HomeMy WebLinkAboutMinutes 12/04/1972MINUTES OF MEETING OF CITY COUNCIL ' PETALUMA, CALIFORNIA December 4 -, 1972 - .Council.Meeting Regular meeting of the= Council of the City of Petaluma was called to order by Mayor Putnam at the hour of 7:30 o'clock p.m. - Attendance Present: Councilmen Cavanagh, Jr.,, Clecak, Mattei, *Perry, Jr., and Mayor Putnam. ..Absent: Councilmen Brunner and Daly. *Councilman Perry, Jr., arrived at 7:35 o'clock p.m. Invocation Due to the.absence of the- Reverend Clyde Tillman St. Vincent's Church, no invocation was,given. Approval of Minutes The mi'n.utes.of November 27, 1972, were approved as recorded - . Construction Mr: Joe Henderson,•Executive Director of the ,Industry Association Construction Industry Association of Sonoma of Sonoma County County,, appeared before.the Council to briefly explain the purposes of the Association. The organization formed in August of 1972, consists of contractors, builders, developers, suppliers, and those firms whose livelihood depend upon .the construction industry. Its primary purpose is to.appear before Planning Commissions, Councils, and various agencies to present the views of the construction industry. Another activity is to gather and prepare statistical material which, Mr. Henderson'added, is available for informational purposes. He summarized the Association function as a "lobby group" by the construction industry. Claims and Bills Resolution #6182.N.C.S. approving claims and Res #6182 NCS bills #1452 to #1501 inclusive and #1460 to #14171inclusiv.e, approved for payment by the City Manager, was introduced by Councilman Clecak, seconded by Councilman Mattei, and ad 5 af- firmative votes, 2 absentees. Environmental City Manager Robert Meyer reported that the Sm Design Plan hearing on the City's Environmental Design 'Plan :before the Board of Supervisors of Sonoma County has been set for December 12, 1972. In a.previous appearance before the Board, the Plan was-referred to theiCounty Planning Commission for review and recommendation. The Board has asked - the City' what elements the Plan affects and the-Council's intent with respect to the Plan. The County's legal counsel, in calling the'public hearing, discussed the matter with th'e City Attorney'and is now satisfied that the Plan i.ss, an element of the General Plan. General discussion followed on the concept of the :En- vi.r.onmental.Design and the General Plan. -.In response to Mr. Meyer's request for a.stat-ement'.on'the intent of the Council for presentation to the Board, a motion was made by-Councilman Clecak, and seconded by Council- man.Perry, Jr.,, that the City will not extend util;it'ies beyond .the urbanized growth area as shown on-the adopted City's and County's General Plan for.the Petaluma• planning area. Motion carried unanimously. O LJ December 4, 1972 Environmental Members of the, Council were urged to attend. Design Plan - the-hearing with appropriate memb - ers of - staff and Mr. Mocine of Williams -and Mocine, the City "s.Plarning Consultants. Interested citizens were also invited to attend to support the Plan. Municipal Swimming By general consensus -of the Council., the- Pool Repairs Director of Public. Works was authorized to proceed with necessary.repairs and maintenance of the municipal swimming pool for an approxi- mate expenditure of $1,600. Mobile.Aerial- Director.of Public Works David Young requested Tower Truck.. the Council to consider tie. purchase of a sec - and hand truck -with a mobile aerial tower. to �9� _ be used by the electrician to maintain park lights and traffic signals,, and by the main- tenance crew to trim.trees. The cost of such vehicle:would not exceed $1,5 00. .A .motion ,wags. made by Councilman Perry, Jr., and seconded by Councilman Clecak, approving the purchase of the mobile aerial tower truck from General Reserve Account 145.610. Motion carried_ unanimously. Annual .Report. 1971 -72 gro F Washington Street Widening. ,Pro,j ect Res #6:183,NCS Residential Developmen -t Evacluaton Board' o9v Ci ty Manager Robert Meyer reported that copies of the 197.1- 72.Annual Report were given to the Council at the study session on Thursday, Novem- ber 30, 1972. - ,Mr:. Meyer distri- bated' copies to the press* and noted that a copy is available at the Library and at the City.Clerk's office for use by the public. Director o:f° Public.' Works David 'Young 'stated that. the project, authorized ` by the Council to widen'Washington Street from Keokuk Street to Kentucky - Street•i.s to* be funded by TOPICS Funds. In :order -to comply With the TOPICS requirements : and federal- environmental procedures, a public hea=ring, must be held for the subject project and.two notices of the hearing