HomeMy WebLinkAboutMinutes 06/01/1970�5 MINUTES OF MEETING OF CITY COUNCIL• PETALUMA, CALIFORNIA June'l, 1970 Council Meeting Regular meeting of the Council of the City of Petaluma was called to order by Vice -Mayor Cavanagh, Jr. at the hour -of 7:30.'o'clock p.m. Attendance Present: Councilmen Battaglia, Brainerd, Brunner, Joerger, Mattei and Vice -Mayor Cavanagh, Jr. ..Absent;' Mayor Putnam. Invocation The invocation was given by the Reverend Herbert Bauck United Church of Christ. Approval of Minutes. The minutes of May 18, 1970, page 6 - the name of John.Jefferson was added to the.lis.t o.f - those who spoke in opposition to the resolution. The minutes of May 18, 1970 were then approved as corrected. The minutes of May 26, 19.70 were approved as recorded. General Plan 1 � This being the time set for public hearing Modification on the modification of the General Plan Res. #5482 N.C.S: Vice -Mayor Cavanagh, Jr. opened the hear - . iha. The City .Clerk announced that no written protests were received. Director of Planning McGivern showed a map of _the proposed change to realign Stony Point Ro;ad.so as to intersect Petaluma Boulevard,.North at an angle to permit traffic flow directly to Industrial Avenue. No oral protests were heard,and the public-hearing was closed.. Resolution No. 5482 N.,C.S. recommending modification of the.Gener.al Plan .was introduced by Councilman Cavanagh,. Jr., seconded by Councilman'Mattei, and - adopted by.5 affirm - ative'. l abstaining, and 1 absentee votes. Councilman Joerger abstained and stated that he own property in the area. Records Audit Audit of the Records for 1969 =70 prepared 1969 -70 �/ by David,M. Browne and Associates, submitted and filed.. Mr. Browne appeared before the Council to the audit and_ _to discuss the-recommendations contained therein. He particularly recommended that the Council consider a program on a scheduled approach of backup and security for the records that,are necessary to the operational aspects of . the City in the event of any emergency or disaster. A proposal for such a program will be submitted'at a later.date. 26 June 1, 1970 Cherry Valley Assess -. Letter from Byron Fauss, President of. ment District the Cherry Valley P.T.A., that sufficient. affirmative petitions from the West �j Street- Cherry Street - Laurel Street_ and Schuman area warrant alrequest that the City Council authorize the hiring'of an engineer.of work for the proposed subject district, read and filed. Mr. Fau'ss addressed the Council -and spoke.of the need for street and side- walks in the.area. for the safety of the school'c'hildren. He presented a map outlining the area of the property owners and tenants who,signed the .peti- tibns and which appeared to show that 60 %*o,f the area favored such a district. The petitions were submitted and filed. City Attorney Robert explained the procedure to be followed to form an assessment district, He suggested that the petitions be examined for sufficiency of the 60% safety factor before hiring an engin- eer of work to prepare a'preliminary survey. However, it was pointed out. by Councilman Battaglia that the engin- eering study could be.us'ed in the, future if.the district did not develop at this time.. Director of Public Works David Young stated.that: the proposed dist'ric't would inc'lud'e all public improvements, i.e., street improvements and water., sewer,�and s:torm.drain facil- ities, but that the improvements would'. vary for each parcel-.' Following some discussion, it was the consensus o,f Council that the -City Engineer and staff review the_petitions.for area sufficiency and report thereon to the Council at its meeting June 15, 1970. Carmel -by.- the -Sea Letter dated May-21, 1970 from Hugh (ai Bayless, City Administrator, City. of Carmel =by- the -Sea requesting $2'00 contribution for legal expenses con- nected with the successful,challenge of - AB :3125 Disclosure 'of Asses;ts law, read .and filed.. A brief disc'us'sion followed,in which it was.sugges.,ted that-the contribution,' -be reduced Mr. Donald Petro,, 1300 G1enw6od'Drive, spoke from the audience against the contribution. A motion was made�'by Councilman Brainerd and secon.ded.by, Councilman Battaglia approving a con�tr bu tion of $50, the City of Carmel -by the -Sea. Planning Director McGivern showed a map of the area. He reported that the 28.0 acre parcel is proposed for a mobilehome development. It.was noted.that two - mobilehome parks exist in the immediate area and another is pro - posed and zoned on North McDowell _Boulevard near Corona Road. Councilman Brainerd requested the record*to show that'he is against further acreage.for mobilehome .parks in area.. The staff .was directed to attend the hearing. After reading the budget message, Mr. Meyer announced that the first budget session will be on'Monday, June 8, 1:970. The City Manager was requested by Councilman Matted to furnish the Council with an advanced schedule of the Departments to.be considered at'a study session so that ample review of those sections can be made.beforehand. Public Liability Purchasing. Officer John.Nolan 'informed Insurance Coverage the Council that the City's present Liability Insurance carrier will extend coverage beyond July. Quotations are expected to, be received next-week and will then be forwarded to the'Coun'cil for review and 'consideration. Vice =Mayor Cavanagh stated that the matter of a $70 charge for coverage,of the.cab`le stretched above-the downtown streets to hold event banners was discussed at the Chamber- of Commerce Board o,f; -Directors' meeting today. Upon checking the matter, .Purchasing:Officer John Nolan reported that*the City's policy does not include this coverage but that further investiga- tion will * be. made. Binding Arbitration It wa's- requested by Councilman.B:attaglia that Senator Collier be contacted regarding the Council' - .s objection.to the proposed State legislation regarding binding arbitration'. Petaluma Ambulance City Manager Robert Meyer reported that the Service private ambulance service companies of the County.. negotiating with the County of Sonoma.for