HomeMy WebLinkAboutMinutes 08/03/19707 -3 Council Meeting Attendance 1 Invocation MINUTES OF MEETING OF CITY_COUNCIL, PETALUMA, August 3, 1970 Regular meeting-of the Council of the City.of Petaluma was called to order by Mayor 'Putnam at the hour.of 7:30'o'clock p.m. Present: Councilmen Battaglia,.Brainerd, r $runne, Cavanagh, Jr., Joerger, Mdttei, and,Mayor Putnam. Absent: None. The invocation was given by the Reverend John Jaster,'St. John's Lutheran Church. Approval of Minutes The minutes of July,20; 1970, and July 27, 1970, were approved as recorded. Audit - Petaluma_ Petaluma Sanitary Disposal Company,.Inc., Sanitary.Disposal, and Bongi Matteri Sanitary Disposal Com- 1 Company & Bongi pang, Inc., Financial Report for Fiscal Matteri Disposal Year.ended March '31, 1970, submitted and Company filed. City Manager Robert Meyer stated that the -audit -has been referred.to Fin- ance Director Gealta and to the-City of Petaluma auditors, and after complete review thereof, a report will be made to the Council at which time the Disposal Company representatives will be present. In response to Councilman Cavanagh, Jr., - City-Attorney Robert explained that Bongi Mat,ter;i - San Disposal Company is a wholly =owned subsidiary of the Petaluma Sanitary Disposal.Company. Withdrawing Parcels Notices of- public hearing by the Local �1/ 3 from-the Penngrove Agency Formation`Commission.of'the County ®' Fire Protection of Sonoma on August 6, 1970, at.3:00 p.m. District in its Meeting Room, Santa Rosa, regard- ing City of Petaluma petition requesting detachment,from,the Penngrove Fire.Protec- tion District for the following annexations to .the City Petaluma: Denman-Annexa- tion No. 2, No. 3, and'No. 4; and, North- east Annexation No. 5, No. 6, No. 7, and No. 8, read and filed. Young Annexation Resolution No. 144 of the Local Agency Res. #5536 N.C.S. Formation Commission of'the County of Sonoma-making d condi- tionally approving the proposed annexa- tion of territory designated as "Young Annexation" to.the City of'Petaluma, read and filed. - Director of Planning William McGivern described the area as being approximately one acre of - land lying acdjacent to the proposed Young Mobile - home.Park on North McDowell Boulevard. Resolution No. 5536 N.C.S., approving the annexation -of certain uninhabited . territory designated "Young Annexation" to the City of Petaluma,.was introduced by Councilinan.Cavanagh, Jr., seconded by Councilman Brunner_, and adopted by 7 affirmative.votes. Public Liability Letter, dated July 31,.1970, from Robert Insurance Coverage T. Stimson of the Petaluma Association August 3, 1970 a� Public Liability of Independent _Insurance Agents, propos- / .(continued) Insurance Coverage i.ng.an insurance program and recommending acceptance of the proposal from Pacific Indemnity Insurance Company,. read and filed. It was agreed by the Council to refer' - the proposal to a Council Committee. Mayor Putnam appointed Councilmen Brunner, Mattei, and Jr.; on the Insur- ance Committee;_ Councilman Brunner to - serve - as-Chairman.. The Committee was directed to contact Mr: Stimson for a meeting as sooii.as possible. Mr. Seim - son, present on behalf of the Association, stated that the existing policy has.been extended `.beyond July , 1, 19 7 0 ,. by-the pre - 'insurance sent carrier. Claims and Bills Resolution No. 5537 N.C.S., approving Res. #5537 N.C.S. Claims- and Bills Nos.' - 834 -to 91.2 inclu- sive and Nos. 124 to 134 inclusive .approved for .payment by the City,Manager was introduced by,Councilman Battaglia, seconded by Councilman Joerger;'and adopted by 7 offirmative.votes. Study.Session City Manager Robert Meyer stated that.' August lu, 1970 the following two items will be con -, sidered at the August 10, 1970, study session: 1. Street Res.ur.facing Report. 2. 'Federal Flood and Mudslide Insurance. State Legislation Mayor Putnam r.eferred'to the League of California Cities Legislative Bulletin requesting an opinion from cities on various Bills before the State. Legisla- ture. SB 476 - AB 1155: Increases,the five member Local Agency Formation.'Commission to.se'ven members by including two representatives.from spec - iai districts The League's view :.that., said Bill will encourage formation of new, special districts and discourage district reorganization, the increase should be a of"discretion of the Commis- sion itself. After a brief - discuss°ion, a. motion was, made by Councilman Joerger and seconded by Councilman Brunner o,ppos- ing*SB 476 and AB 1155. Motion carried by 7 affirmative votes. The Mayor stated. that proper steps will be taken to notify appropriate State legislators.immediately. A B . , Capital T nanc,ing.- Requires procedure for voting on the incurring of indebted- nes`s local governments following the California,Supr:eme Court,Decision which held nvd'f d t'he'two- thirds vote require - ment.contained in the California Consti tutibn. The League is opposed to the feature of, requiring a majority vote for lease - purchase financing, which often has been. the alternative method available to develop essen ial.administration buildings. 1 1 L August 3, 1970 1 State Legislation (cont ) 7.5 City Attorney - Robert pointed out that lease - purchase financing is-not - limited 'to structures, buildings,-etc., but iric'lud equipment and such , other - items for''an amount mot - to justify an election. After'a brief - discussion, it was agreed by the Council that the City Manager notify Assemblyman'Bagley tomorrow that the Coun- c`il is opposed to'the Bill if it is broad and includes equipment and such other items of 'lease - purchase .. 1 AB 2310 - Authorizes the establishment of a Con - servation and Development Agency of the Bay 'Area which' includes the County of Sonoma. The League is opposing this Bill because - t - h'e governing body does - not con- sist solely of Mayors, Councilmen,'and Supervisors,. -but rather is comprised half of-Mayors; Councilmen, and Supervisors and of directly elected Commissioners from 20 within the San Francisco Bay' Area � ' Said'Bill was opposed by the . Council on July•9, 1970'by Resolution No. 5515.N.C.S."; however, Mayor Putnam request- ed''Co:unc l .membbrs; if possible, to re- a:ff •opposition. on an individual basis with legislators. In answer to Councilman.Joerger, Mayor Putnam stated that.i'nformation will be obtained to find out'` whether the.As'sociation of Bay Area Governments has made a public opposition . to - . the 'Bill...