published. The public hearing was set 'for January 29, 1973, and with the consent of the introducing and seconding Councilmen, the d'ate.of the public hearing on the_pro,posed resolution of the hearing ways changed accordingly; whereupon, Resolution #,6.183 N.C.S. .e time and place of public hearing with respect to -the widening of Washington Street in the City of Petaluma from Keokuk Street.to Ken-tueky Street and the instal- lation of traffic sigpals at Howard Street and Kentucky Stree;t,,`was introduced by'Councilman Clecak, se.cond'ed by .Coun_cilman Matted, and adopted by -5 affirmative votes, 2 absentees. Mr. Young noted 'for 'Council; information that Lapman. These street's are proposed to be de. signed with right -turn lanes. City' 'Manager Robert Meyer r,eported'on the status. of the Residential Development Evaluation.Board. Due to the newness of the concept and thorough-* ness of the Board : s examination of the 16 'appli - cations °, the Board will not be able to meet the 1 ZOO December 4,. 1972 Residential schedule as established by Resolution 46113 N'.C.S., Development adopted -by the`Council August 21, 1972, and as Evaluation Board. amended by- Council.motion August 28, 1972, grant - (continued;) ing an extension of 15days for developers to file allotment applications. According to the schedule, the -Board was to publish evaluation rankings on or about'November 1, 1972; however, - = . Mr... Meyer- noted- that .the Board is ho "lding its last meeting -to hear developers' presentations on December 6," 1- 972, -and then will hold another meeting thereafter to make -its evaluations. Ratings will- .be* s.hed.by December 15, 1972, a"nd.the applicants will 15 days thereafter in'- which -to file any appeals. These ratings will be furnished to the Council when published. The Board hold " -its public session on January 10, 1973, and will make its report to the. Council" either on January 22, or 29, 1973. It is hoped that the - Council will award Development Control Allotments on February 5, 1973. Mr. Meyer added that the Evaluation will begin with its assignment at"an earlier date next year in order to meet the-established time schedule. Mr..Bob•Renaldo, Chairman of the Allotment Evaluation Board, "was "present and briefly com- mented on the Board's activities. He indicated that these changes,` outlined by Mr. Meyer, are in concurrence with the Board. In connection with construction of single family dwellings, Mr'. (continued) office for. review by the public and- adoption of the ordinance will be considered by the: Council on December 18,.1972; whereupon Ordinance - #1072 N.C.S. of the City Petaluma, State of California;-establishing land or zones; `regulating the.' uses of :1and and buildings, . the heights of and -the open spaces, about buildings; requiring permits for certain building uses;, defining terms used herein; and specifying--the procedure for 'the amendment and `administration, "and prescribing penalties for, the violation of any.of the provisions hereof; repealing Ordinance #662 N.,C..S. -and all amend - ments was.introduced by-Councilman Daly, seconded by Councilman Brunner, and ordered posted by 5 affirmative votes, 2 absentees. Guidelines and City Manager Robert Meyer reported that the- Procedures— modifications discussed at the.last Council Environmental, meeting -were incorporated 'in the proposed re Impact Reports drafted resolution'. Following some discussion. Res #61.84 NCS on Section 13 covering feels', it was agreed not to charge a fee to-covet staff time, and with the consent of the introducing and seconding Councilmen said;s!ection was deleted . from the proposed resolution. Memo, dated December 4., 1972, from City Attorney - Rober that the. the, .Knox, Bill (AB .889) passed both Houses and is before the Governor for signature;.and: according to the League staff, the Bill provides fora 120 -day moratorium on the issuahce.of building permits to allow the Office of Planning'and,Research to develop guidelines for Environmental, Impact Reports;, that there is no �provis.ion in the :Bill which allows those a.gencies'who have.developed procedures and . guidelines to issue thus, if the Council adopts -_the, ,guide;li.•nes as 'presented,, this City may issue permits for private-projects, but i f' no procedures are' adopted, ' no permits are o "be' issued, submitted and filed,. Councrilman Cavanagh, Jr.-, questioned the' effect of the 120=day moratorium for the . agencies who have ,adopted guidelines and noted that, there were a number of amendments presented that might c-aus,e an administrative problem. - He felt that action on, the proposed resolution should be delayed until these points re AB 8819 are clarified.
