural as the Planning Commission -recommended the E . D; P'. Map b'e changed to. limit-red- industrial for both area .and the Council concurred with the recommended:, change on, January 3.1,._1972. AREA :', NORTH STDE.OF EAST WASHINGTON STREET, BETWEEN PAYRAN,STREET AND ELLIS STREET... Mr. Norman.Ro.11ins requested that the neighborhood- commercial designation on. the .E. Map be eaten °ded - for the entire sub - ject block.. Councilman Cavanagh; Jr.; also asked that consideration of the — matter of plan lines on East Washington Street from Lakeville- Street to the Freeway be - , resumed It was generally agreed by the Council to review.Mr.. Rollins! request in'conjunction with plan lines and with the City Engineer at a special OTHER.COMMENTS Mrs. Jean Bucholtz urged the Coungil-to formulate areas for parks.and schools for consideration of the people of the community -. Mrs. Del Miller, member o`f. -the E.,D.P. Citizens' Residential Planning Committee,,',spoke and urged the Council to preserve. the historical buildings.and open space as part of. the City's wealth., Dr. William Kortum,,President of the Board of Educat.ion.and member -of_the E_,D.P, Citizens' Unincorporated Ar -ea Comm- ittee, spoke to , the Council of the , important role of •the •schools With regard.to land use, He referred to the , Buar-d's recent letter supporting the P-UD concept and reiterated the, Board 's request to part•c'ipate and,.Tbecome involved .with:•, decisions that are vital to the ,proper.gr_owth and development of the community. The hearing-on--the E .,D : P . ;Map was concluded- The Map was referred to the.Planning Commission for its consider °anon and recommendation.to It was- indicated that, the E.D.P. Text would be finalized at the adjourned meeting on February 29, 197.2.