an increase in ambulance rates and guaranteed payment _for transportation of indigent patients. Since the City of Petaluma ambulance service has mad-e,,A0 trips to the Sonoma.County Community Hospital and the City been unable to collect $2,096.40 during the .period of. June, .1, 1969 through May • 30, 1970 for ambul'dnce'service rendered to County indigents, Mr. Meyer asked.the Council for permission to request - the County -that the C'i'ty of , Petaluma ambulance service be-included' in the'County's reimbursement program. A motion was made by Councilman Mattei and seconded by Councilman•Joerger that the City Manager contact: the Board of Super- visors and submit a request as outlined. Motion carried unanimously. o Linda Del Mar Subdivision River Bank -.Petaluma Erosion Councilman Mattei announced that the Council Committee regarding Linda Del'M'ar Sub- division will hold a meeting on June 11, 1970'at 7:30'o'clock•p.m: in the Council Chambers, Hall and that the property owners involved with the Petaluma River Bank erosion problem will be notified. Representatives from the U.'S. Corps of Engineers.and the. Sonoma.County'F.lood Control will be present as well _ as'mem - hers of:the_ staff. Fifth & D Street Mr. Carl Lorenz, representative of Intersection the Church, appeared before the Council -and requested that the red zone located at the north - easterly�corner of "D" Street at Fifth Street be shortened.. He claimed that the vision gained by the length of the red , zone - has;•not - helped. It was pointed out by Chief Police.Larry Higgins that the length.-of said red curb is ft. 10 inches long (two car lengths)._ He also reviewed two accidents which oc- curred within the last two weeks at the.subj intersection but which did not involve the corner by the church. 'In ''the discussion that followed, Coun- 'cilman Matteis opposed the .length of the red curb and felt .that one car length'would• be sufficient. For just- ification of the red curb, he proposed that a study be made of a policy to extend red curbs at intersections throughout the entire City. June 1, 1970 Fifth & D Street Intersection (continued) In reviewing the action of Traffic Committee,'Councilman Joerger stated that its to retain the red curbs as existing at the subject intersecti -on - was .reaff.irmed, .when-.the matter was. referred by the 'Council -for further exploration. He recommended agains't,"refer:ring the matter back to .the. Traffic Committee.again. Upon conclusion of the deliberation, a-motion was made by- Councilman Matted and seconded - by Councilman Battaglia to change -the red.curb.zone to a maximum of one -car length (plus or minus_) for a total of eight car spaces at an inter- section. In reviewing.the,Petaluma City Code , - Ci.ty °Attorney ,Robert pointed out that such action, if adopted, would require an amendment to the Traffic, Ordinance, as,the' Traffic Ordinance authorizes."the City Traffic Engineer to establish such zones. 'The motion and second were withdrawn. A motion was -then made by Councilman Joerger approving the recommendation• of'the Traffic Committee. The motion died for lack of a second. It,was decided that the matter-.be f fiirther considered at ,a Study Session. Tow -Away Zone Purchasing Officer John Nolan reviewed l Res. #5491..N.C.S. the one bid;received'on May 14, 1970 f for tow -away service. The was submitted with exceptions and the major exception deleted the required performance bond., After discussing the bid'with.the Chief.of Police, the Purchasing Officer and the bidder, City Attorney Robert stated t hat I .'in , his this.particular bid could be accepted without the performance bond. He recommended awarding to Petaluma Auto. Body Shop, whereupon . Resolution No. 5491 N.C.S. awarding contract in accordance with the re- quirements entitled "Tow- Away-Service ", was iatroduced'by Councilman Brunner, seconded by.Councilman Brainerd,, *and adopted..by six affirmative vote`s, -one absentee. Beautification Report date d.June 5, 1970 from Director of of Railroad Planning William C. McGivern recommending Rights -of -Way three points be included in the City's proposal to the League of California Cities rega_raiing the Beautification program for railroad propertiea.and r- fights -of -way, submitted-and filed. Said report was approved -by the Council for filing wit -h-the League of California Cities. x � . June ,l , 1970 Maple .Street, Mr. John_.R...Lansdon, 809 Maple Street, -Eucalyptus Tree appeared before.the Council requesting Grove assistance to abate the debris and rubbish accumulated in the Eucalyptus grove located adjacent to Maple Street. He stated that a number of fires have been started in the grove and the res- idents in the area are concerned about the fire hazard and threat to their homes.'''Others present who spoke were: Mr..& Mrs: William Carter, 813 Maple Street, and Mrs: Fagan, address unknown. Mr. Carter reques,ted.that the debris be removed 'for a distance in the grove to - clear an area adjacent to the Y buck yard fences. Fire Chief Ross Benton spoke of the problem but clarified that the grove itself is not a fire hazard but that fires are started by unknown parties. In discussing the problem, it was pointed out by Planning Director McGivern that' tentative map for residential development of the area has been filed.. He suggested that a condition be included to.remove'the trees. The Weed Abatement procedure was also suggested but both processes were considered too slow. To expedite matter, Vice -Mayor Cavanagh, Jr. appointed Councilmen Brunner and Mattei, Police Chief Larry Higgins, and Fire Chief Ross Benton to make afield survey and discuss the problem with the property owner as soon as possible for a suit- able solution. Letter of Commenda- Mr. Larry Forney.presented a petition tion to the.President requesting the Council to sendia letter of the United States of commendation to the President of the United States for his handling of our country's affairs. Inasmuch as such a request requires,Council action, Mr. Forney was advised of the procedure to submit a letter to the City Clerk for the next agenda.
